Article 3 The outsourcing team refers to the construction team for underground mining, excavation, filling, transportation, exploration and other projects in the mines owned by the contracting company.
Article 4: The company must adhere to the principles of openness, fairness and transparency in the selection of outsourcing teams, and select construction teams in strict accordance with the company's relevant regulations on project bidding.
Article 5 When bidding for outsourced projects, bidders should be required to submit the following materials and strictly review them.
1. Possess complete certificates such as level three or above qualifications for mining engineering construction contracting, legal person business license, corresponding level qualification certificate, safety production license, contracting mining engineering construction enterprise safety qualification certificate, and explosives use license. ;
2. Have more than three years of experience in mining engineering construction or mining operations, or have been engaged in underground mining operations in non-ferrous metal mines for more than two years;
3. Have more than three managers personnel and one or more technical personnel with mining technology and management experience;
4. Personnel engaged in special types of work (blasters, welders, electricians, fitters, safety workers, etc.) must hold professional qualifications Certificate, other operators must have experience in underground mining operations and receive education on underground production safety.
Article 6 It is strictly prohibited to subcontract or subcontract the contracted outsourcing projects in any form, and the project leader, professional technicians and safety production leader shall not be replaced at will. Otherwise, the company has the right to impose penalties. .
Article 7 The number of outsourcing teams used by the same mining unit of the company should be controlled within 3. If two or more outsourcing teams operate in the same mine, the mining unit must preside over the signing of a safety production management agreement between the construction units. The mining unit shall supervise the implementation of the safety production management agreement as the coordinating management party of the agreement.
Article 8 The mining unit affiliated to the company shall coordinate and manage the safety production work of the outsourced team and incorporate it into the enterprise's safety production management system. According to the characteristics of outsourced projects, establish a practical safety production management system, select full-time safety managers with strong sense of responsibility, understand technology, and understand business to manage and supervise the safety production work of the construction unit. It is strictly prohibited to use outsourcing as an escrow. No matter what happens.
Article 9 The person in charge of the outsourcing team should attend various meetings on production safety of the mining unit, participate in daily dispatching meetings, and be responsible for organizing and implementing relevant resolutions of the meeting.
Article 10 Employees recruited by the outsourcing team must be over 18 years old, have a junior high school education or above, and are required to hold certificates for special types of work. The outsourcing team should sign labor contracts with employees and assume all legal responsibilities of the employer. Occupational patients with occupational contraindications and persons who may harm the interests of the company are not allowed to be hired.
Article 11 When recruiting employees, the outsourcing team should include the employee’s name, gender, age, household registration location, education level, skills training status, safety training time, planned work type, certificate holding status, etc. The roster of information is reported to the human resources department of the mining unit where the mining unit is located, and the human resources department organizes a compliance inspection of outsourced team employees every quarter. The number of workers in the outsourcing team should match the monthly operation plan and should not be less than 95% of the quota. The outsourcing team should submit this month's labor schedule to the Human Resources Department at the beginning of each month for filing.
Article 12 The outsourcing team should be equipped with more than one construction safety officer and a sufficient number of safety workers, and provide employees with complete labor protection supplies. Strengthen employee safety knowledge training, enhance employee safety awareness, and provide employees with safety learning at least once a week. New employees must be trained before taking up the job, and existing employees must be trained more than once a year. The time for general workers to receive mine safety knowledge education is no less than 24 hours, and the time for special workers to receive education is no less than 48 hours.
Article 13 The outsourcing team should conduct ideological education, legal education, safety education and skills training for employees in a planned, focused and targeted manner to improve their quality and skills and educate employees to comply with Comply with laws, regulations and rules and be a civilized employee. The employee training of the outsourcing team is included in the company's training plan. The human resources department, safety and environmental department and other relevant departments of the mining unit should assist the outsourcing team in employee training.
Article 14 The outsourcing team should formulate systems and standards for employee recruitment, training, salary, rewards and punishments, dismissal, benefits, etc., establish and improve various rules and regulations, and standardize employee management. The Human Resources Department should Assist and supervise implementation. The outsourcing team should pay employees' wages and subsidies in full and on time, provide necessary insurance for employees, and must not delay or withhold employees' wages and subsidies without reason.
Article 15 The outsourcing team must standardize internal employment and management, and fully place the company’s designated personnel in strict accordance with the contract requirements. It is strictly prohibited to hire employees of other outsourcing teams without the permission of the project managers of other outsourcing teams constructing in our company.
Article 16 Mining units shall bear the following safety production responsibilities for outsourcing teams:
1. Conscientiously implement national laws, regulations and industry standards on production safety, and earnestly fulfill the "safety requirements" First, we should adhere to the principle of "prevention first, comprehensive management" and promote standardized management of production safety.
2. Responsible for signing a production safety agreement with the outsourcing team. The outsourced team must be managed for production, technology, planning, safety and on-site management.
