Article 1 These Measures are formulated in accordance with relevant laws and regulations and the actual situation of this Municipality in order to strengthen the management of police auxiliary personnel of public security organs, standardize their performance of duties and protect their legitimate rights and interests.

Article 2 These Measures shall apply to the administration and supervision of the auxiliary police personnel of the public security organs in this Municipality.

The measures referred to in police auxiliary personnel of public security organs (hereinafter referred to as police auxiliary personnel) refers to the staff who are openly recruited for the society, directly managed and used by public security organs, provide auxiliary support for police activities and related work of public security organs, and do not have the status of people's police, including police auxiliary personnel and service police auxiliary personnel.

Social forces such as security defense team members, security volunteers, village officials, and personnel engaged in internal logistics services such as security, catering and cleaning in public security organs do not belong to police auxiliary personnel.

Article 3 Auxiliary police shall, according to the arrangement of public security organs, engage in auxiliary police work under the command and leadership of the people's police of public security organs, and shall not enforce the law alone or in the name of individuals.

The behavior of police assistants in performing their duties according to law is protected by law, and the consequences of performing their duties are borne by their public security organs.

Article 4 The municipal and district people's governments shall strengthen their leadership over the management of police auxiliary personnel within their respective administrative areas, incorporate the construction of police auxiliary personnel into the national economic and social development plan, and guarantee the required funds.

City and district public security organs are responsible for the management of police auxiliary personnel. City, district organizations, finance, human resources and social security, health, veterans affairs and other departments in accordance with their respective responsibilities to do the relevant work.

Article 5 This Municipality shall, according to regional development, population size and geographical scope, reasonably determine the scale of police auxiliary personnel and scientifically allocate police auxiliary personnel. The employment quota of police auxiliary personnel shall be approved by public security organs, institutions and other departments.

Article 6 The recruitment of auxiliary police personnel in this Municipality shall follow the principles of openness, fairness and competitive selection. The municipal public security organ shall, jointly with the human resources and social security departments, improve the relevant systems and unify the basic conditions, procedures and standards for recruitment.

Article 7 An auxiliary police shall meet the following conditions:

(1) Having China nationality;

(two) support the leadership of the China * * * production party, support the China people * * * and the national constitution, law-abiding, good conduct;

(3) At least 18 years old;

(4) Having the working ability, physical condition and psychological quality necessary for performing their duties;

(five) the auxiliary police have a college education or above, and the auxiliary police have a high school education or above;

(6) There are no circumstances specified in Article 8 of these Measures;

(seven) other conditions required for specific positions as stipulated by the state and this Municipality.

Article 8 Under any of the following circumstances, auxiliary police personnel shall not be recruited:

(1) Having received criminal punishment for committing a crime or being suspected of committing a crime, and the case has not yet been closed;

(two) for gambling, drug abuse, prostitution, whoring by administrative detention or other administrative penalties for public security;

(3) Being listed as the object of joint punishment for dishonesty according to law;

(4) Being expelled from public office or military service;

(five) other circumstances in which the state and this Municipality prohibit the recruitment of auxiliary police personnel.

Article 9 When recruiting police auxiliary personnel, under the same conditions, priority shall be given to the following personnel:

(a) the martyrs who died in the line of duty and the spouses and children of the people's police;

(2) Retired military personnel;

(three) the state and the city to assess and commend the courageous people;

(4) Personnel with professional qualifications or special skills required for specific positions;

(5) Graduates from public security, political and legal colleges or other institutions of higher learning;

(six) other personnel who should be given priority according to the provisions of the state and this Municipality.

Article 10 The employment of police auxiliary personnel shall establish labor relations according to law, and define the post responsibilities, working hours, labor remuneration, social insurance, confidentiality obligations, liability for breach of contract and other rights and obligations of police auxiliary personnel; The service period may be stipulated for police auxiliary personnel who receive special skills training for specific posts.

Eleventh auxiliary police should abide by laws and regulations, work system and discipline, obey the management of public security organs, be loyal to their duties, be diligent and conscientious, keep secrets, and perform their duties in a standardized and civilized manner.

Twelfth police auxiliary personnel can assist the public security organs to carry out the following work:

(a) wiring inquiries, window services, file management and other administrative work;

(two) computer network maintenance, communication security, laboratory analysis and other technical support work;

(three) the custody and maintenance of police equipment and other police security work;

(four) other work that can be carried out with the assistance of police assistants as stipulated by the state and this Municipality.

Thirteenth service police auxiliary personnel can assist the public security organs to carry out the following work:

(a) patrol duty, public security inspection, maintaining public order in major state activities and large-scale mass activities. ;

(two) to divert traffic, discourage and correct traffic safety violations, collect traffic violation information, and maintain traffic order;

(three) to prevent and stop illegal and criminal work such as drug investigation and control;

(4) Accepting reports, registering cases, accepting evidence, collecting and inputting information involved, maintaining order at the scene of cases and incidents, and handling cases and incidents such as public security organs guarding and monitoring criminal suspects and keeping property involved;

(five) to accept the work of dealing with the masses for help, helping the injured and trapped people, and carrying out publicity and education;

(six) other work that can be carried out with the assistance of service police assistants as stipulated by the state and this Municipality.

