Chapter 1 General Provisions Article 1 In order to strengthen the planning, construction and management of parking lots, meet parking needs, improve road traffic conditions, and protect the legitimate rights and interests of parking lot operators and parkers, in accordance with relevant laws and These measures are formulated based on laws and regulations and in light of the actual situation of this city. Article 2 These Measures shall apply to the planning, construction and related management activities of parking lots within the jurisdiction of this city. Article 3 The term “parking lot” as mentioned in these Measures refers to an open-air or indoor place for parking of various motor vehicles. Specifically divided into the following categories:
(1) Public parking lots: refers to commercial parking lots that provide services for social vehicles and special-purpose vehicles;
(2) ) Special parking lot: refers to a non-commercial parking lot mainly used for parking vehicles of the unit;
(3) Temporary parking spaces: refers to the parking spaces temporarily set up on urban roads for parking of motor vehicles. Article 4 The municipal transportation administrative department is the administrative department in charge of various parking lots in this city and is responsible for organizing, coordinating, and implementing the planning, construction, and supervision and management of parking lots in the city. The road transportation management agency to which it belongs is responsible for the specific management work and, in conjunction with the traffic management department and planning department of the municipal public security organ, plans, approves, supervises and manages temporary parking spaces.
Public security, planning, urban management, price, construction, land, real estate, finance, industry and commerce, taxation and other competent departments should do a good job in the management of motor vehicle parking lots in accordance with their respective responsibilities.
Each district government should cooperate in the planning, approval and related management of parking lots within its jurisdiction. Article 5 The municipal transportation administrative department shall establish a coordination mechanism for parking lot management in conjunction with the public security, planning, urban management, price, construction, land, real estate, finance, industry and commerce, taxation and other competent departments. Article 6 The establishment and management of parking lots shall follow the principles of overall planning, rational layout, supporting construction first, and standardized use. Article 7 The competent government departments and relevant departments shall formulate preferential policies to support the construction of parking lots. Encourage legal persons, natural persons or other economic organizations to invest, construct, operate and manage parking lots in accordance with the principle of "who invests, builds; who operates, benefits; who charges fees, manages". Chapter 2 Planning and Construction Article 8 The municipal transportation administrative department shall, in conjunction with the public security, planning, urban management, land, construction and other departments, prepare a special project for public parking lots in accordance with the city's overall plan, the special urban road traffic plan and the needs of urban traffic development. The plan shall be implemented after approval by the Municipal People's Government.
The municipal traffic administrative department shall, in conjunction with the traffic management department of the municipal public security organ, urban management, planning and other competent departments, prepare a plan for the installation of temporary parking spaces for motor vehicles based on the needs of urban traffic management and announce it to the public. Article 9 When the municipal urban and rural planning department organizes the preparation of plans for new areas, large (medium) commercial markets, residential areas and old city renovations, it shall plan and build parking lots in accordance with urban planning standards. Article 10 The construction of parking lots shall follow the principles of conservation and intensive use of land, make full use of the underground space in green areas, squares and other places to build underground parking lots; make full use of three-dimensional space to build three-dimensional parking lots.
The parking lot land identified in the special planning for public parking lots shall not be changed in use without adjustment through legal procedures. For public parking lots, land use procedures must be completed in accordance with the law. Article 11 Newly built projects shall set up supporting parking lots in accordance with relevant national and provincial motor vehicle parking design specifications and standards. The supporting parking lots shall be designed, constructed and delivered simultaneously with the main project.
Renovated or expanded public buildings, commercial blocks, residential areas, large (medium) wholesale trade markets, squares, etc. should be equipped with or added parking lots. If there are insufficient parking spaces, It should be renovated or expanded in a timely manner, and the parking lot put into use must not be stopped or used for other purposes without authorization. Article 12 If the function of a building changes, the parking lot that has been built shall not be used for other purposes.
If the parking lot already built when the function of the building is changed cannot meet the standards for parking spaces after the function is changed, the parking lot or parking spaces shall be built according to the standards after the function is changed.
Article 13 The design scheme of public parking lots and special parking lots shall comply with the design standards and installation specifications of public parking lots and special parking lots at the national, provincial and municipal levels. The construction unit and construction unit shall not change the planning and design plan without authorization.
After the public parking lot and special parking lot are completed, they must be accepted by the transportation, public security, planning, fire protection and other departments before they can be delivered for use. Chapter 3 Supervision and Management Article 14 The public parking lots invested and constructed by the government shall adopt the method of public bidding and select professional parking management units to operate them. The income from the transfer of operating rights shall be turned over to the municipal finance in full and collection shall be implemented. Support two lines of management.
For public parking lots invested and constructed by other social organizations and individuals, the property owners can operate them themselves or entrust professional parking management units to operate them. Article 15 Parking lot operators shall handle industrial and commercial and tax registration procedures in accordance with the law, and file with the municipal transportation administrative department within 15 days after industrial and commercial registration. The following materials should be submitted when filing: (1) Parking lot operation and management systems and basic information of employees; (2) Parking lot traffic organization plan, floor plan, Technical information such as the number of berths;
(3) Copies of business license and tax registration certificate;
(4) Approval recommendations from the traffic management, planning, urban management and other departments of the public security organ.
If a public parking lot operator changes the registration items or is approved to cease operations, he shall go through relevant procedures with the industry and commerce and taxation departments in accordance with the law, and report to the transportation administrative department within 15 days from the date of change or suspension of operations.
