Hydrological Regulations of Chongqing Municipality

Chapter I General Provisions Article 1 In order to strengthen and standardize hydrological management, develop hydrological undertakings, provide services for disaster prevention and mitigation, development, utilization and protection of water resources, urban and rural drinking water and water ecological security, and promote sustainable economic and social development, these Regulations are formulated in accordance with the Hydrological Regulations of People's Republic of China (PRC) and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning and construction of hydrological station network, hydrological monitoring and forecasting, investigation and evaluation of water resources, collection and utilization of hydrological monitoring data, environmental protection of hydrological facilities and hydrological monitoring, and hydrological supervision and management within the administrative area of this Municipality.

Hydrological activities of state river basin management agencies within the administrative area of this Municipality may be implemented with reference to these regulations. Article 3 Hydrological undertakings are basic public welfare undertakings for national economic and social development. The people's governments of cities, districts and counties (autonomous counties) shall incorporate the hydrological undertaking into the national economic and social development plan at the corresponding level, include the required funds into the fiscal budget at the corresponding level, and gradually increase the investment in the hydrological undertaking with the economic and social development. Article 4 The municipal water administrative department shall be in charge of the hydrological work in this Municipality, and the municipal hydrological institutions directly under it shall be specifically responsible for organizing and implementing the management work.

The water administrative departments of counties (autonomous counties) shall be responsible for and organize the implementation of hydrological work within their respective administrative areas, except for national river basin management institutions and municipal management institutions.

Special hydrological stations and other units engaged in hydrological activities shall accept the industry management of municipal hydrological institutions. The responsibilities of the fifth municipal hydrological institutions are:

(a) responsible for organizing the implementation of hydrological laws and regulations and technical standards and norms, and guiding, supervising and managing hydrological activities within the scope of this Municipality;

(two) to undertake the preparation and implementation of the city's hydrological development plan;

(three) responsible for the examination and approval of the establishment of special hydrological stations within the scope of duties and the review of the collection, management and use of hydrological monitoring data in this Municipality;

(four) to carry out the verification of hydrological measuring instruments according to law;

(five) responsible for the city's hydrology, water resources monitoring and investigation and evaluation, as well as the city's hydrological information forecast and release;

(six) other duties as prescribed by laws, regulations and rules.

The responsibilities of hydrological institutions in counties (autonomous counties) are:

(a) responsible for the preparation and implementation of the local hydrological development plan;

(two) responsible for the state and the city outside the river hydrology, water resources monitoring and hydrological information forecast release;

(three) cooperate with the municipal hydrological institutions to do a good job in hydrological data collection, hydrological monitoring and environmental protection. The people's governments of cities, counties (autonomous counties) shall, in accordance with the relevant provisions of the state, commend and reward the units and individuals that have made outstanding contributions in hydrological work. Chapter II Planning and Construction Article 8 The municipal water administrative department shall, in accordance with the relevant provisions of the state, jointly with the municipal development and reform department, organize the preparation of the city's hydrological development plan, which shall be implemented after being approved by the Municipal People's Government and reported to the the State Council water administrative department for the record.

The water administrative department of a county (autonomous county) shall, in accordance with the city's hydrological development plan and in combination with the local national economic and social development plan, jointly with the development and reform department of the county (autonomous county), organize the preparation of the local hydrological development plan, which shall be implemented after being approved by the people's government at the same level and reported to the municipal water administrative department for the record.

Hydrological development planning mainly includes hydrological development objectives, hydrological station network construction, hydrological monitoring and information forecasting facilities construction, hydrological information network and operational system construction, and safeguard measures. Hydrological monitoring should adopt the methods of water quantity and water quality synchronization, station measurement and patrol measurement, automatic telemetry and manual monitoring to gradually improve the level of automatic monitoring. The establishment and adjustment of important national hydrological stations shall be approved by the municipal water administrative department and the hydrological institution directly under the water administrative department of the State Council; The establishment and adjustment of other basic hydrological stations shall be approved by the municipal water administrative department and reported to the hydrological institutions directly under the water administrative department of the State Council for the record.
