Article 1 In order to develop bulk cement, save resources and protect the environment, these Provisions are formulated in accordance with the provisions of People's Republic of China (PRC) Cleaner Production Promotion Law and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Provisions shall apply to cement production, operation, transportation, use, management and related activities within the administrative area of this province. Article 3 The people's governments at or above the county level shall regard the development of bulk cement as one of the important tasks of energy conservation and emission reduction, and formulate working measures to promote the development of bulk cement. The fourth provincial administrative department of commerce is responsible for the supervision and management of bulk cement in the province. The administrative department in charge of bulk cement determined by the people's governments of cities and counties under the provincial jurisdiction shall be responsible for the supervision and management of bulk cement within their respective administrative areas. Bulk cement management institutions at all levels are specifically responsible for the management of bulk cement within their respective administrative areas, and accept the business guidance of the bulk cement management institutions at the next higher level. The administrative departments of finance, construction, transportation, quality and technical supervision and environmental protection of the people's governments at or above the county level shall be responsible for the work related to bulk cement within their respective administrative areas according to their respective responsibilities. Fifth bulk cement management institutions at all levels shall exercise the following duties: (1) to organize the implementation of laws, regulations, rules and policies for the development of bulk cement; (two) according to the government's work objectives, formulate plans and annual plans for the development of bulk cement in this area, and organize their implementation; (three) according to the provisions of the collection, management and use of bulk cement special funds; (four) responsible for information exchange, publicity and education, professional training and the popularization and application of new technologies, new processes and new equipment in bulk cement work; (five) in conjunction with the relevant departments to do a good job in the popularization and application of ready mixed concrete and ready mixed mortar; (six) coordinate and solve the problems in the development of bulk cement. Sixth units and individuals that have made remarkable achievements in the development of bulk cement shall be rewarded by the people's governments at or above the county level or the relevant departments. Seventh new construction, expansion and reconstruction of cement production projects shall be designed and constructed in accordance with the requirements of bulk cement distribution capacity stipulated by the state. Existing cement production enterprises (including cement grinding stations, the same below) must be equipped with bulk cement distribution facilities and equipment to improve the bulk cement distribution capacity, in line with national energy conservation and emission reduction and environmental protection standards. Eighth ready-mixed concrete and ready-mixed mortar production enterprises must all use bulk cement. Cement products production enterprises (including new wall materials production enterprises using cement, the same below) use bulk cement, and its consumption must account for more than 70% of the cement consumption. New ready-mixed concrete and ready-mixed mortar production projects shall conform to the development plan of bulk cement and be reported to the local bulk cement management institution for the record. Ninth cement consumption in more than 500 tons of construction projects, must use bulk cement. Bagged cement can be used for construction projects where special vehicles for bulk cement cannot reach the construction site or need special cement. Encourage the use of bulk cement in construction projects with cement consumption below 500 tons. Tenth to encourage the use of ready-mixed concrete and ready-mixed mortar in construction projects. The Municipal People's Government shall, according to the requirements of the state and this province, stipulate the time limit for prohibiting the mixing of concrete and mortar in urban areas. Eleventh bulk cement, ready-mixed concrete, ready-mixed mortar, cement products production enterprises should establish and improve the product quality control system, the implementation of national standardization management, measurement management, process control, quality inspection and other provisions to ensure product quality. Article 12 Units and individuals engaged in the production, operation, transportation and use of bulk cement, ready-mixed concrete, ready-mixed mortar and cement products shall take measures to ensure that the facilities and places for loading, unloading, transportation, storage and use meet the requirements of safety and environmental protection and prevent dust pollution. Article 13 People's governments at all levels should do a good job in the popularization and application of rural bulk cement, increase investment, establish a rural bulk cement distribution and service management system, encourage the use of bulk cement, ready-mixed concrete and ready-mixed mortar, and improve the utilization rate of rural bulk cement. Fourteenth units and individuals engaged in cement production, management, transportation, use and other related activities shall submit statistical reports to the bulk cement management institutions according to law. Fifteenth public security and traffic management departments should provide convenient access for special vehicles to transport bulk cement, ready-mixed concrete and ready-mixed mortar. Special vehicles for transporting bulk cement, ready-mixed concrete and ready-mixed mortar shall go to the local bulk cement management institution for the record; Need to enter the city's urban no parking sections, unified by the local bulk cement management agencies to the public security, traffic management departments, the relevant departments should be handled in a timely manner. Sixteenth railway transportation departments and provincial bulk cement management institutions should strengthen coordination and cooperation, do a good job in the dispatch and management of bulk cement transport vehicles, and ensure that cement production and marketing enterprises ship bulk cement. Seventeenth production enterprises and units that use bagged cement shall pay special funds for bulk cement in accordance with the relevant provisions of the state and this province. The collection, use and management of special funds for bulk cement shall be implemented in accordance with the provisions of the state and this province. The special fund for bulk cement belongs to the government fund and is earmarked for the development of bulk cement. The balance shall be carried forward to the next year for continued use, and governments at all levels and relevant departments shall not arbitrarily reduce, intercept, occupy or misappropriate it. The management funds of bulk cement management institutions are included in the fiscal budget at the same level. Eighteenth cement production enterprises fail to report or refuse to report the statistical statements, and the special funds for bulk cement that they should pay shall be calculated according to the average monthly cement output of the enterprise in the previous year. If the construction project does not provide information on the amount of cement, the special funds for bulk cement that should be paid shall be calculated according to the total amount of cement in the budget of the construction project. Nineteenth bulk cement management institutions at all levels should strengthen the supervision and inspection of the popularization and application of bulk cement, and promptly investigate and deal with illegal acts. Article 20 Whoever, in violation of the provisions of Article 10 of these Provisions, mixes concrete and mortar on the spot without authorization shall be ordered by the construction administrative department to make corrections within a time limit and be fined 65,438,000 yuan per cubic meter of concrete and 200 yuan per ton of mortar, but the total amount of the fine shall not exceed 30,000 yuan. The construction administrative department may entrust the local bulk cement management institution with punishment. In violation of the provisions of Article 8, paragraph 1, of these Provisions, the cement products production enterprises whose bulk cement usage is less than 70% shall be ordered by the administrative department in charge of bulk cement to make corrections within a time limit, and a fine of RMB 100 per cubic meter of concrete, 200 yuan per ton of mortar or 300 yuan per ton of bagged cement shall be imposed, but the total fine shall not exceed RMB 30,000. Enterprises that produce ready-mixed concrete and ready-mixed mortar do not use bulk cement or do not use bulk cement completely shall be punished by the relevant departments in accordance with the relevant provisions of the state. Article 21 Enterprises and units that fail to pay special funds for bulk cement in accordance with regulations shall be ordered by the bulk cement management institutions at the same level to pay within a time limit, and a late fee of 0.5‰ of the special funds for bulk cement shall be charged on a daily basis from the date of delay; Fails to pay within the time limit, by the administrative department in charge of bulk cement entrusted bulk cement management institutions to impose a fine of double the unpaid bulk cement special funds, but the total fine does not exceed 30000 yuan. Without changing the collection object, collection scope and collection standard of bulk cement special funds, or failing to manage and use bulk cement special funds in accordance with these Provisions, the financial department at a higher level or the administrative department in charge of bulk cement at a higher level shall order it to make corrections within a time limit, and the relevant departments shall give administrative sanctions to the directly responsible personnel in charge and other directly responsible personnel according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
