1. Prove that you have a labor relationship. There are two ways to do this:

(1) Prove that you signed a labor contract at that time. Labor contracts are generally made in duplicate or triplicate, one for the unit and one for the employee. Therefore, it is useless to modify only the unit copy. You just need to take out your own copy. In addition, some units will sign labor contracts but not give them to employees. If your company is like this, you can find someone to prove that you signed a labor contract at that time, or you can find someone who works or holds the same position as you. If it is a labor contract, you can have a labor relationship with the unit anyway.

(2) Prove that you have a labor relationship from a factual point of view. The biggest difference between labor relations and labour relation is that employees are managed by enterprises, while labour relation is not, because you can find out the evidence of the usual management of the unit, such as the rules and regulations related to your post, attendance system, reward and punishment system, etc. Or you can find more colleagues to prove that you usually punch in and out of work, which is under the jurisdiction of the unit.

2. About testifying. According to what you said, you complained to the supervision and law enforcement bureau, but people didn't finish it, so I asked you to apply for labor arbitration, just like the court, but the burden of proof was reversed. Article 6 of the Labor Dispute Mediation and Arbitration Law bears the burden of proof for the claims made by the parties. If the evidence related to the disputed matter belongs to the management of the employer, the employer shall provide it; If the employer fails to provide it, it shall bear the adverse consequences.
