Coal is the main energy source in China, and the safe production of coal mines is related to the sustainable development of coal industry and national energy security, and to the safety of lives and property of hundreds of millions of miners. In recent years, with the joint efforts of all parties, the situation of coal mine safety production has steadily improved. However, the total number of accidents is still large, and serious accidents occur from time to time, exposing some outstanding problems in coal mine safety management. The CPC Central Committee and the State Council attached great importance to this, demanding that we should learn from the accident lessons profoundly, stick to the red line that development should not be at the expense of human lives, always put the safety of miners in the first place, vigorously promote coal mine safety, establish and improve a long-term mechanism for coal mine safety, and resolutely curb the occurrence of serious accidents in coal mines. In order to further strengthen the work of coal mine safety production, with the consent of the State Council, we hereby put forward the following opinions:
First, speed up the closure and withdrawal of backward small coal mines.
(1) explicitly closes the object. Focus on closing 90,000 tons/year and below coal mines that do not have safe production conditions, speed up the closure of 90,000 tons/year and below coal mines with serious disasters such as coal and gas outburst, and resolutely close 90,000 tons/year and below coal mines with major and above accidents. Close coal mines that cross the border and refuse to return, and the resources are exhausted; Shut down coal mines that refuse to carry out the order to suspend production for rectification but still organize production. All coal mines that cannot achieve normal mining will be suspended for rectification; If formal mining is not realized within the time limit, it shall be closed according to law. Coal mines that do not meet the three-level standard of safety and quality standardization should stop production and rectify within a time limit; Those who fail to meet the standards within the time limit will be closed according to law.
(2) Increase policy support. Local people's governments should increase their support for eliminating backward production capacity through existing capital channels, and arrange matching funds to tilt towards areas with early customs clearance and multiple customs clearance. Study and formulate preferential credit and financial policies to encourage advantageous coal mining enterprises to merge and reorganize small coal mines. Revise the coal industry policy and improve the coal mine access standard. The state supports the closure of small coal mining areas to develop continuous industries, strengthen infrastructure construction, speed up the construction of energy transmission channels in coal-deficient areas, and give priority to ensuring railway transportation capacity in coal-deficient areas.
(three) the implementation of the closure target and responsibility. By the end of 20 15, more than 2,000 small coal mines will be closed nationwide. The people's government at the provincial level shall be responsible for the closure of small coal mines, and shall formulate a closure plan, define the closure target, and ensure that it is completed on schedule.
Second, strict coal mine safety access.
(four) strict examination and approval of coal mine construction projects and production capacity. No more coal mines with an additional capacity of less than 300,000 tons/year, and no more coal and gas outburst mines with an additional capacity of less than 900,000 tons/year. Existing production mines with serious disasters such as coal and gas outburst and rock burst will no longer expand their production capacity in principle; Before the end of 20 15, the above-mentioned mine production capacity will be re-approved, and the production capacity without safety guarantee capacity will be reduced.
(five) strict access to coal mine production technology and technical equipment. Establish and improve policies, norms and standards such as coal production technology and equipment, rational distribution of underground production and capacity verification, and strictly prohibit the use of equipment and processes explicitly prohibited or eliminated by the state. Equipment used in coal mines must obtain safety signs of coal mine products according to regulations.
(six) strict access to coal mining enterprises and management personnel. Standardize the safety approval, project approval and resource allocation procedures of coal mine construction projects. Those who fail to pass the safety examination and approval shall not pass the project examination and approval; No mining license shall be issued for an unapproved project. Enterprises that do not have the corresponding disaster prevention and control ability to apply for the exploitation of coal resources with high gas, rock burst, easy spontaneous combustion of coal seams and complex hydrogeological conditions shall not pass the safety examination and approval. Enterprises engaged in coal production must have a management team with relevant majors and practical experience. Coal mines must be equipped with mine managers, chief engineers and deputy mine managers who are in charge of safety, production and electromechanical, as well as professional and technical personnel responsible for coal mining, tunneling, electromechanical transportation, ventilation and geological survey. The mine manager, chief engineer and deputy mine manager in charge of safety, production and electromechanical must have safety qualification certificates, and it is strictly forbidden to work part-time in other coal mines; Professional and technical personnel must have technical secondary school education or registered safety engineer qualification related to coal mine, and have more than 3 years of underground work experience. Encourage professional safety management teams to manage small coal mines by means of trusteeship and shareholding, and improve the technology, equipment and management level of small coal mines. Establish a coal safety production credit reporting system, improve the safety production commitment and safety production credit classification management system, and improve the safety production access and exit credit evaluation mechanism.
Third, deepen the comprehensive control of coal mine gas.
