Regulations of Yunnan Province on Highway Management

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Regulations of People's Republic of China (PRC) on Highway Management and relevant laws and regulations, combined with the actual situation of our province, in order to strengthen road administration, protect highway properties from encroachment and destruction, ensure smooth and intact roads, and develop highway undertakings. Article 2 These Regulations shall apply to the road administration of national roads, provincial roads, county roads and township roads within the administrative area of our province.

The road administration of high-grade highways shall be implemented in accordance with the Regulations of Yunnan Province on the Administration of High-grade Highways. If there are no provisions in the Regulations of Yunnan Province on the Administration of High-grade Highways, these Regulations shall prevail.

The road administration of special highways shall be implemented with reference to these regulations. Article 3 The principle of unified leadership and hierarchical management shall be implemented in road administration. People's governments at all levels shall strengthen their leadership over road administration. Provincial traffic administrative departments in charge of road administration; The province and its local (city) and county road management agencies are responsible for the road management of national and provincial roads within their respective jurisdictions; The administrative department of transportation at prefecture (city) and county level shall be responsible for the road administration of county roads and township roads within their respective jurisdictions.

Land, public security, industry and commerce, construction planning and other relevant administrative departments at all levels shall, according to their respective functions and duties, assist in road administration.

People's governments at all levels and traffic administrative departments shall commend or reward meritorious personnel who have made outstanding contributions in the work of loving roads and protecting roads. Article 4 Highway products refer to highways, land for highways and highway facilities. Highway refers to the highway road between cities, between urban and rural areas, and between rural areas that can be used by cars after acceptance by the transportation department. Roads include subgrade, pavement, bridges, culverts and tunnels. Highway land refers to land not less than one meter away from ditches (or intercepting ditches) on both sides of the highway. Highway facilities refer to drainage equipment, protective structures, intersections, boundary markers, milestones, pile numbers, safety facilities, communication facilities, inspection and monitoring facilities, maintenance facilities, service facilities, ferry terminals, flowers and trees, and special houses. Chapter II Responsibilities of Road Administration Organizations Article 5 The main responsibilities of road administration organizations at all levels are:

(a) to publicize the laws, regulations and rules of road administration;

(two) the protection of road property, the implementation of road property inspections, according to the law to stop and investigate all kinds of illegal use, occupation and destruction of road property;

(three) to control the red lines on both sides of the highway according to law and ban illegal buildings;

(four) to maintain the integrity of highway signs and markings;

(five) to maintain the normal order of highway maintenance and construction; Check and urge highway maintenance units to maintain normally, clear roadblocks in time, carry out emergency repairs, ensure smooth and safe roads, do a good job in cultivating and pruning street trees, and do not affect the safe use of traffic and surrounding industrial and agricultural facilities;

(six) to educate the people along the highway about love, protection and safety;

(seven) other duties as prescribed by laws, regulations and rules. Article 6 When performing official duties, road officials of road administration institutions shall enforce the law impartially, provide enthusiastic service, dress in accordance with state regulations, hold the "People's Republic of China (PRC) Road Administration Certificate" and wear the "China Road Administration" badge. Use special stop signs or command flags (lights).

Road management agencies can hire part-time road personnel and volunteer road personnel to assist in road management. Seventh road inspection vehicles must be equipped with "China road" signs and lights. Chapter III Management of Road Property Article 8 Land used for highways and ancillary facilities shall be surveyed and registered by highway management agencies in conjunction with land management departments, and maps shall be drawn, catalogued and filed, and boundary markers shall be buried, which shall be reported to the people's government at the county level for the record.

Used in roads, courtyards, nurseries, vegetable fields, hotels, etc. , formed in history and used for a long time, did not go through the formalities of land acquisition, but can no longer pay the relevant fees.

When a new, rebuilt or expanded highway project is accepted, the construction unit shall hand over the relevant highway production materials to the highway management organization at the same time. If the land of abandoned road sections is used for other purposes after new construction or reconstruction, the relevant formalities shall be handled at the land management department. Article 9 Without approval, no unit or individual may engage in the following acts on highway property:

(a) set up poles, transformers, shacks, stalls, maintenance stations, washing stations, water stations and other facilities;

(two) dumping waste soil, piling up garbage or other off-highway maintenance construction materials;

(3) Diversion irrigation, sewage discharge, earth borrowing and blank making, blocking side ditches, blind ditches and intercepting ditches, and building dams and storing water by using highway bridges and culverts;

(4) Laying pipelines for transporting flammable, explosive and toxic gases and liquids in highway bridges and tunnels;

(five) move, alter, damage, dismantle and occupy highway facilities;

(six) vehicles with dripping, spilling and mopping parts are driving on highways paved with high-grade and second-grade roads;

(seven) market transactions and threshing to dry grain;

(eight) other acts endangering highway production.

It is forbidden for any unit or individual to excavate sand and gravel, build dams, compress or widen riverbeds, divert water, burn wasteland, blast, cut down trees and mine earth within 200m upstream and downstream of large and medium-sized highway bridges and ferries, 50m upstream and downstream of small bridges, and around the center line of highway tunnels100m.
