Article 1 In order to promote the development of production, processing and trade of organic products, standardize the certification activities of organic products, improve the quality and management level of organic products, and protect the ecological environment, these Measures are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on Certification and Accreditation and other relevant laws and administrative regulations.

Article 2 The term "organic products" as mentioned in these Measures refers to products produced, processed and sold in accordance with the national standards for organic products for human consumption and animal consumption.

The term "organic product certification" as mentioned in these Measures refers to the activities of certification bodies to evaluate the production and processing of organic products according to the national standards for organic products and the provisions of these Measures.

Article 3 The activities of organic product certification and the production, processing and sales of organic products within the territory of People's Republic of China (PRC) shall abide by these Measures.

Article 4 The National Certification and Accreditation Administration (hereinafter referred to as CNCA) is responsible for the unified management, comprehensive coordination and supervision of organic product certification activities.

Local quality and technical supervision departments and local entry-exit inspection and quarantine institutions (hereinafter referred to as local certification supervision and administration departments) shall, according to their respective responsibilities, supervise and inspect the certification activities of organic products within their respective jurisdictions.

Article 5 The State shall formulate unified basic norms and rules for organic product certification, unified conformity assessment procedures, unified standards and unified marks.

Article 6 The State shall, on the principle of equality and mutual benefit, carry out international mutual recognition of organic product certification and accreditation.

Institutions engaged in organic product certification (hereinafter referred to as organic product certification institutions) shall carry out relevant mutual recognition activities in accordance with the mutual recognition agreement on organic product certification signed by CNCA.

Institutional management

Article 7 An organic product certification institution shall be established in accordance with the law, have the basic conditions stipulated in the Regulations on Certification and Accreditation of People's Republic of China (PRC) and the technical ability to engage in organic product certification, and can only engage in organic product certification activities after being recognized by the accreditation institution recognized by CNCA (hereinafter referred to as the accreditation institution).

Overseas organic product certification institutions shall abide by the Regulations of People's Republic of China (PRC) on Certification and Accreditation and other relevant laws, administrative regulations and the relevant provisions of these Measures when conducting organic product certification activities in China.

Eighth inspectors engaged in organic product certification shall be registered by the recognized institutions before they can engage in organic product certification activities.

Article 9 Institutions engaged in environmental testing and product sample testing activities in the production areas (bases) related to organic product certification (hereinafter referred to as organic product testing institutions) shall have corresponding testing conditions and capabilities, and have passed metrological certification or obtained laboratory accreditation. Article 10 CNCA shall approve the organic product certification institutions that meet the requirements of Article 7 of these Measures.

CNCA regularly publishes the list of organic product certification institutions and organic product testing institutions that meet the provisions of Articles 7 and 9 of these Measures. Certification institutions and product testing institutions not listed in the catalogue shall not engage in certification and related testing activities of organic products.

Certification implementation

Eleventh organic product certification institutions to implement organic product certification, should be based on the national standards for organic products.

The export of organic products shall meet the special requirements of the importing country or region.

Article 12 An organic product certification body shall disclose information such as the standards, basic certification norms, rules and charging standards of organic product certification.

Thirteenth organic product production and processing units and individuals or their agents (hereinafter referred to as the applicant), can voluntarily apply to the organic product certification body for organic product certification. When applying, the following written materials shall be submitted:

(1) The name, address and contact information of the applicant;

(two) the product origin (base) area, production and processing scale;

(3) plans for product production, processing or sales;

(four) the environmental description of the place of origin (base), processing or sales;

(5) Quality management system documents that meet the requirements of production and processing of organic products;

(six) the qualification certification materials of relevant professional technical and management personnel;

(seven) a statement to ensure the implementation of organic product standards, technical specifications and other special requirements;

(8) Other materials.

If the applicant is not a direct producer or processor of organic products, it shall also provide a written contract signed with the producer or processor of organic products.

