Decision of Benxi Municipal People's Government on Promulgating the Cleaning Results of Government Regulations and Normative Documents (20 17)

First, the "Measures for Maternity Insurance in Benxi City" (DecreeNo. 139 of the municipal government) was revised.

(1) Paragraph 1 of Article 11 is amended as: The employer has continuously paid for the maternity workers for 10 month, and the workers who meet the national and provincial population and family planning policies enjoy maternity insurance benefits.

Three, "Benxi city motor vehicle maintenance management measures" (municipal government decreeNo. 162) to change.

(1) Paragraph 3 of Article 11 is amended as: Motor vehicle maintenance operators shall first go through the relevant registration formalities with the administrative department for industry and commerce, and then apply to the traffic administrative department for a motor vehicle maintenance business license according to law.

(two) delete item (two) of article thirty-sixth. Four, the "measures for the administration of dangerous houses in Benxi city" (municipal government decreeNo. 164) is changed.

(1) Article 11 is amended as: The appraisal of dangerous houses shall be conducted in accordance with the Appraisal Standard for Dangerous Houses (JJ125-2016) promulgated by the Ministry of Housing and Urban-Rural Development, and with reference to relevant professional technical standards, norms and procedures.

Housing risk assessment is divided into grade A, grade B, grade C and grade D. ..

Grade A: there are no dangerous components, and the building structure can meet the requirements of safe use;

Grade B: individual structural members are assessed as dangerous members, but the safety of the main structure is not affected, which can basically meet the requirements for safe use;

Grade C: Some load-bearing structures can't meet the requirements of safe use, and the house is in a dangerous state locally, which constitutes a local dangerous house;

Grade D: The load-bearing structure can no longer meet the requirements of safe use, and the whole house is in a dangerous state, which constitutes a whole dangerous house.

(2) Paragraph 2 of Article 12 is amended as: If the house is identified as non-dangerous, the validity period of the house safety appraisal report is 1 year. Five, "Benxi coal mine safety management measures" (municipal government decreeNo. 180) to change.

(1) Paragraph 3 of Article 8 is amended as: Coal mine special operators shall receive special safety operation training in accordance with relevant state regulations and obtain corresponding qualifications before taking up their posts.

(2) Article 12 is amended as: Coal mining enterprises shall promote the standardization of safety production in accordance with the relevant provisions of the state.

(3) Article 14 is amended as: Coal mining enterprises shall extract and use safety fees in accordance with the relevant provisions of the state and the province.

Coal mining enterprises shall, in accordance with the provisions of the state, establish and improve the safety production liability insurance system. Pay work-related injury insurance premiums for employees participating in work-related injury insurance according to law. Encourage coal mining enterprises to handle accidental injury insurance for underground workers and pay insurance premiums.

Coal mining enterprises shall provide workers with labor protection articles that meet national standards or industry standards free of charge. Do not replace labor protection articles with money or other articles; Do not buy or use special labor protection articles without safety signs. The purchased special labor protection articles shall be checked and accepted by the safety production management organization or safety production management personnel of coal mining enterprises.

(4) Article 29 is amended as follows: If a coal mining enterprise, in violation of the provisions of the third paragraph of Article 14 of these Measures, fails to provide workers with labor protection articles that meet the national standards or industrial standards free of charge, replaces labor protection articles with money or other articles, and purchases or uses special labor protection articles without safety signs, the coal mine safety production supervision and management department shall order it to make corrections within a time limit and may impose a fine of not less than 5,000 yuan but not more than 50,000 yuan; If it fails to make corrections within the time limit, it shall be fined between 50,000 yuan and 200,000 yuan, and the directly responsible person in charge and other directly responsible personnel shall be fined between 6,543,800 yuan and 20,000 yuan; If the circumstances are serious, it shall be ordered to suspend production and business for rectification. If a crime is constituted, criminal responsibility shall be investigated according to law.

In addition, the order of relevant government regulations has been adjusted accordingly.
