Interim Provisions of Dalian Municipality on Funeral Management

Rule number one. In order to deepen the funeral reform and promote the construction of socialist spiritual civilization, these Provisions are formulated in accordance with the Regulations of the State Council Municipality on the Administration of Funeral. Article 2 Units and individuals within the administrative area of Dalian shall abide by these Provisions. Article 3 The civil affairs departments of cities, counties (cities) and districts are the administrative departments of the people's governments at the same level responsible for funeral management within their respective administrative areas, and do a good job in funeral management in accordance with laws, regulations and these Provisions.

The administrative departments of public security, health, land planning, forestry, transportation, environmental protection, urban construction and industry and commerce at all levels shall, in accordance with their respective responsibilities, cooperate with the civil affairs departments to do a good job in funeral management. Article 4 State organs, public organizations, enterprises and institutions and neighborhood (village) committees shall actively promote funeral reform, educate cadres, workers and residents to seriously abide by relevant laws, regulations and policies, get rid of feudal superstitions and bad funeral habits, and establish a new fashion of civilized and thrifty funeral management. Article 5 Any unit or individual has the right to stop and report acts in violation of these Provisions. Civil affairs, urban construction, land planning, forestry and other relevant departments shall promptly deal with the report after receiving it, and shall commend and reward those who report meritorious service. Article 6 Within the administrative area of this Municipality, residents (villages) shall be cremated after death, except for individual islands in Changhai County and ethnic minorities who respect funeral customs, and the cremated ashes shall not be buried in coffins.

The burial area in Changhai County is designated by the county people's government and reported to the Municipal Civil Affairs Bureau for approval.

Ethnic minorities who respect the funeral customs prescribed by the state and voluntarily practice cremation shall be encouraged, and others shall not interfere. Seventh four district hospitals in the city should cancel the mortuary. After the death of a resident (village), his relatives or medical units shall notify the funeral home to pick up the corpse. After receiving the notice, the funeral home should immediately go to the hospital for treatment. If an autopsy is required, the funeral home should provide necessary conditions and equipment.

Other county (city), district hospitals should create conditions to gradually cancel the mortuary, temporarily unable to cancel, can only temporarily store the body, and shall not engage in funeral supplies and funeral activities. Eighth corpse transportation shall be borne by the funeral home, and the corpse transportation vehicle shall be hung with the funeral license plate uniformly produced by the Provincial Civil Affairs Department. Ninth residents (village) after death, the body should be cremated within five days. If it is necessary to extend the time of mortuary due to special circumstances, the longest time shall not exceed thirty days. During the mortuary, the body should be sent to the funeral home for storage in principle. Tenth for cremation, should provide the following valid documents to the funeral home:

(a) normal death, belonging to the permanent residence in this city, provide the "death funeral certificate" issued by the local police station where the deceased is located; Do not belong to the city's permanent residence and no other legal proof of residence, provide the "medical certificate of death" issued by the hospital; If a foreigner dies, he shall provide a death certificate issued by the hospital or the public security department at or above the county level and a written application issued by the family of the deceased or the embassy or consulate of the host country.

(two) died of a medical accident, according to the provisions of the State Council "medical accident treatment measures".

(three) other abnormal deaths and nameless bodies, provide death certificates issued by public security departments at or above the county level. Article 11 After a corpse is cremated, the ashes can be stored in an ashes hall or buried in a legal ashes cemetery. We advocate burying graves and epitaphs underground, planting memorial trees or scattering ashes into the sea. Twelfth cemeteries are divided into public welfare and business.

Counties (cities) to establish public cemetery, by the villagers committee application, the township government audit, county civil affairs departments for examination and approval, and report to the Municipal Civil Affairs Bureau for the record; The establishment of public welfare cemeteries in Ganjingzi District, Jinzhou District and Lushunkou District shall be approved by the Civil Affairs Bureau. Public cemetery shall not engage in business activities.

The establishment of operating cemeteries shall be jointly examined by the local county (city), District People's Government and the municipal civil affairs department, and submitted to the Provincial Civil Affairs Department for examination and approval. Thirteenth without the approval of the municipal civil affairs department, no unit or individual may rent, transfer or buy or sell graves.

It is forbidden to establish or restore clan cemeteries. Article 14 No unit or individual may bury graves in scenic spots, cultural relics protection areas, forest parks, nature reserves, dams of reservoirs and rivers, both sides of railways and highways, and cultivated land.

Graves that have been buried in the above-mentioned areas and four districts of the city before the implementation of these Provisions shall be gradually moved out or leveled in accordance with unified planning, except for revolutionary martyrs, celebrities, overseas Chinese and tombs with historical, artistic and scientific value protected by the state. Fifteenth to carry out social paid funeral services and funeral activities, must be approved by the Civil Affairs Bureau.

Funeral service personnel shall abide by professional ethics, implement standardized and civilized services, and shall not take advantage of their work to ask for or accept property. Sixteenth in funeral and sacrificial activities, it is forbidden to erect coffins, make big coffins, blow hair to recite scriptures, throw paper money along the street, burn paper, and play the funeral music of loudspeakers. Do not use funeral activities to extort property.

Religious people who do Dojo for the funeral should do it in the religious activity sites approved by the government. Seventeenth in violation of the provisions, the civil affairs department shall be punished according to the following provisions, including a fine of 1000 yuan, and the civil affairs department may entrust its subordinate funeral management institutions to implement it:

(a) in violation of the provisions of the first paragraph of article sixth, ordered to cremate the flat grave, refused to cremate the flat grave, forced to cremate the flat grave.

(two) in violation of the provisions of the second paragraph of article seventh, a fine of 2 times the illegal income.

(three) in violation of the provisions of article eighth, a fine of 1000 yuan.

(four) in violation of the provisions of article ninth, more than 30 days after the morgue is still not cremated, according to 3 times the fee; Refuse to pay, compulsory cremation.

(five) in violation of the provisions of article twelfth, without the approval of the establishment of public welfare and business cemetery, to meet the conditions for examination and approval, the deadline for completing the formalities; Those that do not meet the examination and approval conditions shall be banned.

(six) in violation of the provisions of the first paragraph of article thirteenth, a fine of 1000 yuan, illegal income, a fine of 3 times the illegal income.

(seven) in violation of the provisions of the second paragraph of article thirteenth or in violation of the provisions of the first paragraph of article fourteenth, in conjunction with the planning and land departments to be banned, ordered to restore the original state, and impose a fine of 1000 yuan. If there are illegal gains, the illegal gains shall be confiscated.

(eight) in violation of the provisions of the first paragraph of article fifteenth, a fine of 3 times the illegal income.

(nine) in violation of the provisions of article sixteenth, the individual shall be fined in 500 yuan, and the unit shall be fined 1000 yuan.
