Provisions of Nanjing Municipality on Keeping Pets and Dogs
Article 1 These Regulations are formulated in accordance with the relevant laws and regulations and in light of the actual situation of this Municipality in order to standardize the raising and management of dogs, safeguard the personal health and safety of citizens, and maintain the city appearance, environment and public order.
Article 2 Units and individuals that raise dogs, engage in dog business activities and manage dogs within the administrative area of this Municipality shall abide by these regulations.
Military dogs, police dogs and other special dogs, as well as zoos and scientific research dogs, shall be managed in accordance with state regulations.
Article 3 Dog management shall follow the principles of combining management with service, combining law enforcement by administrative organs with participation of grass-roots organizations, and combining self-discipline of dog owners with public supervision.
Article 4 It is forbidden to keep dogs in office service areas of state organs and hospitals, teaching areas of schools and kindergartens, dormitory areas of students and dormitory areas of units.
Article 5 The area south of the Yangtze River and within ring highway of this Municipality is the key management area for dog breeding (hereinafter referred to as the "key management area").
Other areas and rural areas in the areas listed in the preceding paragraph are general dog management areas (hereinafter referred to as general management areas).
Streets, towns and densely populated areas within the general administrative area shall be determined by the district and county people's governments, reported to the Municipal People's government for approval, and managed in accordance with key administrative areas.
Article 6 The people's governments at all levels in this Municipality shall be responsible for organizing the implementation of these Regulations. People's governments at all levels shall establish a coordination mechanism for dog management.
The public security department is the competent department in charge of dog management, and shall hold regular meetings of relevant departments to study and coordinate the dog management.
Animal husbandry and veterinary, industry and commerce, health, urban management administrative law enforcement (city appearance), municipal utilities, prices, finance, real estate, gardens, civil affairs and other departments shall, in accordance with their respective responsibilities, cooperate in dog management.
Article 7 An animal immunity system shall be implemented for dogs according to law. No unit or individual may raise dogs that have not been vaccinated against rabies for 90 days.
Article 8 The legitimate rights and interests of dog owners are protected according to law. Advocate civilized dog raising, and dog raising shall not harm the legitimate rights and interests of others.
Chapter II Dog Breeding Registration
Ninth key management areas to implement the dog registration system. Dogs are not registered, and no unit or individual may keep them.
Article 10 An individual applying for raising a dog in a key management area shall meet the following conditions:
(a) with the city's permanent residence or temporary residence of the legal proof;
(2) Having full capacity for civil conduct;
(3) Having a fixed residence;
(four) the types and quantity of dogs that meet the requirements;
(five) to obtain a legal and effective dog immunization certificate.
Eleventh key management area units to apply for a dog shall meet the following conditions:
(a) Keeping important warehouses, construction sites and accounting offices;
(two) the person in charge of management, management personnel should be trained, dogs should be trained;
(three) there are dog cages, kennels, fences and other captive facilities and closed conditions;
(4) Obtaining a legal and valid dog immunization certificate.
Twelfth units and individuals in key management areas to apply for raising dogs, should fill in the application form for dog registration. The dog registration application form can be collected from the local police station and community police office, or downloaded from the website published by the public security department.
If an individual applies for raising a dog, he or the person entrusted by him shall bring the dog to the place designated by the local public security bureau or the county public security bureau to apply for registration. To apply for registration, the following materials shall be submitted:
(1) An application form for dog registration;
(two) the identity certificate of the applicant, and if the application is entrusted to others, the identity certificate of the client and the power of attorney of the dog owner shall also be submitted;
(3) Legal and valid dog immunization certificate.
Units applying for raising dogs shall apply to the municipal public security department for registration. To apply for registration, the following materials shall be submitted:
(1) An application form for dog registration;
(2) dog breed certificate;
(3) Legal and valid dog immunization certificate;
(4) Relevant training and training certificates.
If imported dogs are kept, there shall also be an entry-exit animal inspection and quarantine certificate issued by the entry-exit inspection and quarantine institution.
