Guiding opinions on the integration of inspection, testing and certification institutions in the national quality inspection system

Inspection and certification is an important part of quality infrastructure. After years of efforts, the construction of inspection, testing and certification institutions of quality inspection system has achieved remarkable results, and played an important role in strengthening quality supervision, promoting industrial development, supporting independent innovation, safeguarding the interests of the masses, and safeguarding national security. However, there are also some problems, such as unclear functional orientation, excessive administrative dependence, low resource efficiency, weak comprehensive ability, lack of service brands, and lagging international development, which are incompatible with the needs of China's national economic and social development. Integrating inspection and certification institutions is an important task of institutional reform and functional transformation in the State Council and an important measure to promote the development of inspection and testing high-tech service industry in China. It is of practical significance to promote the transformation from China manufacturing to China creation, from China speed to China quality and from China products to China brand. In order to thoroughly implement the spirit of "Several Opinions of the State Council on Promoting Fair Competition in Market Economy and Maintaining Normal Market Order" (Guo Fa [2014] No.20) and "Notice of General Office of the State Council on Forwarding the Implementation Opinions of AQSIQ on Integrating Inspection, Testing and Certification Institutions" (Guo Ban Fa [2014] No.8), combined with the actual quality inspection system, the integration of inspection, testing and certification institutions is now carried out.

I. General requirements

(1) guiding ideology.

We will implement the spirit of the 18th National Congress of the Communist Party of China and the Second and Third Plenary Sessions of the 18th Central Committee, make the market play a decisive role in the allocation of resources and give better play to the role of the government, and adhere to the separation of government and enterprise management. Combined with the characteristics of quality inspection industry, scientifically define the public welfare and business function orientation of inspection, testing and certification institutions. Driven by the government and innovation, we will vigorously promote integrated development, optimize the layout structure, expand open cooperation, stimulate market vitality, comprehensively improve the service capabilities of inspection, testing and certification enterprises, and continuously improve the service level of inspection, testing and certification, laying a solid technical foundation for building a quality power.

(2) Basic principles.

-adhere to scientific planning and become stronger and bigger. Combined with the planning and construction of the national quality inspection technology system, through the regional integration and cross-level, cross-regional and cross-domain integration of inspection and certification institutions, the scale will be expanded, the strength will be enhanced and the number will be reduced. In the future, in principle, the quality inspection department will no longer directly set up general inspection and testing certification institutions.

-Adhere to the rule of law and market-driven. Accelerate the cleaning up of relevant policies and regulations on inspection, testing and certification, and further improve relevant laws and regulations. Unify the qualification management of inspection, testing and certification institutions, open the inspection, testing and certification market in an orderly manner, and create a fair competitive market environment for all kinds of subjects.

-Adhere to classified integration and step-by-step implementation. Combined with the classification reform of public institutions, according to the functional orientation, the inspection and testing certification institutions are divided into public welfare inspection and testing certification institutions and operational inspection and testing certification institutions for classification and integration. On this basis, we will promote the transformation of operational inspection, testing and certification institutions into enterprises. After the inspection and certification institutions are transformed into enterprises, they are gradually decoupled from government departments.

-adhere to local conditions and pilot first. According to the actual situation, all localities have formulated and implemented the operation integration plan of inspection, testing and certification institutions. Encourage all localities to actively carry out cross-departmental, cross-industry and cross-regional integration pilots, actively explore various ways including mixed ownership, and promote the integration of inspection, testing and certification institutions in various modes from point to area.

-adhere to the people-oriented principle and make overall plans. Rely on the broad masses of cadres and workers to promote the integration of inspection, testing and certification institutions, maintain the stability of personnel, earnestly safeguard the vital interests of the masses, and realize the unity of national, collective and individual interests. Pay attention to the integration of inspection and certification institutions and the effective connection and coordinated promotion of the management system reform and functional transformation of quality inspection departments.

(3) Work objectives.

By 20 15, the integration of inspection and certification institutions directly under the General Administration of Quality Supervision, Inspection and Quarantine and inspection and certification institutions related to the entry-exit inspection and quarantine system was basically completed, and the pilot project of vertical integration of special equipment inspection and testing institutions achieved remarkable results. By 20 17, the integration of inspection, testing and certification institutions of quality inspection system was basically completed. Public welfare inspection, testing and certification institutions have clear responsibilities and strong guarantees, and the transformation of operational inspection, testing and certification institutions into enterprises is basically in place. By 2020, we will basically complete the reform tasks such as separation of government affairs, separation of management and office, and transformation into enterprises. The professional promotion, large-scale integration, market-oriented operation and internationalization of business inspection and certification institutions have achieved remarkable results, forming a number of comprehensive inspection and certification groups with well-known brands.