Fourteenth police auxiliary personnel shall not engage in the following work:

(1) Handling matters involving state secrets;

(two) case investigation and evidence collection, issue an appraisal report, and identify the responsibility for traffic accidents;

(3) Implementing criminal compulsory measures;

(4) Making administrative decisions;

(5) Examining cases;

(6) Keep or equip weapons and police equipment;

(seven) other jobs that the state and this Municipality stipulate that police auxiliary personnel shall not engage in.

Fifteenth police auxiliary personnel during the performance of their duties, in accordance with the provisions, can be equipped with and use information collection and recording equipment, necessary duty and safety protection equipment; Police auxiliary personnel who have obtained the qualification certification of police dog technicians may use police dogs to engage in police auxiliary work in accordance with regulations.

Article 16 The public security organ shall, in accordance with the relevant provisions of the state, issue uniform work certificates, standard clothes and signs to police auxiliary personnel.

When performing their duties, police auxiliary personnel shall carry their work certificates, wear standard clothes and signs in accordance with the regulations; When leaving the post, the public security organ shall take back the certificates, clothes and logos issued.

Seventeenth police auxiliary personnel in the performance of official duties, one of the following circumstances, should be avoided:

(1) I am a party to the case or a close relative of the party;

(2) He or his close relatives have an interest in the case;

(three) I have other relations with the parties to this case, which may affect the impartial performance of duties.

If the party concerned or his legal representative thinks that it may affect the impartial performance of his duties, he may ask him to withdraw; Whether to quit or not is decided by the public security organ where the police auxiliary personnel are located.

Article 18 The public security organs shall carry out classified management of police auxiliary personnel, and define management requirements according to the post characteristics of police auxiliary personnel and service police auxiliary personnel, as well as their political quality, work performance, professional ability and service years. , assess and adjust the level, and linked to wages. The specific measures shall be formulated by the municipal public security organ in conjunction with the departments of organization, finance, human resources and social security.

Nineteenth public security organs should strengthen the education, management and supervision of police auxiliary personnel, carry out education and training on political quality, legal knowledge, code of conduct and discipline style, and improve the professional quality and professional level of police auxiliary personnel; Regularly assess the performance of duties and compliance with laws and regulations of police auxiliary personnel, and the assessment results serve as the main basis for implementing rewards and punishments, adjusting grades and deciding whether to retain them.

Article 20 The public security organ shall provide necessary working conditions and safety protection for police auxiliary personnel to perform their duties, and safeguard the lawful rights and interests of police auxiliary personnel such as rest, vacation and welfare treatment according to law.

Article 21 The municipal public security organ shall, jointly with the departments of finance, human resources and social security, reasonably determine its salary standard and make dynamic adjustment according to the economic and social development, financial situation, professionalism, danger, labor intensity and the level of police assistants.

Article 22 The public security organs and health departments shall establish and improve the emergency medical treatment mechanism, organize, coordinate and guide medical institutions to unblock the first aid channels in accordance with the provisions of the state and this Municipality, and promptly treat police auxiliary personnel who are injured in the line of duty or suffering from acute and critical illness.

Auxiliary police officers who are killed or disabled due to preventing and stopping illegal and criminal acts, rescuing and protecting state property, people's lives and property, or handling emergencies shall enjoy relevant treatment in accordance with regulations; Those who meet the conditions for the assessment of martyrs shall be assessed as martyrs according to law, and their survivors shall enjoy pension benefits.

Twenty-third public security organs shall, in accordance with the relevant provisions, reward police auxiliary personnel with outstanding performance, remarkable achievements and important contributions.

Twenty-fourth public security organs should unblock the channels of complaints and reports, and promptly investigate and deal with complaints and reports of suspected violations of law and discipline in the performance of duties and management of police auxiliary personnel according to law.

Twenty-fifth police auxiliary personnel in violation of the provisions of these measures, by the public security organs in accordance with the relevant provisions to give criticism and education, demotion, not retained. ; Violation of other laws, regulations and rules, shall be investigated for legal responsibility according to law.

Article 26 State organs and their staff members who violate the laws, regulations, rules, work systems and disciplinary provisions on the management of police auxiliary personnel, abuse their powers, neglect their duties, engage in malpractices for selfish ends, shall be dealt with in accordance with administrative sanctions, disciplinary sanctions and other relevant provisions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 27 Whoever obstructs police auxiliary personnel from performing their duties according to law or commits unlawful infringement on police auxiliary personnel, which constitutes a violation of public security administration, shall be punished by public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 28 These Measures shall come into force as of March 6, 2022.
