Interim Measures of Shenyang Municipality on Implementing the Minimum Living Security System for Urban Residents (full text)

The Interim Measures for the Implementation of the Minimum Living Security System for Urban Residents in Shenyang, which has been adopted at the second executive meeting of the Municipal People's Government, are hereby promulgated and shall come into force as of 1 April, 1998. Chapter I General Provisions

Article 1 In order to improve the social security system, safeguard the basic rights and interests of urban residents in our city and maintain social stability, these Measures are formulated in accordance with the relevant provisions of the state and with the actual situation of this Municipality.

Article 2 The minimum living guarantee system for urban residents as mentioned in these Measures refers to the minimum cost assistance system that combines the minimum wage standard, the minimum living guarantee standard for laid-off workers, the basic living guarantee standard for trustees, the unemployment benefit standard and the minimum retirement fee standard to ensure the basic living of urban residents in our city.

Article 3 Where the household registration is in the urban area of this Municipality (including xinmin city, Liaozhong County, Faku County and Kangping County where the government is located), and the per capita monthly income of the family is lower than the minimum living guarantee standard for urban residents in this Municipality, these Measures shall apply.

Fourth the implementation of the minimum living security system for urban residents, adhere to the principle of enterprises, institutions, families and individuals, supplemented by government assistance.

Fifth civil affairs departments at all levels are the functional departments that implement the minimum living guarantee system for urban residents, and the relevant departments such as finance, labor, economic restructuring commission and trade unions. Should be in accordance with the division of responsibilities with the civil affairs departments to implement the minimum living security system for urban residents.

Chapter II Safeguard Standards

Article 6 The minimum living standard for urban residents: Heping District, Shenhe District, Huanggu District, Tiexi District, Dadong District, Yuhong District and Dongling District is 150 yuan per month; Sujiatun District, Xinchengzi District, xinmin city and Liaozhong County 130 yuan; Average monthly income of Kangping County and Faku County 120 yuan.

Article 7 If the per capita real income of urban households is lower than the minimum living guarantee standard for urban residents, they may apply for the minimum living guarantee for urban residents, and issue and supplement the minimum living guarantee for urban residents after approval by the relevant departments.

Article 8 The relevant standards of the minimum living guarantee system for urban residents may be adjusted by the Municipal People's Government in a timely manner and announced to the public according to the price changes of daily necessities and the improvement of people's living standards in our city.

Chapter III Guaranteed Objects

Article 9 The object of minimum living guarantee for urban residents is: residents who have no source of livelihood, no ability to work, and can't decide their dependents; Residents who have not been re-employed during the period of receiving unemployment benefits or after the expiration of the period of unemployment benefits, and the per capita income of their families is lower than the minimum living standard; Residents whose per capita income is still lower than the minimum living standard after receiving wages or minimum wages, basic living expenses and pensions for retirees.

Article 10 The scope of family income determination: all kinds of wages, retirement fees, unemployment benefits, living expenses, bonuses, allowances, price subsidies and living allowances for laid-off custodians of family members; Accepting gifts, income from property inheritance and income from support; Income obtained by the unemployed through labor and other channels; Other income.

Article 11 When calculating the wage income of employees, if it does not meet the minimum wage standard, it shall be calculated according to the minimum wage standard; if it is higher than the minimum wage standard, it shall be calculated according to the actual wage. Retirement fees for retirees are calculated according to the minimum retirement fee standard if they are lower than the minimum retirement fee standard, and calculated according to actual income if they are higher than the minimum retirement fee standard. Unemployed laid-off workers with the ability to work, whose labor income and actual income are higher than the minimum living standard for laid-off workers, shall be calculated according to the minimum living standard for laid-off workers.

Twelfth to encourage and support the ability to work to protect the object of self-employment, self-reliance. Industry and commerce, taxation, education, urban construction, urban management and other departments should provide them with preferential policies.

Chapter IV Sources and Supervision of Guarantee Funds

Article 13 The funds required for the implementation of the minimum living guarantee standard for urban residents shall be borne by the municipal, district and county (city) governments at 50% respectively, and shall be included in the fiscal budget by the people's governments at the two levels, included in the expenditure items of special social assistance funds and managed in special accounts. Before the end of each year, the civil affairs departments at all levels put forward the plan for the next year, which will be included in the budget after being audited by the financial department at the same level and allocated regularly. The preparation of final accounts at the end of the year shall be examined and approved by the financial department at the same level.

The financial department should ensure that the funds are earmarked and shall not be misappropriated or misappropriated.

Article 14 The use of guarantee funds shall be subject to inspection, auditing and social supervision by the financial and auditing departments.

Chapter V Approval and Issuance of Guarantee Funds

Article 16 For residents who are below the minimum living standard for urban residents, the head of household shall apply to the neighborhood committee where he is located, fill in the Declaration and Approval Form for the Minimum Living Guarantee for Urban Residents in Shenyang, and issue the Minimum Living Guarantee Certificate for Urban Residents in Shenyang after investigation and verification by the neighborhood committee, review by the subdistrict office and the district/county (city) civil affairs department, and approval by the municipal civil affairs department. Sub-district offices issue minimum living allowance every month. Those who have enjoyed the security fund and require to continue to enjoy the security fund shall apply to the neighborhood Committee in advance every quarter, otherwise they will be deemed to have waived their eligibility.

Seventeenth to receive the minimum living allowance for urban residents, the actual monthly per capita income is higher than the minimum living standard, stop issuing the minimum living allowance, and recover the "Shenyang urban residents minimum living allowance certificate".

Article 18 Neighborhood committees, neighborhood offices and district/county (city) civil affairs departments shall conduct an audit on the household income of the security object every quarter, and publish the audit results in the neighborhood committees.

Article 19 Persons who apply for and enjoy the minimum living guarantee for urban residents shall accept the supervision and management of civil affairs departments, neighborhood offices and neighborhood committees, truthfully reflect the family income, and shall not conceal, underreport or omit reporting. Offenders, once found out, immediately recover the impersonator of the minimum living allowance for urban residents, and will be punished according to the seriousness of the case.

Article 20 Where any staff member who implements the minimum living guarantee system for urban residents violates these measures, neglects his duty, engages in malpractices for selfish ends, or intercepts or misappropriates the minimum living guarantee fund for urban residents, the unit to which he belongs or the relevant department shall handle it according to the regulations, and if the case constitutes a crime, he shall be investigated for criminal responsibility according to law.

Chapter VI Supplementary Provisions

Twenty-first specific issues in the implementation of these measures shall be interpreted by the Municipal Civil Affairs Bureau.

Article 22 These Measures shall come into force as of April 2008 1998.