Second, the integration path

(1) Institution category.

Public inspection, testing and certification institutions refer to inspection, testing and certification institutions organized by the government, funded by financial guarantee or subsidies, and aiming at public services. Public welfare inspection, testing and certification institutions mainly provide technical support for the government to formulate policies, regulations and risk management, provide technical support for government supervision, provide technical services for major projects of the national economy and people's livelihood, and provide other inspection, testing and certification services that are not suitable for the market mechanism. Public welfare inspection, testing and certification institutions shall not engage in for-profit inspection, testing and certification business.

Business inspection, testing and certification institutions refer to inspection, testing and certification institutions that allocate resources by the market, exist in the form of independent enterprise legal persons, operate independently, conduct independent accounting and assume sole responsibility for their own profits and losses. When conditions are ripe, business inspection and certification institutions can also choose social organization forms. Business inspection and certification institutions provide socialized and commercialized inspection and certification services to the society, and can also undertake inspection and certification services purchased by the government.

(2) Integration mode.

Under the leadership of the government, all localities can choose or refer to the following modes to implement integration according to the actual situation.

1. Integration of administrative distribution methods. Take administrative lottery to integrate the personnel and assets of inspection and certification institutions.

2. Authorization operation mode integration. With the approval of the financial department, the financial assets of the inspection and certification institutions will be converted into operational assets and integrated according to the capital operation mode.

3. Integration through division and merger. The existing inspection, testing and certification institutions are divided into two parts, one part is classified as public welfare inspection, testing and certification institutions, and the government leads the implementation of integration; The other part is reformed and integrated into a business inspection, testing and certification institution.

4. Public * * * platform integration. Local governments integrate inspection, testing and certification institutions affiliated to different departments, build public inspection and testing platforms, and work as independent inspection and testing institutions.

5. Integration of overall restructuring methods. Reorganize the existing inspection and testing certification institutions as a whole, and then integrate them into operational inspection and testing certification institutions in the form of capital.

Third, key tasks

(1) Promoting the integration of inspection, testing and certification institutions of entry-exit inspection and quarantine departments (20 14-20 15).

1. China Quality Certification Center was transformed into an enterprise, merged into China Inspection and Certification (Group) Co., Ltd., retained CQC brand, and established a modern enterprise system. The assets of the 3 1 evaluation center directly under the Inspection and Quarantine Bureau were included in the local company of China Inspection Group after audit and evaluation.

2. Integrate the inspection and testing institutions directly under the Entry-Exit Inspection and Quarantine Bureau according to their functions, and separate the public welfare functions from the general inspection and testing functions.

3. The inspection, testing and certification institutions directly under the Inspection and Quarantine Bureau shall be integrated according to the classification reform plan of inspection and quarantine institutions of the General Administration of Quality Supervision, Inspection and Quarantine approved by the central authorities. Institutions that need to be transformed into enterprises are included in the China Inspection Group.

(2) Promoting the integration of inspection, testing and certification institutions of quality and technical supervision departments (20 14-20 17).

1. Separate the special equipment inspection and testing institutions of quality supervision system into public welfare inspection and testing institutions and business inspection and testing institutions, and integrate business inspection and testing institutions. Promote the vertical integration of China Special Equipment Inspection and Research Institute with assets as the link nationwide, and set up China Special Equipment Inspection and Testing Group. Encourage the integration of assets within and across provinces, and set up a number of regional special equipment inspection and testing groups. By 2020, three to five special equipment inspection and testing groups, such as China Special Inspection Group, with strong technical ability, high service level, good scale benefit and certain international influence will be strengthened, and a socialized high-tech service system for special equipment inspection and testing with reasonable layout, strong strength, fairness and credibility will be formed. The pilot scheme for the integration of special equipment inspection and testing institutions shall be formulated separately (see annex).

2. In order to ensure the unity, accuracy and reliability of national measurement and the effectiveness of legal measurement and people's livelihood measurement, the technical institutions that undertake the transmission, traceability, legal measurement and people's livelihood measurement of national measurement can be set as public welfare inspection and testing institutions. The business of commercial measurement and calibration is integrated into the business of inspection and testing institutions.

Separate the administrative supervision and law enforcement functions performed by fiber inspection institutions from the inspection and testing functions of industrial products such as textiles and garments, and integrate the inspection and testing functions of industrial products such as textiles and garments into operational inspection and testing institutions.

