Provisions of Guiyang Municipality on the Safety Management of Recreational Facilities

Article 1 In order to strengthen the supervision and management of the safety of amusement facilities and protect the personal safety of tourists, these Provisions are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this Municipality. Article 2 These Provisions shall apply to the safety management of the design, production, sale, installation and operation of amusement facilities that are engaged in high altitude and high speed and may endanger personal safety within the administrative area of this Municipality. Article 3 The safety management of amusement facilities in this Municipality shall be supervised and managed by the municipal garden administrative department in conjunction with the administrative departments of quality and technology supervision, public security, economy and trade, industry and commerce, transportation and tourism in accordance with the following provisions.

(a) the competent department of landscape administration is responsible for organizing and coordinating the relevant departments to publicize and implement the laws, regulations and rules on the safety management of amusement facilities; Responsible for organizing the approval, acceptance and annual review of amusement facilities projects; Responsible for organizing on-the-job training for operators and employees; Responsible for organizing and coordinating the supervision and management of amusement facilities safety.

(two) the administrative department of quality and technical supervision shall be responsible for the regular supervision and inspection of the quality of amusement facilities produced, distributed and used, and shall, in conjunction with relevant departments, conduct quality acceptance of newly installed amusement facilities.

(3) The units and individuals that the public security organs are responsible for supervising the operation of amusement facilities shall establish and improve the public security system, implement public security preventive measures and implement public security management.

(four) the administrative department of economic and trade is responsible for the regular supervision and inspection of the safety performance of amusement facilities, and in conjunction with relevant departments, the installation quality and safety performance of newly installed amusement facilities are inspected.

(five) the administrative department for Industry and commerce is responsible for issuing business licenses to units or individuals that produce, distribute and operate amusement facilities, and supervising and managing their production and business activities.

(six) the traffic administrative department shall be responsible for the inspection and registration of water sightseeing vessels and facilities in accordance with the relevant provisions, and conduct on-the-job training for the crew.

(seven) the tourism administration department is responsible for formulating the service quality standards for amusement facilities operation, and supervising and inspecting the service quality of amusement facilities operation enterprises according to the standards.

Huaxi District, Wudang District, Baiyun District, qingzhen city, Kaiyang County, xiuwen county and Xifeng County construction administrative departments shall, jointly with the administrative departments of quality and technical supervision, public security, economy and trade, industry and commerce, transportation and tourism. In accordance with the authority prescribed by the municipal government, the daily supervision and management of the safety of amusement facilities within its jurisdiction. Article 4 The recreational facilities in this Municipality shall be planned in a unified way and laid out rationally.

The design, production and sales of amusement facilities must meet the national safety standards and related safety requirements of amusement machines and amusement facilities. Article 5 An amusement facilities production enterprise must have production equipment, process equipment, timing detection means, raw materials, purchased parts and outsourced parts purchased by professional technicians and skilled workers, which must meet the quality requirements, have qualification certificates and technical data, and conduct re-inspection on key parts according to regulations. Sixth trial-produced amusement facilities new products must be inspected by the national amusement machine quality supervision and inspection center or the inspection unit recognized by the provincial quality and technical supervision department before the prototype can be trial-produced. The technical appraisal can only be carried out after the prototype of the new product is put into trial operation for half a year. Article 7 Amusement facilities subject to the administration of production licenses for industrial products shall comply with the relevant provisions of the State on the administration of production licenses for industrial products. Article 8 When selling amusement facilities, users must be provided with quality certificates, product manuals, inspection and maintenance instructions and drawings, designated spare parts and special tools, etc. Products should have Chinese product name, manufacturer's name, address, production date and safe use period. For products subject to production license management, the production license number must be provided.

In the process of equipment installation and debugging, operators and maintenance personnel should be trained for users and after-sales service should be provided. Article 9 Business units of entertainment facilities shall have legal person status, and individuals shall have full capacity for civil conduct. To purchase and install amusement facilities, a written application must be submitted to the municipal administrative department of landscape architecture.

After receiving the project application, the municipal garden administrative department shall, in conjunction with the relevant departments, conduct on-the-spot investigation and study within 15 days, and make feasibility analysis and evaluation opinions. To meet the conditions and agree to the project, issue approval documents; If the project cannot be established, a written reply shall be given. Tenth entertainment facilities business units or individuals, the purchase of entertainment facilities, should implement the inspection and acceptance system. Imported amusement facilities shall be handled in accordance with the relevant provisions of commodity inspection. Eleventh installation of recreational facilities, operating units or individuals should provide engineering geological data and meteorological data, production enterprises should provide basic construction drawings, the construction unit in accordance with the basic construction drawings, production enterprises or installation units to the engineering foundation acceptance before installation. Article 12 After the installation of amusement facilities is completed, the operation unit or individual shall go through the acceptance procedures for the installation quality and safety performance of the facilities with the relevant departments such as quality and technical supervision, economy and trade, public security and so on after the operation is normal through dispatching and load test and the self-inspection is qualified. , to obtain a certificate of conformity, reported to the municipal administrative department of landscape architecture for examination and registration, and put into operation after comprehensive acceptance by the municipal administrative department of landscape architecture.

When conducting a comprehensive inspection, the operating unit or individual shall provide the following information:

(a) a single file of entertainment facilities;

(two) the list of amusement facilities management personnel and the division of responsibilities;

(3) A compilation of amusement facilities safety management systems;

(four) the qualification certificate of the relevant departments and other written materials that should be accepted.

Recreational facilities operating units or individuals that resell recreational facilities shall go through relevant procedures in accordance with the provisions of the preceding paragraph.

Without acceptance or unqualified acceptance; Don't operate without authorization.
