Regulations of Heilongjiang Province on Police Auxiliary Personnel of Public Security Organs
The auxiliary police mentioned in these Regulations refers to non-people police personnel who are openly recruited for the society and provide auxiliary support for the daily operation and police activities of public security organs, including civilian auxiliary police and service auxiliary police.
Social forces such as public security joint defense, public security volunteers, village protection teams and school protection teams, and personnel engaged in logistics services such as catering, security and cleaning in public security organs do not belong to the auxiliary police. Article 3 Auxiliary police work under the command or leadership of public security organs and their people's police. The behavior of auxiliary police in performing their duties according to law is protected by law, and natural persons, legal persons and unincorporated organizations should support and cooperate. Article 4 The management of auxiliary police shall follow the principles of standardization according to law, clear rights and responsibilities, strict supervision and reasonable guarantee, and whoever uses, manages and is responsible.
The people's governments at or above the county level shall strengthen their leadership over the management of auxiliary police within their respective administrative areas, establish a work coordination mechanism, implement safeguard measures, and study and solve major problems in the management of auxiliary police.
Public security organs at or above the county level shall be responsible for the recruitment, use and management of auxiliary police within their respective administrative areas.
Institutions, finance, human resources and social security, veterans affairs and other departments shall, according to their respective responsibilities, * * * do a good job in related work. Fifth people's governments at or above the county level shall, according to the needs of public security work, local economic and social development and social security situation, rationally allocate the auxiliary police force and strictly control the team size. Article 6 The auxiliary police shall implement post system management. According to the principle of total control, adapting to demand, leaning to the grassroots level and dynamic adjustment, it is approved and used in different levels.
The specific number of auxiliary police posts is proposed by the public security organs at or above the county level, and approved by the people's government at the same level after the establishment of institutions at the same level, human resources and social security, and financial departments.
Public security organs at all levels shall not recruit auxiliary police if the vacancy rate of political science and law majors exceeds 10%. Seventh people's governments at or above the county level shall include the auxiliary police's salary and welfare, equipment configuration, education and training, insurance, incentives and daily management funds in the fiscal budget at the corresponding level. Chapter II Recruitment Article 8 The recruitment of auxiliary police shall follow the principles of openness, equality, competition and merit selection, and unify the standards and procedures.
The public security organs at or above the county level shall, according to the work needs and job vacancies, put forward a recruitment plan, which shall be audited by the competent departments of human resources, social security and finance at the same level and reported to the people's government at the same level for examination and approval.
The recruitment plan shall be publicized to the public.
Public security organs at all levels shall report the recruitment and use of auxiliary police to the public security organ at the next higher level for the record. Ninth auxiliary police candidates shall meet the following conditions:
(1) Having China nationality;
(two) support the leadership of the China * * * production party, support the Constitution of People's Republic of China (PRC), abide by laws and regulations, and have good conduct;
(three) at least eighteen years of age but under thirty-five years of age. In hard and remote areas, special posts and urgently needed talents, the upper age limit can be relaxed to 40 years old;
(4) Having a college degree or above and the ability to perform post responsibilities. In hard and remote areas or veterans, their academic qualifications can be relaxed to senior high school, but when they are promoted to the third-class auxiliary police, they should obtain college education or above;
(five) physical and mental health, in line with the physical assessment and physical examination standards of the people's police.
Public security organs at or above the municipal level may make supplementary provisions on the above provisions and strictly limit the recruitment conditions. Article 10 Under the same conditions, persons under any of the following circumstances shall be given priority to be employed as auxiliary police:
(1) Spouses and children of martyrs, people's policemen and auxiliary policemen who died in the line of duty;
(2) Retired soldiers and courageous people;
(3) graduates of public security, political and legal colleges or political and legal majors;
(four) other personnel who should be given priority according to the provisions of the state and the province. Eleventh any of the following circumstances, shall not be recruited as an auxiliary police:
(1) Being investigated for criminal responsibility according to law or suspected of violating the law, and the investigation has not yet been concluded;
(two) by administrative detention or judicial custody punishment;
(3) Being expelled from public office or military service, or being expelled for violating discipline and law;
(4) Being listed as the object of joint punishment for dishonesty according to law;
(five) engaged in auxiliary police work contract expires without leaving;
(six) other circumstances stipulated by the state and the province that are not suitable for police auxiliary work. Twelfth auxiliary police recruitment by the public security organs at or above the county level in conjunction with the human resources and social security departments at the same level in accordance with the approved employment plan.
Public security organs recruit auxiliary police through unified recruitment procedures, and all police types, departments and grass-roots departments of public security organs are not allowed to organize recruitment by themselves.