Thirteenth puppies born less than ninety days, should be within ten days from the date of breeding to the local police station for the record. If a dog has been kept for 90 days, it shall go through the registration formalities in accordance with the procedures stipulated in these regulations.
Fourteenth the materials submitted by the applicant are complete and conform to the statutory form, and the public security department shall accept the application; If the application materials are incomplete or do not conform to the statutory form, the public security department shall inform the applicant of all the contents that need to be corrected at one time on the spot, and if the applicant submits all the corrected application materials as required, the public security department shall accept it.
When accepting an individual application, the public security department shall examine the materials submitted by the applicant on the spot. Those who meet the conditions stipulated in Article 10 of these regulations shall register on the spot, issue dog-raising licenses, set up electronic identification marks for dogs, and issue dog-raising registration certificates within 10 days; If it does not meet the requirements, it shall make a written decision not to register within ten days from the date of accepting the application, and inform the reasons and handling methods.
When accepting an application from a unit, the public security department shall review the materials submitted by the applicant within 10 days from the date of accepting the application, and assign more than two staff members to conduct on-site verification and make a written decision on whether to approve the registration. Those who meet the conditions stipulated in Article 11 of these regulations shall register, issue dog-raising licenses, set up electronic identification marks for dogs, and issue dog-raising registration certificates within 10 days from the date of registration; If it does not meet the requirements, it shall make a written decision not to register, and inform the reasons and handling methods.
Fifteenth dog registration should follow the principle of convenience. The public security department shall, jointly with the animal husbandry and veterinary administrative department, regularly implement one-stop immunization and registration services. The time and place of implementing one-stop service every year shall be determined and announced by the municipal public security department in conjunction with the municipal animal husbandry and veterinary department.
Sixteenth dog registration certificate is valid for one year. If it is necessary to continue to raise dogs at the expiration of the validity period, it shall apply for renewal procedures 30 days before the expiration of the validity period.
Individuals who need to continue to raise dogs shall apply to the public security department of their place of residence with legal and valid dog immunization certificate and dog registration certificate. Units need to continue to raise dogs, the municipal public security department shall conduct on-the-spot verification. For qualified units and individuals, the public security department shall go through the extension procedures.
Article 17 Dog owners in key management areas shall, under any of the following circumstances, go through the formalities of alteration, cancellation, filing and completing formalities with the public security department of the place of residence with the dog registration certificate:
(a) where the address is changed, the registration of change shall be handled within 30 days from the date of change;
(2) If the dog is transferred, it shall jointly handle the change registration with the transferee within fifteen days from the date of transfer;
(three) to give up the dog, the dog shall be handed over or sent to the dog inspection and reception place, and the registration shall be cancelled with the public security department of the place of residence;
(four) if the dog dies, it shall cancel the registration within fifteen days from the date of death;
(five) if the dog is missing, it shall be filed with the public security department of the place of residence within five days from the date of disappearance;
(six) lost the dog registration certificate, it shall promptly apply to the public security department of the place of residence for a replacement.
Eighteenth public security departments should establish electronic archives of dog management in key management areas and record the following items:
(a) the dog owner's name or unit name, address and contact information;
(2) Dog breed, photos and main physical characteristics;
(3) the immunity of dogs;
(four) the dog registration certificate number code, issuance time;
(five) the continuation, alteration, cancellation and replacement of the dog registration certificate;
(6) Records of illegal dog raising;
(seven) other matters that should be recorded.
Chapter III Code of Conduct for Raising Dogs
Article 19 Dog owners shall regularly vaccinate dogs against rabies in accordance with the relevant provisions of the state, and prevent other diseases of dogs.
If the dog is infected or suspected to be infected, the dog owner shall immediately report to the local animal husbandry and veterinary department or the public security department.
If the dog dies of illness or the cause of death is unknown, the dog owner shall immediately report to the local animal husbandry and veterinary department or the public security department, and carry out harmless treatment under its supervision; Those that cannot be treated harmlessly shall be destroyed.
If a dog dies of rabies, the dog owner shall immediately report to the local animal husbandry and veterinary department, and the animal husbandry and veterinary department shall cremate it.