3. Investment in production safety must be increased in accordance with national regulations. Special funds for safety must be clearly included in outsourcing project contracts, and the facilities and equipment provided must comply with national regulations.
4. Develop a safety production management system for the outsourcing team, clarify the safety production responsibilities of the construction unit, improve the management methods for construction personnel changes, and establish construction technology, management, safety and other information files. Engineering and technical personnel must be organized to review the individual project design and construction plans (pictures) designed by the outsourcing team themselves.
5. Responsible for conducting mine-level safety training and education for employees of construction units, supervising, inspecting and implementing the work of workshop and team safety production training and education conducted by construction units.
6. Understand the personnel changes of the construction unit, and review and approve the changes of the project leader, project safety production leader and main production technical personnel of the construction unit.
7. Check whether the operating certificates of the construction unit’s special types of workers are complete and valid.
8. Regularly organize safety inspections of outsourced projects. If the construction unit is found to have any form of safety hazards during the construction process, it should be ordered to make timely rectifications; if any major accident hazards are discovered that seriously endanger construction safety and personal safety, When it is safe, they should be ordered to stop work for rectification and make rectifications within a time limit. If the rectification is still unsatisfactory, the contract should be terminated.
9. Responsible for organizing regular safety inspections in the work area. The inspection contents include: prevention of roof cover, prevention of gun smoke poisoning, prevention of falling into wells, prevention of water penetration, prevention of food poisoning, prevention of heatstroke, and prevention of Collapse, landslide prevention, fire prevention, accidental injury prevention, etc.
10. Establish and improve the registration and withdrawal system for blasting items in construction units to prevent any form of loss of blasting items.
11. Outsourcing projects must conscientiously implement the "Three Simultaneities" of occupational safety and health and strictly comply with the "Measures for Design Review and Completion Acceptance of Safety Facilities in Non-Coal Mine Construction Projects" (State Administration of Work Safety Order No. 18).
Article 17 The contract or production safety agreement for an outsourcing project should include the following clauses:
1. Make it clear that the legal representative and project leader of the outsourcing team are responsible for production safety The first responsible person shall specify the person in charge, safety management personnel, key job personnel and other employees to implement the company's safety risk fund mortgage management system.
2. Clarify the system for outsourcing team leaders and safety management personnel to work underground;
3. Clarify that all outsourcing personnel must participate in work-related injury insurance or personal accident insurance.
4. The contract must specify that there is an outsourcing team under one of the following circumstances, and the company has the right to unilaterally terminate the contract.
(1) A major safety accident occurred in the outsourcing team that killed more than 3 people (including 3 people);
(2) A total of more than 3 people died throughout the year ( (including 3 people) or work safety fatal accidents occurred for 3 consecutive years;
(3) Failure to implement national production safety laws, regulations and policies, and disobey Party A’s unified management of production safety;
(4) The outsourcing team subcontracts or subcontracts the contracted engineering or mining production tasks.
(5) Failure to complete the production plan issued by the company for three consecutive months without legitimate reasons or failure to complete the company's production plan for six months in a year, and failure to complete the annual production plan;
(6) Privately conduct material or ore transactions with the company's units or employees, or collude with the company's units or employees to commit fraud, or use other unfair means to seek benefits;
(7) Serious violations Contract;
(8) Serious violation of laws, regulations and the company's rules and regulations.
5. Make it clear that the outsourcing team should accept Party A’s mine-level safety training and education for its employees, and notify Party A in advance of personnel changes.
6. The outsourcing team must establish a production safety responsibility system in accordance with the relevant national production safety regulations, strengthen production safety management in the operating area and related places, formulate supervision and management measures for hazardous sources, and establish emergency response to production safety accidents. Plan and practice.
7. The outsourcing team must receive sufficient quantities of explosives from Party A in accordance with the project progress and the explosives management regulations, and store and use them in accordance with the relevant national explosives management regulations. Illegal purchase, storage, and use of explosives is strictly prohibited.
8. The outsourcing team must establish a regular safety production meeting system and a safety production accident reporting system, and it is strictly forbidden to conceal the occurrence of accidents.
Article 18 If a production safety accident occurs, in addition to reporting it in a timely manner, the contingency plan for production safety accidents should be promptly launched, accident rescue should be carried out quickly, efforts should be made to control the expansion of the accident, and minimize casualties and property losses.
Article 19 The outsourcing team must proactively cooperate with the local government, safety supervision and other relevant departments to conduct accident rescue and accident investigation, carefully analyze the cause of the accident, investigate the responsibility for the accident, and truly achieve the "four things" Pass".
Article 20 When a production safety accident occurs to an outsourcing team, the mining unit where it is located shall bear corresponding responsibilities and hold the relevant personnel accountable in accordance with relevant regulations.
Article 21 The mining units affiliated to the company may refer to these regulations and formulate corresponding implementation details based on their own circumstances.
Article 22: These regulations shall come into effect on the date of promulgation.