Encourage inspection, testing and certification institutions to integrate in the same city.

(3) Cross-industry, inter-departmental and inter-regional integration (20 15-20 17).

1. Promote the reorganization of China Inspection and Certification (Group) Co., Ltd. into a state-owned capital operation company. Support CIQ to integrate the internal and external institutions of the quality inspection system by means of asset allocation, brand joining, setting up investment and financing platforms and industrial funds; Establish an international operation platform, integrate the existing overseas businesses and institutions of quality inspection system, and build a well-known brand of international inspection and certification.

2. Support Fiona Fang Mark Certification Group to give full play to its brand advantages and national network advantages, take the market as the guide, take capital as the link, integrate resources with inspection and certification institutions inside and outside the quality inspection system, and reorganize to build a joint-stock Fiona Fang Mark Inspection and Certification Group.

3. Encourage China National Institute of Standardization and China Academy of Inspection and Quarantine to explore cross-departmental, cross-industry, cross-regional and cross-level integration with assets and inspection and testing business as the link respectively.

4. According to the principle of setting up comprehensive inspection and testing institutions in the same county (city), promote the county-level government to integrate inspection and testing resources belonging to different departments and set up comprehensive inspection and testing institutions at the county level.

Fourth, the pilot demonstration

(a) special equipment inspection and testing institutions integrated reform pilot. Promote China Special Inspection Institute, with the support of the central finance and relevant local finance, to establish China Special Equipment Inspection and Testing Group with joint provincial and sub-provincial special equipment inspection and testing institutions, and on the basis of voluntary negotiation, with joint capital contribution in the form of fixed assets, intangible assets and monetary funds. Support the integration of special equipment inspection and testing institutions in Jiangsu and other provinces. Conditional areas can explore and promote inter-provincial integration and form regional special equipment inspection and testing groups.

(two) the comprehensive reform of inspection and certification institutions. Promote the vertical integration and deep integration of inspection and testing institutions in special equipment and other professional fields in Hubei Province. Explore and promote the cross-regional and cross-level integration pilot of Hubei Quality Inspection Institute and China Inspection Group. Support led by the city and county governments to promote the integration of inspection and testing institutions in different departments or industries into operational inspection and testing institutions.

(three) the pilot transformation of inspection and testing institutions into enterprises. Support qualified inspection, testing and certification institutions in Haiyan County, Zhejiang Province to transform into enterprises, promote the pilot reform of inspection, testing and certification institutions with mixed ownership, and explore an operating model conducive to the healthy development of inspection, testing and certification institutions.

(four) the development and reform of inspection and testing institutions. Support Guangzhou and other places to build a national inspection and testing high-tech service industry cluster, integrate inspection and testing institutions inside and outside the quality inspection system, comprehensively set up public inspection and testing institutions and operational inspection and testing institutions, set up large-scale operational inspection and testing group companies, promote the sharing and agglomeration development of inspection and testing resources, and build a unified inspection and testing brand.

(five) the pilot reform of the integration of inspection and certification institutions in the same city. Support Sichuan Province and Chengdu City to explore supporting policies such as personnel management, asset management and social security involved in the investment and establishment of enterprises by innovative institutions on the basis of Chengdu Quality Inspection Institute Co., Ltd., which has been integrated in the same city. Take capital as the link, and integrate the inspection and testing institutions inside and outside the quality inspection system.

(six) the integration of technical alliance of inspection and testing institutions. Promote the establishment of inspection and testing technology alliance by inspection and testing institutions of quality inspection system. Based on the alliance, explore the substantive integration among alliance members.

Support other regions and institutions of the national quality inspection system to carry out various forms of pilot integration of inspection, testing and certification institutions according to local actual conditions and document No.20 and No.8 issued by the State Council and the spirit of this opinion, and explore experiences from point to point.

It is necessary to put the integration of inspection, testing and certification institutions in a prominent position, strive to be included in the overall deployment of local governments to comprehensively deepen reforms, and make overall plans to promote them. Under the leadership of local governments, it is necessary to promote the establishment of a leading group for the integration of inspection, testing and certification institutions, clarify the division of responsibilities of various departments, and improve the working mechanism. It is necessary to make an integration plan on 20 15, implement it conscientiously, and strive to seize the opportunity in the development of inspection, testing and certification high-tech service industry.