Article 20 Dogs shall not endanger public interests, interfere with the normal life of others, or indulge or drive away dogs to intimidate or hurt others.
When barking affects others, the dog owner or dog carrier shall take measures to stop it.
If a dog injures a person, the dog owner or dog carrier shall immediately send the injured person to a medical institution for diagnosis and treatment, pay medical expenses in advance, and bear civil liability according to law.
Twenty-first dog owners should provide necessary eating conditions, activity space and living environment for dogs, and should not abuse or abandon dogs.
No one shall harass, abuse or hurt dogs without reason.
Article 22 Dogs are prohibited from entering government offices, hospitals, schools, kindergartens, sanatoriums, places for children's activities, stadiums, museums, libraries, theaters, hotels, restaurants, shopping malls, indoor farmers' markets, financial business places, parks, scenic spots and other public places where dogs are prohibited from entering.
Twenty-third except for small taxis, dogs are not allowed to take public transport. When taking a small taxi with a dog, the driver's consent shall be obtained.
Twenty-fourth key management areas to raise dogs should also comply with the following provisions:
(a) individual dogs are limited to one per household, and strong dogs and large dogs are not allowed.
(two) do not walk the dog in the area and time where it is forbidden to walk the dog.
(3) No environmental pollution. If a dog excretes feces outdoors, the dog owner shall immediately remove it.
(four) shall not be buried and discarded in key management areas, dog carcasses should be cremated.
(5) When taking the dog in the elevator or going up and down the stairs, the dog should be put into a dog bag, a dog cage, a hug, or put on a muzzle, and avoid peak hours.
(6) When the dog is taken out of the house, the dog tag shall be hung and the dog chain shall be tied, and the length shall not exceed 1.5 meters. Dog chains should be led by people with full capacity for civil conduct, abide by traffic regulations and take the initiative to avoid pedestrians and vehicles.
(seven) units that raise dogs shall be kept in captivity or tied up. If it is necessary to go out for registration, immunization, diagnosis and treatment, training, feeding, etc., the dog should be put into a dog cage or tied to a rope, and led by a manager.
Twenty-fifth key management areas promote the breeding of sterilized dogs.
If the dogs in the key management areas give birth to puppies, the dog owners shall file with the local police station, and within 90 days from the date of birth of the puppies, hand over the over-limit dogs to others or send them to the dog shelter for shelter.
Twenty-sixth key management areas shall pay the dog management fee annually. The specific standards shall be formulated by the Municipal People's Government and promulgated after approval by the relevant provincial departments.
Breeding neutered dogs, with the sterilization certificate issued by the agency entrusted by the animal husbandry and veterinary department, will be charged a dog management fee by half.
If the blind raise guide dogs and the severely disabled raise support dogs, the dog management fee will be exempted.
For the elderly living alone over 70 years old, the dog management fee shall be reduced as appropriate.
Dog management fees are collected by the public security department and included in the financial budget management. Management fees are used for dog file management, dog detention and dog feces cleaning and other related management services.
Chapter IV Dog Management
Twenty-seventh engaged in dog breeding, trading, training and other business activities, operators should go through the relevant procedures according to law, and file with the public security department.
It is forbidden to sell dogs suffering from rabies and their bitten and killed livestock and poultry.
Twenty-eighth personnel engaged in dog diagnosis and treatment shall meet the conditions prescribed by relevant laws and regulations. Engaged in dog diagnosis and treatment activities, shall obtain the permission of the competent department of animal husbandry and veterinary medicine.
Twenty-ninth prohibit the establishment of dog breeding, trading, training and other business premises in residential areas and commercial buildings.
Thirtieth engaged in dog breeding, trading, training and other business activities, shall comply with the following provisions:
(a) the place meets the epidemic prevention conditions stipulated by the state;
(two) except for immunization, diagnosis and treatment, training, feeding and trading, dogs shall not be taken out of the feeding place;
(three) except for puppies born less than 90 days, the dogs sold shall have legal and valid dog immunization certificates;
(four) record the breed, quantity and flow direction of dogs raised and traded, and file them with the public security department;
(5) If a dog is found to be infected or suspected of being infected, it shall immediately report to the local animal husbandry and veterinary department or the public security department, and protect the site, and shall not be transferred, sold or slaughtered.
