Regulations of Chongqing Municipality on Building Energy Conservation

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Energy Conservation Law of People's Republic of China (PRC), the Building Law of People's Republic of China (PRC), the Renewable Energy Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the construction (renovation and expansion) of buildings within the administrative area of this Municipality, the energy-saving renovation of existing buildings, the operation and management of energy-using systems for civil buildings and related management. Article 3 The term "building energy conservation" as mentioned in these Regulations refers to the activities of adopting energy-saving building technologies and materials in the planning, design, construction and use of buildings to reduce building energy consumption and make rational and effective use of energy on the premise of ensuring the building's use function and indoor thermal environment quality.

The term "civil buildings" as mentioned in these Regulations refers to residential buildings and public buildings (including buildings with civil building functions in industrial construction projects). Article 4 The people's governments of cities, districts and counties (autonomous counties) shall strengthen their leadership in building energy conservation, organize relevant departments to carry out publicity and education on building energy conservation, popularize scientific knowledge on building energy conservation, and raise the awareness of building energy conservation of the whole society.

The people's governments of cities, districts and counties (autonomous counties) shall incorporate the work of building energy conservation into the national economic and social development plan and energy development plan at the corresponding level. Fifth city, county (Autonomous County) construction administrative departments responsible for the supervision and management of building energy conservation within their respective administrative areas.

City, county (Autonomous County) Economic Commission, development and reform, science and technology, planning, land, real estate, quality supervision, finance, government management and other departments shall, in accordance with their respective responsibilities, do a good job in building energy conservation management. Chapter II General Provisions Article 6 The people's governments of cities, districts and counties (autonomous counties) shall encourage scientific research and technological development of building energy conservation, popularize and apply building energy conservation technologies, promote the development and utilization of renewable energy in civil buildings, and give play to the role of social intermediary organizations in promoting building energy conservation. Seventh municipal construction administrative departments shall organize the preparation of the city's building energy-saving special planning, and organize the implementation after the approval of the Municipal People's government. Eighth local building energy efficiency standards shall be formulated by the municipal construction administrative department in conjunction with the municipal standardization administrative department, and announced according to legal procedures. Article 9 The municipal construction administrative department shall, jointly with relevant departments, establish an announcement system for determining the technical performance of building energy conservation, and formulate, publish and update the catalogue for promotion and use and the catalogue for restriction or prohibition in a timely manner. Tenth new (reconstruction, expansion) buildings or existing buildings with renewable energy application conditions, should give priority to the use of renewable energy. Chapter III Energy Efficiency of New Buildings Article 11 New construction projects shall implement mandatory standards for building energy efficiency. In the reconstruction and expansion of building envelope and energy system, building energy-saving measures should be taken in accordance with the mandatory standards for building energy efficiency. Twelfth construction project design or planning administrative departments to review the design, should be from the building layout, shape, orientation, lighting, ventilation, greening and other aspects of comprehensive consideration of energy utilization and building energy conservation requirements. Thirteenth preliminary design and construction drawing design of construction projects shall meet the requirements of mandatory standards for building energy conservation. In the preliminary design stage, special articles on building energy-saving design and engineering thermal calculation shall be compiled in accordance with relevant state regulations, and in the construction drawing design stage, the technical measures specified in the preliminary design approval opinions and mandatory building energy-saving standards shall be implemented.

When reviewing the construction drawing design documents, the construction drawing review institution shall review the contents of energy-saving design, and separate energy-saving review chapters in the review report. Do not meet the mandatory standards for building energy efficiency, the construction drawing design document review conclusion shall be classified as unqualified, and the municipal and district/county (autonomous county) construction administrative departments shall not issue construction permits. Fourteenth construction units shall not express or imply that design units and construction units violate the mandatory standards for building energy efficiency in design and construction; It is not allowed to express or imply that the construction unit uses materials, products, equipment and building components that do not meet the mandatory standards for building energy conservation and the requirements of construction drawing design documents.

The construction unit shall purchase relevant materials, products, equipment and components in accordance with the contract, and the construction unit shall ensure that it meets the requirements of mandatory building energy efficiency standards and construction drawing design documents. Article 15 The construction unit shall inspect the wall materials, insulation materials, doors and windows, heating and refrigeration systems and lighting equipment entering the construction site, and shall not use the energy consumption indicators indicated in the product specifications and product labels that do not meet the mandatory standards for building energy efficiency and the construction drawing design documents.

For the materials and parts that must be witnessed and sampled for inspection as stipulated by the state and this Municipality, the construction unit shall conduct on-site sampling under the supervision of the construction unit or supervision unit, and send them to the building energy-saving testing institution for testing. Sixteenth construction units and supervision units shall carry out construction and supervision in accordance with the requirements of the state and this Municipality on building energy efficiency, mandatory standards for building energy efficiency and construction drawing design documents. Seventeenth construction quality supervision institutions should incorporate building energy conservation into the important content of construction quality supervision, and strengthen the supervision and inspection of the construction process of building energy conservation projects. When submitting the quality supervision report of construction projects, there should be special supervision opinions on building energy conservation.
