Labor dispatch cannot be dispatched for a long time. Generally, a dispatch labor contract can be signed for up to 2 years.

According to Article 58 of the "Labor Contract Law of the People's Republic of China", a labor dispatch unit is an employer as referred to in this law and shall perform the employer's obligations to workers. The labor contract concluded between a labor dispatch unit and the dispatched worker shall, in addition to the matters specified in Article 17 of this Law, also specify the employer of the dispatched worker, the dispatch period, the job position, etc.

The labor dispatch unit shall enter into a fixed-term labor contract of more than two years with the dispatched workers and pay labor remuneration on a monthly basis; during the period when the dispatched workers are not working, the labor dispatch unit shall follow the regulations of the local people's government. The minimum wage standard shall be paid to them on a monthly basis.

Article 63 of the "Labor Contract Law of the People's Republic of China": Dispatched workers have the right to equal pay for equal work as workers in the employing unit. The employer shall, in accordance with the principle of equal pay for equal work, implement the same labor remuneration distribution method for dispatched workers and workers in similar positions within the unit. If the employing unit does not have workers in similar positions, the labor remuneration of workers in the same or similar positions shall be determined with reference to the location of the employing unit.

The labor remuneration paid to the dispatched workers stated or agreed upon in the labor contract concluded between the labor dispatch unit and the dispatched workers and the labor dispatch agreement concluded with the employing unit shall comply with the provisions of the preceding paragraph.
