Measures of Wuhan Municipality on the Administration of Temporary Parking of Motor Vehicles on Roads

Article 1 These Measures are formulated in accordance with the Road Traffic Safety Law of the People's Republic of China, the Regulations on the Administration of Urban Roads and other relevant laws and regulations, combined with the actual situation of this Municipality, in order to strengthen the management of motor vehicle parking in this Municipality, standardize the road parking order and ensure the safe and smooth urban roads. Article 2 These Measures shall apply to the planning, setting and use of urban road parking spaces in the central city of this Municipality and the supervision and management activities of temporary parking of motor vehicles.

The term "urban road parking spaces" as mentioned in these Measures refers to the area designated by the traffic administrative department of the public security organ in accordance with the law within the red line of the road and temporarily parked for motor vehicles within a certain period of time. Article 3 The establishment and management of urban road parking spaces shall follow the principles of unified planning, rational layout, convenience for the masses and unimpeded. Article 4 The municipal urban management department is the competent department in charge of the temporary parking management of motor vehicles in this Municipality, and is responsible for organizing the formulation of relevant norms for the management and service of temporary parking of motor vehicles in this Municipality; Organize the construction of urban road parking intelligent management system and divide the charging areas; Organize bidding activities for urban road parking berth franchise rights, and determine the operators of urban road parking berths; Conduct comprehensive coordination, inspection, guidance, supervision and assessment of urban road parking management, and entrust urban road parking management institutions to implement daily management.

The municipal development and reform (price) administrative department is responsible for formulating or adjusting the urban road parking fee standards, and supervising and inspecting the implementation of the motor vehicle parking fee standards.

The traffic administrative department of the public security organ shall be responsible for the management of urban road parking order and the planning, dismantling and adjustment of urban road parking berths, and investigate and deal with urban road parking violations according to law.

Land planning, urban construction, finance, industry and commerce, gardens, forestry and other administrative departments shall, according to their respective responsibilities, do a good job in the management of temporary parking of motor vehicles on roads. Article 5 The traffic administrative department of the public security organ shall plan and adjust road parking spaces within the red line of urban roads, and shall comply with the relevant regulations, technical requirements and standards, and abide by the following provisions:

(a) does not affect the passage of pedestrians and vehicles;

(two) shall not occupy fire exits, medical emergency exits and municipal infrastructure, and shall not interfere with the normal use of fire facilities, medical emergency facilities and municipal infrastructure;

(three) in line with the requirements of regional road parking total control. Sixth the following sections and areas are prohibited from setting up road parking spaces:

(1) Main highways;

(2) One-way traffic organization, with a width less than 6 meters, and two-way traffic organization, with a width less than 8 meters;

(three) other areas or road sections jointly determined by the traffic management department of the municipal public security organ and the urban management department. Article 7 The traffic administrative department of the public security organ shall inform the urban administrative department of the planning, dismantling or adjustment of urban road parking spaces and make an announcement to the public.

The traffic administrative department of the municipal public security organ shall, jointly with the municipal urban management department, evaluate the urban road parking spaces in this city every year, and timely increase or decrease the urban road parking spaces according to the urban development.

If the demolition of urban road parking spaces causes losses to the operators of urban road parking spaces, the relevant construction units shall compensate them; Unable to determine the main body of construction, the municipal urban management department in conjunction with the municipal finance department shall appropriately reduce its franchise fees. Eighth in any of the following circumstances, the traffic administrative department of the public security organ shall dismantle the urban road parking spaces:

(a) the traffic conditions of urban roads have changed, and parking on urban roads affects the normal traffic of vehicles;

(two) urban infrastructure construction or other public welfare projects need to be demolished;

(three) other circumstances that should be dismantled as stipulated by laws and regulations.

If it is necessary to temporarily occupy temporary road parking spaces due to traffic control, large-scale activities, emergency rescue and emergency handling, the traffic management department of the public security organ may make a decision to suspend the use of temporary road parking spaces. The use of urban road parking spaces is suspended, and the operators of urban road parking spaces shall set up obvious signs to announce to the public. Ninth urban road parking spaces and ancillary facilities belong to urban road traffic public facilities, and no unit or individual may set up, change, damage or dismantle them without authorization.

No unit or individual is allowed to set up obstacles that hinder parking in urban road parking spaces without authorization. Article 10 Operators of urban road parking spaces shall obtain the right to operate through bidding. The bidding is organized and implemented by the municipal urban management department, and the bidding income is turned over to the finance, and its use is announced to the public. Eleventh urban management departments should sign franchise agreements with urban road parking operators. The agreement shall include the rights and obligations of both parties, the duration and the circumstances of termination of the agreement.

City road parking operators in any of the following circumstances, the city management department shall urge the city road parking operators to carry out rectification, coordination fails, you can terminate the agreement:

(a) because of the service quality dispute of urban road parking berth operators, which has a bad influence;

(two) failing to provide services in accordance with the original commitment standards;

(3) Failing to pay the tender fees in full and on time;

(four) unauthorized sublease, subcontract, affiliated business;

(five) the implementation of illegal acts, refused to correct;

(six) refusing to cooperate with the maintenance, excavation and repair of urban road facilities.
