Provisions on the Protection and Management of Ancient and Famous Trees in Hainan Province (revised in 2022)

Article 1 In order to protect the resources of ancient and famous trees, promote the construction of ecological civilization and the comprehensive, coordinated and sustainable development of economy and society, these Provisions are formulated in accordance with the provisions of the Forest Law of People's Republic of China (PRC), the Regulations on Urban Greening of the State Council and other laws and regulations, combined with the actual situation of this province. Article 2 These Provisions shall apply to the protection and management of ancient and famous trees within the administrative area of this province. Article 3 The term "ancient trees" as mentioned in these Provisions refers to trees whose age is more than 100 years.

The term "famous trees" as mentioned in these Provisions refers to trees that are rare, precious trees or have important historical, cultural and scientific research value and great commemorative significance. The catalogue of famous trees is jointly proposed by the competent departments of forestry and landscaping of the provincial people's government and announced to the public after examination and approval by the provincial people's government. Article 4 The Greening Committee of the people's governments at or above the county level shall organize and coordinate the protection and management of ancient and famous trees within their respective administrative areas.

The competent departments of forestry and landscaping of the people's governments at or above the county level (hereinafter referred to as the competent departments of ancient and famous trees at or above the county level) shall be responsible for the protection and management of ancient and famous trees in accordance with the duties prescribed by the people's governments at the corresponding levels.

Township people's governments and sub-district offices are responsible for the protection and management of ancient and famous trees within their respective jurisdictions.

Finance, planning, construction, environmental protection, tourism, culture and other departments shall, in accordance with their respective responsibilities, coordinate in the protection and management of ancient and famous trees. Article 5 The protection of ancient and famous trees shall be subject to territorial management.

Ancient and famous trees in nature reserves shall be protected and managed by the competent department of nature reserves in accordance with relevant regulations. Article 6 The people's governments at or above the county level shall include the funds for the protection of ancient and famous trees in the fiscal budget at the same level for the investigation, identification, protection and rescue of ancient and famous trees, as well as the publicity and training of the protection of ancient and famous trees. Seventh people's governments at all levels should strengthen scientific research on the protection of ancient and famous trees, popularize the application of scientific research results, publicize and popularize protection knowledge, and improve the level of protection management.

Units and individuals that have made remarkable achievements in the protection of ancient and famous trees, scientific research and publicity and education shall be commended and rewarded by the people's governments at or above the county level. Article 8 All units and individuals have the obligation to protect ancient and famous trees, and may not damage them or dispose of them by themselves, and have the right to stop and report the damage to ancient and famous trees. Ninth ancient and famous trees in accordance with the following provisions published and classified protection:

(a) the old and famous trees over 300 years old shall be promulgated by the provincial people's government and shall be protected at the first level;

(two) the age of trees 100 years old and less than 300 years old shall be announced by the people's governments of cities, counties and autonomous counties, and the second-level protection shall be implemented. Article 10 The departments in charge of ancient and famous trees in cities, counties and autonomous counties shall organize a general survey of ancient and famous trees within their respective jurisdictions at least once every five years, and organize relevant experts to conduct identification and confirmation according to the survey materials.

The appraisal standards and procedures for ancient and famous trees shall be formulated by the provincial department in charge of ancient and famous trees jointly with relevant departments, and announced to the public after being examined and approved by the provincial people's government.

The relevant units or individuals have objections to the identification of ancient and famous trees, which can be put forward to the provincial department in charge of ancient and famous trees. Provincial departments in charge of ancient and famous trees may, according to the specific circumstances, organize relevant departments and experts to carry out identification and confirmation. Article 11 The departments in charge of ancient and famous trees in cities, counties and autonomous counties shall register, photograph and locate ancient and famous trees, establish graphic files (including electronic information files), and report them to the Greening Committee of the provincial people's government and the departments in charge of ancient and famous trees in the province for the record. The graphic files of ancient and famous trees should be updated in time according to the growth and survival of trees.

The Greening Committee of the Provincial People's Government shall organize and coordinate the construction of the graphic database of ancient and famous trees in the province by the competent department of ancient and famous trees in the province, and dynamically monitor and manage the resources of ancient and famous trees. Twelfth units and individuals to the city, county, autonomous county departments of ancient and famous trees report unregistered ancient and famous trees, ancient and famous trees departments should promptly investigate and file a case. Thirteenth city, county and autonomous county departments in charge of ancient and famous trees should set up protective boards in a prominent position around ancient and famous trees, and set up protective fences, lightning protection devices and other corresponding protective facilities according to actual needs.

Ancient and famous trees protection board shall indicate the number, name, scientific name, family, age, protection level, unit or maintainer responsible for daily maintenance (hereinafter referred to as the person responsible for daily maintenance), listed unit and its contact telephone number.

No unit or individual is allowed to move or damage the protection cards and protection facilities of ancient and famous trees without authorization. Fourteenth Provincial People's Government Afforestation Committee shall organize and coordinate the provincial departments in charge of ancient and famous trees, formulate conservation technical specifications and corresponding protection measures according to the protection level of ancient and famous trees, and announce them to the public.

The departments in charge of ancient and famous trees at or above the county level shall strengthen the publicity and training of the technical specifications for the conservation of ancient and famous trees, guide those responsible for daily conservation to conserve ancient and famous trees, and provide technical services free of charge. Fifteenth protection of ancient and famous trees to implement the responsibility system of conservation, the city, county, autonomous county departments in charge of ancient and famous trees shall be determined in accordance with the following provisions:

(1) Old and famous trees growing in military units, government organs, public organizations, enterprises and institutions, cultural relics protection units, farms, forest farms, tea plantations, places for religious activities, etc. , by the unit responsible for maintenance;

(two) the ancient and famous trees growing in the land of railways, highways, rivers and dams, reservoirs and lakes shall be maintained by the railway, highway and water conservancy project management units respectively;

(three) the ancient and famous trees growing in nature reserves, scenic spots, forest parks, geological parks and wetland parks shall be maintained by their management institutions;

(four) the ancient and famous trees growing in the public facilities such as urban streets, green spaces and parks shall be maintained by the urban landscaping management unit;

(five) the growth of ancient and famous trees in urban residential areas, the implementation of property management, the property service enterprises are responsible for the maintenance; Without the implementation of property management, the Township People's government or the street office is responsible for the maintenance;

(six) the ancient and famous trees growing in township streets and green spaces shall be maintained by the township people's government;

(seven) the ancient and famous trees growing on the contracted land shall be maintained by the contractor;

(eight) the old and famous trees growing on the rural land outside the scope specified in Item (seven) shall be maintained by the villagers' committee or villagers' group;

(nine) the ancient and famous trees that grow outside the scope specified in items (1) to (8) shall be maintained by the departments in charge of ancient and famous trees in cities, counties and autonomous counties.

Old and famous trees owned by individuals shall be maintained by individuals.

If the relevant units and individuals have any objection to the determined maintenance responsibility, they may apply to the competent department of ancient and famous trees in the city, county or autonomous county for review. The competent department of ancient and famous trees shall make a decision within 10 working days from the date of accepting the application.
