Regulations on recruiting skilled workers

Article 1 In order to improve the quality of laborers, promote their employment and strengthen employment management, these Provisions are formulated in accordance with the Labor Law of People's Republic of China (PRC), the Vocational Education Law of People's Republic of China (PRC) and relevant state regulations.

Article 2 The State implements the employment system of pre-job training. The employing unit must recruit workers engaged in jobs (occupations) (hereinafter referred to as technical jobs) with complex skills, involving state property, people's life safety and consumers' interests from those who have obtained corresponding professional qualification certificates. The scope of technical jobs shall be determined by the Ministry of Labor and Social Security. The administrative departments of labor security of provinces, autonomous regions and municipalities directly under the Central Government and the labor security institutions of relevant departments in the State Council may, according to actual needs, increase the scope of technical jobs with the approval of the Ministry of Labor and Social Security.

Article 3 The state practices a vocational qualification certificate system, and the examination and appraisal institutions approved by the administrative department of labor and social security conduct examination and appraisal of workers' vocational skills. National vocational qualifications are divided into primary (level 5), intermediate (level 4), advanced (level 3), technician (level 2) and senior technician (level 1).

Article 4 Graduates from technical schools, vocational (technical) schools, employment training centers and various vocational training institutions must obtain corresponding vocational qualification certificates before they can engage in technical jobs.

Article 5 For apprentices engaged in technical jobs, the employing unit shall conduct training in accordance with the apprenticeship period stipulated in the Catalogue of Jobs in People's Republic of China (PRC) and the Catalogue of Jobs in People's Republic of China (PRC). For workers who have been transferred to technical jobs, the employer shall conduct training in accordance with the requirements of the national vocational (skill) standards, and can only take up their posts after meeting the corresponding vocational skills requirements.

Article 6 Due to special needs, with the approval of the administrative department of labor and social security, the employing unit may recruit skilled workers for retraining, but the local training institutions have not yet started training and will not take up their posts until they meet the requirements of corresponding professional skills. Where the employing unit arranges the national policy resettlement personnel to engage in technical jobs, it shall organize training first, and take up their posts after meeting the skills requirements of the corresponding jobs (occupations).

Article 7 Before the promulgation of these Provisions, the employing unit shall train the on-the-job personnel who are engaged in technical jobs but have not obtained the corresponding vocational qualification certificates in accordance with the national vocational (skill) standards, so that they can meet the vocational skill requirements of this job.

Article 8 Employment agencies shall abide by these Provisions when introducing the employment of workers within the scope of technical jobs as stipulated in Article 2 of these Provisions.

Ninth employers and employment agencies to publish advertisements for skilled workers, must indicate the requirements of professional qualifications in the conditions that candidates should have.

Article 10 The administrative department of labor security of the local people's government at or above the county level shall supervise and inspect the compliance of the employing units with these provisions according to law.

Article 11 Where an employing unit, in violation of the provisions of this Ordinance, recruits workers who have not obtained the corresponding professional qualification certificates to engage in technical jobs, the administrative department of labor security shall give a warning and order the employing unit to conduct relevant training for relevant personnel within a time limit, and take up their posts after obtaining the professional qualification certificates, and may also impose a fine of 1000 yuan.

Twelfth the provisions shall come into force as of July 6, 2000+0. The Provisions on Pre-employment Training of Skilled Workers issued by the former Ministry of Labor on June 1995+0 1 day shall be abolished at the same time.