Chapter V Supervision and Administration
Thirty-first municipal, district and county people's governments shall, according to the needs, specify the areas and time when dogs are prohibited from walking in key management areas, and set up signs; During major festivals or activities, you can specify the area and time where dogs are temporarily prohibited from walking, and set up signs.
Residents' committees, owners' meetings of residential quarters and owners' committees can organize residents and owners to formulate a dog-raising convention according to law, stipulate the area and time where dogs are allowed to walk, set up signs and supervise the implementation. If there is no owners' meeting or owners' committee in the residential area, the property service enterprise may organize the implementation on its behalf.
Thirty-second public security departments shall perform the following duties of supervision and management:
(a) the implementation of dog registration for dogs that do not have the registration conditions.
Only the handling of supervision and inspection.
(two) unified printing and distribution of dog no entry signs.
(three) in violation of the provisions of this Ordinance to capture, take in stray dogs, abandon dogs and confiscate dogs.
(four) the establishment of dog management and service electronic information system, to provide relevant information and services for the public and social grassroots organizations.
(five) accept dog complaints, timely mediate dog disputes, and investigate and deal with illegal dog-raising behavior in accordance with the provisions of these regulations.
(six) the establishment of dog illegal records. Dog-keeping behavior has been reported and punished many times, or if a dog hurts people, it should be supervised and managed.
(seven) to guide and support the residents' committee, the owners' assembly of residential quarters, the owners' committee and the realty service enterprise to organize the formulation and implementation of the kennel convention.
Thirty-third public security departments should set up dog reception centers to accommodate stray dogs, abandoned dogs and dogs confiscated in violation of the provisions of these regulations.
Encourage qualified folk animal protection organizations and individuals to set up dog shelters according to law to take in stray and abandoned dogs. The specific management measures shall be formulated separately by the municipal public security department in conjunction with the municipal animal husbandry and veterinary and civil affairs departments.
If the dog has been registered, the dog detention shelter shall notify the dog owner to claim it within five days from the date of receipt, and the dog owner shall claim it within fifteen days from the date of receipt of the notice; Dog owners who fail to claim them within the time limit are regarded as ownerless dogs and can be adopted by others. Dogs that have not been adopted can be handled by the dog detention and repatriation institution.
The dog shelter shall meet the epidemic prevention conditions stipulated by the state. If it is necessary to carry out harmless treatment according to law, it shall be handled in accordance with the relevant provisions of the state.
Article 34 The animal husbandry and veterinary administrative department shall supervise and manage the immunization and quarantine of dogs and the prevention, control and extermination of epidemic diseases according to law, and organize and supervise the harmless treatment of epidemic dogs and dog carcasses. Implement the dog diagnosis and treatment license system according to law. Investigate and deal with the sale of dog meat without quarantine according to law.
Article 35 The administrative department for industry and commerce shall strengthen the supervision and management of units and individuals engaged in dog business activities according to law.
Thirty-sixth health administrative departments shall supervise and manage the injection of rabies vaccine for human use, the diagnosis and treatment of rabies patients and the prevention and monitoring of rabies epidemic.
Article 37 The administrative law enforcement department of urban management (city appearance) shall investigate and deal with the behaviors that affect the city appearance and environmental sanitation, such as selling dogs in the streets and lanes, and timely organize the cleaning up or urge dog owners to clean up dog feces.
Article 38 When an epidemic of rabies occurs, the municipal, district and county people's governments shall designate epidemic spots and epidemic areas according to the epidemic situation, and organize relevant departments to take emergency measures.
The relevant departments in the supervision and inspection found that dogs do not meet the requirements, not immune, or found rabies and other diseases, should be dealt with in a timely manner.
The relevant departments shall conduct supervision and inspection in accordance with legal procedures, and record and file the results of supervision and inspection.
Thirty-ninth dog industry associations shall, in accordance with the provisions of the articles of association, strengthen industry self-discipline, advocate dog owners to standardize dog-raising behavior, and assist dog owners to raise dogs.