(2) Changing functions and innovating management. Quality inspection departments at all levels should play a coordinating role in integrating inspection, testing and certification institutions and promoting the inspection, testing and certification industry to become stronger and bigger. We will promote the reform and repeal of relevant laws and regulations, break departmental monopoly and industry barriers, and open the inspection, testing and certification market in an orderly manner. Promote the transformation of quality and safety supervision methods, reduce administrative examination and approval, further play the role of market supervision, and stimulate the demand for inspection and certification. Strengthen the inspection and certification of government-purchased services, introduce competition mechanism, and realize the diversification of service supply. Promote the establishment of external evaluation and restraint mechanisms for inspection, testing and certification institutions and improve the corporate governance structure. Promote the integrity construction of inspection, testing and certification, strengthen the post-event supervision of inspection, testing and certification, increase the punishment for dishonesty, and earnestly safeguard the social credibility of inspection and certification.

(3) Actively coordinating and supporting policies. Quality inspection departments at all levels should actively strive for the support of local governments, strengthen coordination and communication with relevant departments such as editorial office, finance, human resources and social security, taxation, industry and commerce, and strive for local governments to formulate relevant supporting policies in accordance with the spirit of the relevant documents of the CPC Central Committee and the State Council to promote the reform of public institutions, and properly handle the * * * problems in the integration of inspection, testing and certification institutions and enterprise restructuring.

(4) Strict discipline and steady progress. Quality inspection departments at all levels should strictly abide by the relevant financial laws and regulations, strictly perform the relevant examination and approval procedures, and do a good job in asset verification, financial audit, property rights change and so on. , it is strictly prohibited to resort to deceit, concealment and unauthorized transfer, resale, lending, dividing up or otherwise disposing of state-owned assets. Properly handle the relationship between reform, development and stability, grasp the rhythm and progress, timely study and solve new situations and new problems encountered in the integration reform, ensure that the mind is not chaotic, the team is not scattered, and the work is continuous, and ensure the smooth and orderly progress of the integration reform.

All relevant departments (units) should pay full attention to it, raise awareness, intensify their work, actively promote the vertical integration of special inspection institutions according to the requirements of the State Council, improve inspection efficiency, stimulate market vitality, implement corporate responsibility, reduce social costs, and promote the sustainable development of high-tech service industries such as inspection, testing and certification.

I. Guiding ideology, basic principles and work objectives

(1) guiding ideology.

In accordance with the overall requirements of comprehensively deepening the reform, the transformation of government functions and the reform of public institutions put forward by the 18th National Congress of the Communist Party of China and the Third Plenary Session of the 18th Central Committee, we should give full play to the decisive role of the market in resource allocation and better play the role of the government, adhere to the separation of government from enterprise management, scientifically define the functional orientation of professional and technical work and inspection and testing work of special equipment safety supervision, vigorously promote the integration of special equipment inspection institutions, make special inspection institutions bigger and stronger, and constantly improve the high-tech service level of special inspection.

(2) Basic principles.

According to the development concept of specialization, socialization, scale and internationalization, the basic principles of the integration of special inspection institutions are determined.

-adhere to the separation of government from enterprise and management from office. The professional and technical work of safety supervision shall be undertaken by the public welfare organization organized by the government, and the inspection and testing business shall be undertaken by the operational special inspection team, and the corporate governance structure of the special inspection team shall be established and improved.

-Adhere to government promotion and vertical integration. The General Administration of Quality Supervision, Inspection and Quarantine shall formulate relevant policies and access conditions for administrative licensing, and guide and promote the vertical integration of special inspection institutions. Quality supervision departments at all levels actively strive for the support of local governments and relevant departments in accordance with the requirements of the state on the pilot vertical integration of special inspection institutions, and organize and promote local special inspection institutions to complete the vertical integration on time.

-Adhere to overall planning and rational layout. According to the requirements of special equipment inspection, make overall planning and scientific overall planning, so that the overall layout of special inspection institutions can adapt to the rapid growth of special equipment and the safety needs of the people.

-adhere to classified promotion and step-by-step implementation. According to the actual situation, all localities have promoted the integration work step by step. Improve relevant supporting policies and measures to encourage mature areas to take the lead in integration; Temporarily do not have the conditions to actively create conditions to gradually promote, to ensure the timely completion of the integration task.

(3) Work objectives.

China Special Equipment Testing and Research Institute (hereinafter referred to as "China Inspection Institute") took the lead in uniting with willing local special inspection institutions, initiated and registered China Special Equipment Inspection Group (hereinafter referred to as "China Inspection Group") with assets as a link, leading the vertical integration of national special inspection institutions; At the same time, encourage and promote provincial (sub-provincial cities) special inspection institutions to integrate other special inspection institutions, set up provincial or inter-provincial special inspection groups, and initially form a socialized pattern of special equipment inspection and testing.