(7) Strengthen gas management. Conscientiously implement the national policy of promoting the extraction and utilization of coalbed methane (coal mine gas). In mines with high gas, coal and gas outburst, it is necessary to strictly implement pumping before mining, not pumping and not mining, and pumping up to standard. Coal and gas outburst mines must implement regional outburst prevention measures in accordance with regulations, mine protective layers or implement regional pre-drainage, and eliminate the outburst danger. It is not allowed to use outburst working faces or dig outburst heads. If it is found that the gas still exceeds the limit, it will be investigated according to the accident and the responsible person will be dealt with according to the law and regulations.
(eight) strictly evaluate the gas prevention and control ability of coal mining enterprises. Improve the evaluation system of gas prevention and control ability of coal mining enterprises, improve evaluation standards and increase necessary indicators. Strengthen the supervision and inspection of the implementation of evaluation results. Coal mining enterprises that do not have the ability to prevent and control gas after evaluation must stop production for rectification, merger and reorganization until they are closed according to law. Strengthen the construction of evaluation institutions, enrich evaluation personnel, implement evaluation responsibilities, and seriously investigate the responsibility of units and individuals who practice fraud.
Fourth, a comprehensive investigation of coal mine hazards factors.
(nine) compulsory identification of hidden factors of disasters. Strengthen the management of coal geological exploration. If the exploration degree can not meet the requirements of the specification, no mining area shall be designated. Coal mining enterprises should strengthen geological exploration in the process of construction and production, find out the hidden dangers and disaster-causing factors such as gas, water and fire within the scope of the mine field, and comprehensively use geophysical prospecting, drilling and other exploration technologies for supplementary exploration; Otherwise, construction and production shall not be continued.
(ten) the establishment of disaster risk factors investigation and management mechanism. In mining areas where small coal mines are concentrated, local people's governments should organize the investigation and management of regional water disasters, set warning lines and no-mining lines for accumulated water in old mined-out areas of coal mines, and implement and improve preventive and safeguard measures. The state provides support from the relevant special funds of the central government.
Five, vigorously promote the "four modernizations" construction of coal mines.
(eleven) to speed up the mechanization construction of small coal mines. The state encourages and supports the mechanized transformation of small coal mines with a capacity of less than 300,000 tons/year, and determines the minimum scale production capacity that meets the requirements of industrial policy through mechanized transformation according to the method for verifying production capacity. Newly built, rebuilt and expanded coal mines shall not be approved without mechanized mining.
(twelve) vigorously promote the standardization, automation and information construction of coal mine safety and quality. Deepen the standardization of coal mine safety and quality, and strengthen dynamic compliance and post-event compliance. Coal mines must ensure the normal operation of safety monitoring, personnel positioning and communication systems, vigorously promote the application of information technology and Internet of Things technology, make full use of and integrate the existing production scheduling, monitoring, office automation and other information systems, build and improve the comprehensive scheduling information platform for safety production, and realize video monitoring, real-time monitoring and remote control. County-level coal mine safety supervision departments should be networked with the comprehensive dispatching information platform for coal mine safety production, and randomly check the operation of coal mine safety monitoring. Local people's governments should cultivate, develop or establish regional technical service institutions to provide technical services for coal mines, especially small coal mines.
Six, strengthen the responsibility and labor management of coal mine managers.
(thirteen) strictly implement the responsibility system of coal mine managers. Coal mine managers should implement the responsibility for production safety, effectively ensure the safety of miners, ensure that coal mines must have complete licenses, and prohibit unlicensed or unlicensed illegal production; Regular mining must be carried out in the approved area, and cross-border or roadway mining or empty roof operation is strictly prohibited; The ventilation system must be reliable, and it is forbidden to work without wind, breeze and circulating wind. Gas drainage must meet the standard, outburst prevention measures are in place, the monitoring system is effective, and the gas exceeds the limit, so it is forbidden to operate illegally. It is necessary to implement the underground exploration and drainage regulations and prohibit the exploitation of waterproof coal pillars; It is necessary to ensure that the underground electromechanical and all lifting equipment are in good condition, and it is strictly forbidden to illegally enter the well with non-flame retardant and non-explosion-proof equipment; Must adhere to the mine leadership shift, to ensure that employees are trained and certified, it is strictly prohibited to command in violation of regulations. All coal mines that fail to meet the requirements will be suspended for rectification.
(fourteen) standardize the management of labor and employment in coal mines. In a certain area, strengthen the recruitment information service of coal mining enterprises, organize unified registration and qualification examination, unified assessment, unified signing of labor contracts and handling employment filing, unified participation in social insurance, unified use of labor services to dispatch workers according to law, and strengthen supervision. Strictly implement the real-name registration system of industrial injury insurance; Severely crack down on undocumented posts and fake certificates.
(15) Protect the rights and interests of coal miners. Carry out collective wage negotiation in the industry, study and determine the hourly minimum wage standard for coal miners, improve the underground subsidy standard, and increase the income of coal miners. Strictly implement the national legal working hours system. Stop production and rectify coal mines must pay workers' wages on schedule. Coal mines must be equipped with labor protection articles according to law, organize regular occupational health examinations, strengthen the prevention and treatment of pneumoconiosis, and build standardized canteens, bathhouses and dormitories.
