Measures of Hefei Municipality on the Administration of Recycling of Renewable Resources

Chapter I General Provisions Article 1 In order to strengthen the management of renewable resources recycling industry, promote the development of circular economy, save resources and protect the environment, these measures are formulated in accordance with relevant national laws and regulations and in light of the actual situation of this Municipality. Article 2 The term "renewable resources" as mentioned in these Measures refers to all kinds of wastes that have completely or partially lost their original use value and can regain their use value after recycling and processing.

The main varieties of renewable resources include: waste metal, waste electronic products, waste electromechanical equipment and its parts, waste paper raw materials, waste light chemical raw materials, waste glass and other recyclable wastes. Article 3 These Measures shall apply to the recycling of renewable resources within the administrative area of this Municipality and its supervision and management.

Where there are other provisions in laws, regulations and rules on the recycling management of hazardous wastes and scrapped cars, those provisions shall prevail. Fourth city supply and marketing cooperatives responsible for the city's renewable resources recycling management. The relevant departments determined by the county and district supply and marketing cooperatives or the county and district people's governments shall be responsible for the management of renewable resources recycling in their respective jurisdictions (hereinafter referred to as the competent departments).

The municipal development and reform department is responsible for the management of the comprehensive utilization of renewable resources in this Municipality. County, district development and reform department is responsible for the comprehensive utilization of renewable resources management in this area.

Planning, public security, industry and commerce, commerce, environmental protection, city appearance, finance, real estate, land, taxation, economy and trade, science and technology, urban management administrative law enforcement and other departments shall jointly do a good job in the management of renewable resources recycling according to their respective responsibilities.

Sub-district offices, township (town) people's governments, social neighborhood committees and villagers' committees shall cooperate with the competent departments to do a good job in the management of renewable resources recycling within their respective jurisdictions. Fifth renewable resources industry associations should formulate industry self-discipline norms, and cooperate with the competent authorities to study and formulate industry development plans, industrial policies and related technical norms.

The renewable resources industry association shall accept the business guidance of the competent department and assist the relevant administrative departments to supervise and manage the renewable resources recycling industry. Article 6 Units and individuals are encouraged to reduce waste, economize on use, protect, accumulate and sell renewable resources, and promote the full utilization of renewable resources. Seventh encourage enterprises and individuals to invest in the construction of renewable resources recovery system. Support and encourage enterprises to integrate industry resources and realize large-scale operation. Chapter II Recycling Management Article 8 The recycling management of renewable resources in this Municipality shall establish a recycling network system based on community green classified recycling and environmental protection mobile recycling, with centralized and decentralized trading markets as the carrier, so as to realize the industrialization, recycling and harmlessness of renewable resources. Article 9 The municipal competent department shall, jointly with the relevant departments of development and reform, planning, environmental protection, industry and commerce, land and the county people's government, formulate the industrial development plan of the renewable resource recycling industry and the construction plan of the renewable resource recycling system according to the overall urban planning and the development situation of the renewable resource recycling industry, and implement them after being reported to the Municipal People's government for approval.

County and district authorities shall, according to the construction plan of renewable resources recycling system, determine the setting of renewable resources community recycling outlets within their respective jurisdictions. Tenth municipal departments shall, jointly with environmental protection, industry and commerce, public security, quality supervision, city appearance and other relevant departments, formulate norms for the construction of renewable resources recycling outlets. Article 11 The opinions of industry associations, scientific research institutions and the public shall be solicited when formulating the development plan of renewable resource recycling industry, the construction plan of renewable resource recycling system and the construction specifications of renewable resource recycling outlets. Twelfth railways, ports, airports, military restricted zones and metal smelting enterprises within 200 meters, as well as on both sides of urban primary and secondary roads, are not allowed to set up renewable resources recycling sites; What has been established should be gradually moved out. Thirteenth new residential areas should be reserved for the construction of community recycling sites in accordance with the requirements of the construction plan of renewable resources recycling system.

For completed residential quarters, the owners' congress or the realty service enterprise entrusted by the owners shall provide the site needed for the construction of community recycling sites in accordance with the construction plan of renewable resources recycling system; Unable to provide the required site for the recycling site, the county and district authorities shall negotiate with the owners to set up a mobile recycling site. Fourteenth to apply for the establishment of renewable resource recycling enterprises and individual operators, their sites and locations shall conform to the planning for the construction of renewable resource recycling system, and their site construction and facilities shall conform to the norms for the construction of renewable resource recycling outlets.

To apply for the establishment of renewable resource recycling enterprises and individual operators, the opinions of the competent authorities shall be sought before going through the industrial and commercial registration with the administrative department for industry and commerce. The competent department shall, within 7 working days, put forward opinions on whether the site selection, place and site construction conform to the construction plan of renewable resources recycling system and the norms of network construction.

The community recycling system, the important waste materials distribution market and the renewable resources processing center determined by the construction plan of renewable resources recycling system shall determine the investment operators through bidding; If there are less than three qualified bidders, the investment operators can be determined through consultation. Fifteenth units and individuals engaged in the recycling of renewable resources shall meet the requirements of industrial and commercial administration registration and apply for business licenses according to law.

The administrative department for industry and commerce shall, when handling the business license of the enterprise, indicate whether the recycling of productive scrap metal is included in the business scope.

Individual industrial and commercial households and enterprises whose business scope does not include productive scrap metal shall not recycle productive scrap metal.
