Chapter I General Provisions Article 1 In order to strengthen the supervision and management of commodity quality in the market, stop the circulation of fake and shoddy commodities, and safeguard the legitimate rights and interests of users and consumers, these Measures are formulated in accordance with the Standardization Law of People's Republic of China (PRC) and the relevant provisions of the state and province, combined with the actual situation of this Municipality. Article 2 All units and individuals engaged in commodity circulation and quality supervision activities within the administrative area of this Municipality shall abide by these Measures.

Verification of measuring instruments, drug inspection, food hygiene inspection, safety supervision and inspection of boilers and pressure vessels, inspection of import and export commodities and quality inspection of other special commodities stipulated by laws and regulations shall be carried out in accordance with relevant regulations. Article 3 The Municipal Bureau of Standards and Metrology shall be responsible for the supervision and management of commodity quality in the whole city. County and district administrative departments of standard measurement (including technical supervision, the same below) shall be responsible for the supervision and management of the quality of commodities in the market within their respective administrative areas.

The supervision and inspection of commodity quality shall be undertaken by the inspection unit stipulated by laws and regulations or the inspection unit entrusted by the administrative department of standards and metrology at or above the county level (hereinafter referred to as the quality supervision and inspection institution). Article 4 The administrative departments of industry and commerce, health, price and public security shall, according to their respective functions and duties, cooperate with the administrative departments of standard measurement to strengthen the supervision and management of commodity quality in the market. Article 5 The competent departments of all industries and enterprises in this Municipality shall strengthen the supervision and management of the commodity quality of their own industries and affiliated enterprises, establish and improve the commodity quality management system, and supervise their own industries and affiliated enterprises to abide by these Measures. Article 6 Consumers' associations and relevant social organizations shall assist the administrative department of standards and metrology in social supervision of commodity quality and safeguard the legitimate rights and interests of users and consumers. Article 7 The inspection system shall be implemented for commodities in the market. The municipal administrative department of standards and metrology shall publish the catalogue of inspection commodities as needed. All units and individuals engaged in commodity distribution activities in this Municipality (hereinafter referred to as distributors) must apply to the administrative department of standards and metrology for commodity inspection in accordance with the regulations, and can only sell after passing the inspection.

The municipal administrative department of standards and metrology may, according to needs, organize spot checks on the quality of commodities in the market or conduct joint supervision and inspection with relevant departments. Article 8 The expenses required for quality supervision and inspection institutions to inspect commodities in the market shall be allocated by the people's government at the same level and shall not be charged to dealers. Chapter II Quality Responsibility of Distributors Article 9 Distributors must be responsible for the quality of the commodities they distribute, strictly implement the system of incoming goods inspection and acceptance, conduct quality inspection in accordance with relevant regulations and standards, and ensure that the commodities they distribute meet the quality requirements. Article 10 If there are quality problems in the goods sold during the quality guarantee period, the distributor shall be responsible for the warranty, replacement and return. Eleventh prohibit the sale of the following commodities:

(1) Failure or deterioration;

(2) Endangering safety and personal health;

(three) the marked indicators are inconsistent with the actual situation;

(four) fraudulent use of high-quality marks, certification marks and forged license marks;

(five) adulteration to make false, fake to fill the true, old to fill the new;

(six) laws and regulations prohibit the sale. Twelfth distribution of goods in any of the following circumstances, it is pointed out that will not be corrected, shall not be sold:

(a) there is no inspection certificate or the relevant units to allow sales;

(two) the name, producer and place of origin of the goods are not indicated in Chinese (the address of important industrial products is not indicated);

(three) limited use without indicating the date of production and expiration time;

(four) the implementation of production (manufacturing) license management without indicating the license number and validity period;

(five) according to the relevant provisions, indicate the specifications, grades, main technical indicators or components, content, etc. It should be marked in Chinese, but it is not marked;

(six) high-end durable consumer goods without Chinese instructions;

(seven) unqualified products (including defective products and unqualified products) and the words "unqualified products" ("defective products" and "unqualified products") are not marked in the prominent part of the goods or packaging;

(eight) toxic, flammable, explosive and other dangerous goods are not marked with relevant signs and instructions. Thirteenth operators to publish, broadcast, set up and post commodity advertisements, must comply with the relevant provisions of the "Regulations on the Administration of Advertising". Commodity advertisements marked with quality standards must submit certificates issued by standardization management departments at or above the provincial level or quality inspection institutions that have passed metrological certification. Article 14 Distributors shall actively assist quality supervision and inspection institutions to supervise and inspect commodities, and truthfully provide inspection samples and materials in accordance with relevant regulations to provide convenient conditions for inspection. Chapter III Supervision and Inspection Article 15 Commodity quality supervision and inspection institutions shall inspect the quality of commodities in the market according to national standards and industry standards; Where there is no national standard or industry standard, local standards shall be implemented; Where there is no local standard, the enterprise standard or commodity description shall prevail. Article 16 Commodities with product quality certification marks and commodities with valid inspection certificates issued by legal quality supervision and inspection institutions at or above the provincial level may be exempted from inspection. However, when users and consumers report the quality of goods or find quality problems, the administrative department of standards and metrology at or above the county level has the right to conduct spot checks. Seventeenth high-end durable consumer goods must be destructive test, should be approved by the administrative department of standards and metrology at or above the county level. Eighteenth quality supervision and inspection personnel must produce quality supervision and inspection certificates when taking samples. When conducting joint inspection with other parties, quality supervision and inspection institutions must hold the task book issued by the administrative department of standards and metrology at or above the county level and the sampling sheet uniformly printed by the administrative department of standards and metrology of the city; The distributor has the right to refuse if the quality supervision and inspection personnel fail to issue relevant certificates or the number of samples taken exceeds the specified amount.

Quality supervision and inspection institutions must issue inspection reports within the prescribed time limit and send them to the administrative department of standard measurement and dealers in time.