(sixteen) to improve the quality of coal mine workers. Strengthen the construction of coal mine safety team, accelerate the transformation from "recruitment" to "enrollment", and strengthen the training and assessment of miners' practical skills. All coal mine employees must be certified after passing the examination, strictly separate teaching from examination, establish a unified question bank, formulate assessment methods, and issue certificates free of charge to those who pass the examination. Improve the examination management system, establish examination files, and earnestly do not issue certificates if the examination fails. Incorporate the training of migrant workers in coal mines into the scope of employment promotion planning and vocational training support policies in various places.
Seven, improve the scientific level of coal mine safety supervision and emergency rescue.

Municipal coal mines are accepted by the city (prefecture) level coal mine safety supervision department and signed by the main person in charge of the city (prefecture) level people's government; Other coal mines shall be accepted by the county-level coal mine safety supervision department and signed by the main person in charge of the county-level people's government. The coal mines of central enterprises must be supervised by the coal mine safety supervision departments at or above the city (prefecture) level, and shall not be handed over to the county and township people's governments and their departments for supervision.

Coal mine safety supervision and supervision departments found that there are major hidden dangers and behaviors such as super-capacity production in coal mines, and should be ordered to suspend production for rectification according to law; If illegal construction is found, it shall be ordered to stop construction and investigate and deal with it according to law; It is found that coal mines that still organize production during the period of suspension of production and rectification should be submitted to the local government for closure according to law. Coal mine safety supervision institutions should strictly implement the safety access, design review and completion acceptance of safety facilities of coal mine construction projects; Strengthen the supervision and inspection of local government's coal mine safety production supervision according to law; For coal mines that suspend production for rectification, the safety production license shall be temporarily withheld according to law. Land and resources departments should strictly implement the mineral resources planning, the national coal planning mining area and the mining right setting scheme system, and severely crack down on illegal activities such as unlicensed exploration and mining of coal mines, open-pit mining in the name of coal field fire fighting or geological disaster control, underground mining in the name of exploring holes and pits, and mining beyond the approved mining area. The public security department should stop approving the suspension of production and rectification of coal mines to buy civilian explosives. The electric power department should limit the power of coal mines that have stopped production for rectification. The competent department of construction should strengthen the management of safety production license of coal mine construction enterprises, organize the timely revision of corresponding coal mine design standards and norms, and strengthen the qualification supervision of coal mine design, construction and supervision units in conjunction with the coal industry management department. Investment departments should improve the pertinence and effectiveness of the allocation and use of funds for coal mine safety technological transformation.
(nineteen) to speed up the construction of coal mine emergency rescue capability. Strengthen the construction of national (regional) mine emergency rescue bases, and its operation and maintenance costs will be supported by the central finance and local provincial finance. Strengthen the construction of local mine rescue teams, and its operation and maintenance costs will be supported by local finance. Coal mining enterprises shall establish full-time emergency rescue teams in accordance with relevant regulations. If a full-time rescue team is not established, a part-time auxiliary rescue team must be built. Coal mining enterprises should unify production, ventilation and safety monitoring and scheduling, and establish a fast and effective emergency mechanism; Organize emergency drills for all employees at least once a year. Strengthen the emergency rescue command of coal mine accidents. In case of major and above accidents, the main person in charge of the provincial people's government or the person in charge shall rush to the scene of the accident in time. Rescuers who died in coal mine rescue and disaster relief shall declare their martyrs in accordance with the relevant provisions of the state.
(twenty) to strengthen the construction of coal mine emergency rescue equipment. Coal mines shall, in accordance with the provisions, build and improve emergency avoidance, compressed air self-help and water supply rescue systems, equip underground emergency broadcasting systems, and reserve self-help and mutual rescue equipment. Coal mines or mining areas where coal mines are concentrated shall be equipped with appropriate drainage equipment and emergency relief materials. Accelerate development and equip with advanced equipment that can quickly open up the "life channel". Support the key development of coal mine emergency command, communication, emergency power supply and other equipment and mobile platforms, as well as rescue equipment such as life detection and search and rescue positioning for people in distress, large-scale demolition at disaster sites, and special protective articles and equipment for rescuers.
All relevant departments in the State Council should study and formulate specific policies and measures in accordance with the division of responsibilities, implement work responsibilities, strengthen supervision, and earnestly organize their implementation. The people's governments at the provincial level should formulate implementation measures in light of local conditions, strengthen organization and leadership, strengthen the construction of the responsibility system for coal mine safety production, strengthen supervision and inspection, strengthen publicity and education, strengthen social supervision, and strictly investigate the responsibilities to ensure that all requirements are effectively implemented.