Article 14 An organic product certification body shall, within 10 days from the date of receiving the written application from the applicant, complete the examination of the application materials and make a decision on whether or not to accept it; If it is not accepted, it shall notify the applicant in writing and explain the reasons.

Article 15 After accepting the certification of organic products, an organic product certification institution shall carry out certification activities in accordance with the procedures stipulated in the basic norms and rules of organic product certification, ensure the integrity, objectivity and authenticity of the certification process of organic products, and completely record and file the certification process.

Article 16 An organic product certification body shall make a certification conclusion in time according to the requirements of relevant standards or technical specifications, and ensure the objectivity and truthfulness of the certification conclusion.

Organic product certification bodies shall be responsible for the certification conclusions made by them.

Seventeenth to meet the requirements of organic product certification, the organic product certification body shall issue the organic product certification certificate to the applicant, and allow him to use the China organic product certification mark; If it does not meet the certification requirements, it shall notify the applicant in writing and explain the reasons.

Article 18 For products produced during the conversion period according to the national standards for organic products, or processed products made from products produced during the conversion period, the word "conversion" and the conversion period shall be indicated on the certificate, and the certification mark of organic conversion products in China shall be used.

Nineteenth organic product certification institutions shall, in accordance with the provisions of the certified units, individuals and certified products to carry out effective follow-up inspection, to ensure that the certification conclusion can continue to meet the certification requirements.

Twentieth organic product certification institutions shall not carry out organic certification of processed products with organic components (weight or liquid volume, excluding water and salt) below 95%.

Article 21 Units and individuals that produce, process and sell organic products and organic product certification bodies shall take effective measures to sell organic products according to the product range and quantity determined by the certification certificate, so as to ensure the consistency of production and sales quantity of organic products.

Certificates and signs

Article 22 CNCA stipulates the basic format of organic product certification certificate and the style of organic product certification mark.

Twenty-third organic product certification certificate shall include the following contents:

(a) the name and address of the certified units and individuals;

(two) the number, origin and product type of the certified products;

(3) Certification categories of organic products;

(4) The standards or technical specifications on which it is based;

(five) the scope of use, quantity, form or method of organic product certification marks;

(6) Issuing institution, date of issuance, period of validity and signature of the person in charge;

(seven) products produced during the transformation period of organic products or processed products made from products produced during the transformation period shall be marked with the word "transformation" and the transformation period.

Twenty-fourth organic product certification certificate is valid for one year.

Twenty-fifth units or individuals that have obtained the organic product certification certificate shall go through the formalities of change under any of the following circumstances within the validity period of the organic product certification certificate:

(1) The certified entity or individual has changed;

(two) the production and processing units or individuals of organic products have changed;

(3) the product category changes;

(four) the conversion of organic products expires and needs to be changed.

Twenty-sixth units or individuals that have obtained the organic product certification certificate shall, within the validity period of the organic product certification certificate, re-apply for certification to the organic product certification institution under any of the following circumstances:

(a) the place of origin (base), processing place or business activities have changed;

(two) other can not continuously meet the requirements of organic product standards and related technical specifications.

Twenty-seventh units or individuals that have obtained the certification certificate of organic products shall make a decision to suspend or revoke the certification certificate in time under any of the following circumstances:

(a) the certified products can not continuously meet the requirements of standards and technical specifications;

(2) the certified unit or individual has changed;

(three) the production and processing units of organic products have changed;

(four) the product model does not match the certificate;

(5) Failing to apply for or use the organic product mark as required.

For the revoked certificate, the organic product certification institution shall take it back.

Twenty-eighth organic product certification marks are divided into China organic product certification mark and China organic conversion product certification mark. See the attachment for the pattern.

The certification mark of ORGANIC products in China is marked with the words "China Organic Products" in Chinese and the corresponding English (organic).

Products produced during the conversion period of organic products or processed products with products produced during the conversion period as raw materials shall use the certification mark of organic conversion products in China. The logo is marked with the words "China Organic Conversion Products" in Chinese and corresponding English.

