Measures of Shanghai Municipality on Hydrological Management

Chapter I General Provisions Article 1 (Purpose and Basis)

In order to strengthen hydrological management in this Municipality, standardize hydrological work, develop, utilize, conserve and protect water resources and services for disaster prevention and mitigation, and promote sustainable economic and social development, these measures are formulated in accordance with the Hydrological Regulations of People's Republic of China (PRC) and the actual situation of this Municipality. Article 2 (Scope of Application)

These Measures shall apply to the planning and construction of hydrological station network within the administrative area of this Municipality, hydrological monitoring and forecasting, collection, storage and utilization of hydrological monitoring data, investigation and evaluation of water resources, and protection of hydrological facilities and hydrological monitoring environment.

Hydrological activities of river basin management institutions established by the State Council water administrative department in important rivers and lakes designated by the state within the administrative area of this Municipality (hereinafter referred to as river basin management institutions) shall be implemented in accordance with relevant state regulations. Article 3 (Administrative Department)

Shanghai Water Affairs Bureau (hereinafter referred to as the Municipal Water Affairs Bureau) is in charge of the hydrological work within the administrative area of this Municipality, and its subordinate Shanghai Hydrological Station (hereinafter referred to as the Municipal Hydrological Station) is specifically responsible for organizing and implementing the management work. The Municipal Water Affairs Bureau may entrust the Shanghai Water Administrative Law Enforcement Corps to implement the administrative punishment prescribed by laws, regulations and rules on hydrological management.

The water administrative departments of Pudong New Area, Minhang, Baoshan, Jiading, Fengxian, Songjiang, Jinshan, Qingpu, Chongming and other counties (hereinafter referred to as relevant counties) shall be responsible for the hydrological work within their respective administrative areas according to their functions and powers, and their subordinate hydrological institutions (hereinafter referred to as relevant county hydrological institutions) may be entrusted by the municipal hydrological station to carry out specific hydrological management.

The administrative departments of development and reform, land planning, environmental protection, transportation ports, maritime affairs, meteorology, public security and flood control headquarters of this Municipality shall, within the scope of their respective duties, coordinate the implementation of these measures. Article 4 (Leadership and Guarantee)

The municipal and relevant district and county people's governments shall strengthen their leadership in hydrological work, take active measures to speed up the modernization of hydrology and ensure the coordinated development of hydrology and economy and society. The funds required for hydrological services should be included in the fiscal budget and guaranteed by the finance at the same level. Chapter II Hydrological Planning and Station Network Construction Article 5 (Hydrological Development Planning)

The municipal and relevant district and county people's governments shall incorporate hydrological undertakings into the national economic and social development plan at the corresponding level.

The Municipal Water Affairs Bureau shall, according to the national hydrological development plan, watershed hydrological development plan and the city's national economic and social development plan, organize the preparation of the city's hydrological development plan, and after soliciting the opinions of the relevant administrative departments of the municipal government, report it to the Municipal People's Government for approval and implementation, and report it to the water administrative department of the State Council for the record.

The relevant district and county water administrative departments shall, according to the needs of the city's hydrological development planning and economic and social development, organize the preparation of hydrological development planning in their respective administrative areas, report to the people's government at the same level for approval and implementation, and report to the Municipal Water Affairs Bureau for the record. Article 6 (Planning and Construction of Hydrological Station Network)

The construction of hydrological station network should implement unified planning. The Municipal Water Affairs Bureau, jointly with the municipal development and reform department, shall, according to the national hydrological station network planning and the city's hydrological development planning, organize the preparation of the city's hydrological station network planning in accordance with the principles of overall consideration, combination of distance and distance, rational layout, enjoyment of resources and prevention of duplication, and incorporate it into the corresponding urban and rural planning after being comprehensively balanced by the municipal planning and land department and reported to the municipal government for approval.

In the process of organizing the planning of hydrological station network in this Municipality, the opinions of the administrative departments of environmental protection, transportation and port, maritime affairs and meteorology shall be sought, and the opinions shall be audited by the river basin management agencies.

If it is necessary to adjust the planning of hydrological station network due to the needs of economic development or the changes of rivers, lakes and reservoirs, it shall be submitted for approval in accordance with the procedures specified in the preceding paragraph.

The unified planning of hydrological station network construction in this Municipality shall be incorporated into the annual fixed assets investment plan, and shall be organized and implemented by the Municipal Water Affairs Bureau, relevant district and county water administrative departments, municipal hydrological stations and relevant district and county hydrological institutions (hereinafter referred to as hydrological institutions) in accordance with the national fixed assets investment project construction procedures.

New construction, renovation and expansion of water conservancy projects need supporting construction or renovation of hydrological station network, and the required funds should be included in the project construction budget. Article 7 (Classification and Grading of Hydrological Stations)

Hydrological stations implement classified management.

Hydrological stations in this city are divided into national basic hydrological stations and special hydrological stations.

National basic hydrological stations are divided into national important hydrological stations and general hydrological stations.

According to the actual situation, the Municipal Water Affairs Bureau can determine the municipal important hydrological stations within the administrative area of this Municipality in the general hydrological stations. Article 8 (Establishment and Adjustment of National Basic Hydrological Stations)

The establishment and adjustment of important national hydrological stations shall be put forward by the Municipal Water Affairs Bureau according to the planning of the hydrological station network of this Municipality and reported to the hydrological institutions directly under the water administrative department of the State Council for approval. The establishment and adjustment of general hydrological stations shall be put forward by the municipal hydrological station according to the planning of the hydrological station network of this Municipality, and shall be reported to the hydrological institution directly under the water administrative department of the State Council for the record after being approved by the Municipal Water Affairs Bureau. Article 9 (Establishment of Special Hydrological Stations)

The establishment of a special hydrological station shall be approved by the municipal hydrological station in accordance with the relevant provisions of the state. Among them, if it is necessary to set up a special hydrological station for the administrative management of transportation, shipping and environmental protection, it shall be approved by the relevant administrative departments, and the relevant administrative departments shall solicit the opinions of the municipal hydrological station before approval.