Second, lay a solid foundation for integration and build an orderly competition pattern.

(a) clear the nature and positioning of special equipment technical inspection institutions.

In the implementation of the pilot integration of special inspection institutions, at the same time, the public welfare institutions organized by the special equipment safety supervision departments of governments at all levels will be retained as technical inspection institutions. Its main function is to provide technical support for the safety supervision department of special equipment, and undertake daily work such as accident investigation and analysis, emergency response, hidden danger rectification supervision, risk monitoring, statistical analysis, inspection quality supervision and spot check, complaint investigation, and use registration. Retain China Special Inspection Institute as the national research laboratory of special equipment safety and energy-saving technology; Provincial special equipment technical inspection (accident investigation and emergency disposal) institutions reserved by the provincial government; According to the actual needs of local special equipment safety supervision, the municipal government retains local special equipment technical inspection (accident investigation and emergency response) institutions. The above-mentioned technical inspection institutions use the quality inspection system to check the establishment of special inspection institutions, and re-check the establishment according to the responsibilities, tasks and actual work needs and the principle of only reducing and not increasing.

(two) the construction of special equipment inspection and testing orderly competition pattern.

Promoting the integration of special inspection institutions should be implemented simultaneously with the reform of special equipment inspection and administrative licensing. Socialize the manufacturing supervision and inspection, installation supervision and inspection, design document appraisal and periodic inspection of special equipment in production and use, and the production or use unit shall independently choose qualified inspection institutions, and no department or unit may designate inspection institutions for enterprises. Strive to create a fair, just and orderly competition environment for inspection and testing. The integration pilot should be actively and steadily implemented step by step, especially the reform involving public security. After the successful experience of the pilot, it should be gradually promoted.

In order to ensure the smooth vertical integration of special inspection institutions, special equipment inspection and testing institutions are divided into two categories according to their work attributes: the first category is comprehensive inspection group (special inspection group), which is mainly engaged in the inspection of special equipment. The above inspection work is a technical behavior involving safety and strong public attributes. Such institutions should have the corresponding capabilities, the government should make overall plans, scientifically set access conditions, and enterprises should choose independently to achieve orderly competition; The second category is special testing institutions, mainly engaged in nondestructive testing, safety valve calibration, regular inspection of gas cylinders and other entrusted testing. , belonging to the market behavior, resources are allocated by the market to achieve full competition.

(three) to formulate the access conditions for the establishment of the special inspection team (pilot).

Special equipment is related to personal and property safety and social stability, and the inspection of special equipment has a strong public attribute, which is mainly undertaken by a large-scale and powerful special inspection team formed by integration.

1. During the integration pilot period, when formulating the access conditions for special inspection teams, necessary restrictions should be imposed on the nature of group investors, group size, group articles of association, group capacity, corporate governance structure and social supervision mechanism.

2. The established special inspection team shall not carry out business activities such as design, manufacture, installation, transformation, repair, maintenance and sales of special equipment.

During the integration pilot period, the institutional attributes and establishment of the investors who participated in the establishment or joined the special inspection team remained unchanged, and they continued to provide technical support for government safety supervision.

The inspection qualification and business of CISICA and all investors are all transferred to CISICA, and a unified brand, qualification and quality system are implemented within CISICA.

2. Establish provincial and inter-provincial special inspection teams.

Under the leadership of the government, according to the actual situation of each province, provincial special inspection institutions can take the lead in vertically integrating the special inspection institutions in the province, adopting financial assets investment and administrative allocation, or transforming financial assets into operational assets and integrating them according to the capital operation mode. After the establishment of the provincial special inspection team, it can further join the China special inspection team, and can also be further integrated into the inter-provincial special inspection team.

In the process of setting up a special inspection team, all provinces should consider retaining the career establishment of provincial and municipal technical inspection institutions to ensure the full disbursement of career funds.

Provincial (including sub-provincial cities and cities with separate plans) and prefecture-level special inspection agencies can directly participate in the formation of China special inspection teams, or jointly set up inter-provincial special inspection teams, or participate in the special inspection teams set up in the provinces where they are located.

For remote areas with a small number of special equipment, we can continue to retain the existing special inspection institutions of public institutions, and undertake the inspection and testing of special equipment that the local special inspection team fails to cover within the original qualification scope (or by purchasing services from the government) to ensure the full coverage of special equipment inspection and testing in the local area.