Twenty-ninth organic product certification marks should be used within the product range and quantity limited by the organic product certification certificate.

The certified unit or individual shall affix the organic product certification mark on the certified product or the minimum package of the product in accordance with the regulations.

Certified units or individuals may print certification marks of organic products on the labels, instructions and advertising materials of certified products, and may enlarge or reduce them in proportion, but they shall not be deformed or discolored.

Article 30 When the organic product certification mark is added to the certified product or the minimum package of the product, the logo or name of the organic product certification institution shall be marked on the adjacent parts, and the relevant patterns or words shall not be larger than the organic product certification mark.

Article 31 No misleading words such as "ORGANIC product", "organic product" ("organic", "CONVERSIONTOORGANIC"), "pollution-free" and "pure natural" shall be marked on products that have not obtained the certification of organic products.

Article 32 The word "organic" may be marked on the product or the packaging and label of the product for processed products with an organic content of 95% or more.

For processed products with an organic content of less than 95% and equal to or higher than 70%, the words "production of organic components" can be marked on the product or product packaging and label.

For processed products with an organic content of less than 70%, the word "organic" can only be indicated in the product composition table.

Organic ingredients should be certified as organic products.

Article 33 When making a decision to revoke or suspend the use of the organic product certification certificate, the organic product certification institution shall also supervise the relevant units or individuals to stop using, temporarily seal up or destroy the organic product certification mark.

Supervision and inspection

Article 34 CNCA shall organize local certification supervision and management departments and relevant units to supervise and inspect the certification of organic products and the production, processing and sales activities of organic products. Supervision and inspection can take the following ways:

(1) Organizing peer review;

(two) to solicit the opinions of the certified enterprises or individuals;

(three) to conduct spot checks on certification and related testing activities, certification decisions and testing results;

(four) to require institutions engaged in organic product certification and testing activities to report their business situation;

(five) to conduct spot checks on the use of certificates and signs;

(six) to inspect the organic products sold;

(seven) accept certification complaints and appeals, and investigate and deal with certification violations.

Article 35 The production and processing units or individuals that have obtained the certification of organic products, as well as the units or individuals engaged in the sales of organic products, shall, in accordance with the national standards for organic products and the provisions of these Measures, establish and improve the system of follow-up inspection in the process of production, processing, packaging, transportation, storage and business operation, and the system of production, processing and sales records and files.

Article 36 Imported organic products shall conform to the provisions of relevant Chinese laws, administrative regulations and departmental rules, and meet the national standards for organic products.

Article 37 If an applicant disagrees with the certification conclusion or decision of an organic product certification body, he may appeal to the certification body that made the conclusion or decision. If you still disagree with the conclusion of the organic product certification body, you can appeal or complain to CNCA.

Penalty clause

Thirty-eighth in violation of the provisions of article twentieth of these measures, the implementation of organic product certification of processed products organic content is less than 95%, shall be ordered to make corrections, and impose a fine of 20 thousand yuan.

Thirty-ninth in violation of the provisions of article twenty-first, shall be ordered to make corrections within a time limit and impose a fine of 1000 yuan to 30000 yuan.

Forty-first violation of the provisions of Article 32 of these measures, shall be ordered to make corrections, and impose a fine of more than 30000 yuan 10000 yuan.

Article 42 Other illegal acts such as forgery, fraudulent use, trading and transfer of organic product certification certificates and certification marks shall be punished in accordance with the provisions of relevant laws, administrative regulations and departmental rules.

Article 43 If an organic product certification institution, an organic product testing institution or a person engaged in organic product certification issues a false certification conclusion or the certification conclusion issued is seriously untrue, it shall be punished in accordance with the provisions of Chapter VI of the Regulations on Certification and Accreditation of People's Republic of China (PRC).

Forty-fourth organic product certification fees shall be implemented in accordance with the provisions of relevant national price laws and administrative regulations.

Article 45 These Measures shall be interpreted by the General Administration of Quality Supervision, Inspection and Quarantine.
