Provisions of Fushun Municipality on Management and Supervision of Fire Water Source Facilities

Article 1 In order to strengthen the management and supervision of fire water source facilities, ensure fire water use, and protect the safety of public property and citizens' lives and property, these Provisions are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 Units and individuals within the administrative area of this Municipality must abide by these Provisions. Article 3 The fire water source facilities mentioned in these Provisions refer to fire water supply facilities and automatic fire water supply systems such as fire pipe networks, fire hydrants, fire pools, water towers and special fire wells. Fourth fire water source facilities daily maintenance management and regular maintenance work, the public * * * part by the real estate public management department is responsible for; Within the unit, the unit is responsible for; City and county public security fire control institutions are responsible for daily supervision and inspection. Fifth city and county public * * * fire water source facilities planning and construction scheme by the public security fire control institutions at the same level in conjunction with the municipal planning, construction committee, public utilities, urban construction and other departments, and incorporated into the overall long-term urban construction planning. Article 6 The design of fire water source facilities must conform to the relevant national fire technical specifications and standards. Urban construction and transformation must be synchronized with the construction and transformation of fire water source facilities; Newly built or rebuilt fire water source facilities must be issued by the competent department of city planning, and their design drawings and geographical location maps shall be submitted to the public security fire control institutions for examination and filing; If the built fire water source facilities do not meet the requirements of the specification, they should be reformed. Article 7 The municipal and county people's governments shall gradually increase the funds for the construction and renovation of fire water source facilities, and arrange special funds for the maintenance of public fire water source facilities from urban maintenance fees every year to ensure that fire water source facilities meet the needs of national economic and social development in the region. Eighth fire water source facilities construction units must be in accordance with the design drawings, and shall not be changed without authorization. After the completion of the fire water source facilities, the construction unit shall, in conjunction with the public security fire control institutions, accept and hand over the files to the municipal urban construction archives.

If the fire water source facilities are damaged or affect the use of fire fighting, they must be repaired in time.

Fire water source facilities, the management unit is responsible for setting up clear signs that meet the national technical standards. Article 9 The management of fire water source facilities shall meet the following requirements:

(a) to establish and improve the fire water source facilities maintenance management system;

(two) regular inspection and monitoring of fire water source facilities;

(three) the fire water source facilities are in good condition and effective, and the water intake channel is smooth. Tenth no unit or individual may interfere with the normal use of fire water source facilities. It is forbidden to pile up all kinds of articles, park vehicles, dig holes and borrow soil, and build buildings (structures) within 5 meters around outdoor fire hydrants, fire pools and other fire water source facilities. During interior decoration, it is forbidden to move, modify, block or damage the fire water source facilities. Dismantling, moving, misappropriating or stopping fire water source facilities must be approved by public security fire control institutions. Eleventh in addition to emergency rescue and disaster relief, fire water supply and fire water source facilities shall not be used without authorization. Under special circumstances, water must be approved by the public security fire department and used at a limited time and place. Article 12 In case of any of the following acts in violation of these regulations, the public security fire control institution shall order it to make corrections within a time limit or go through formalities, and impose a fine of more than 2,000 yuan and less than 50,000 yuan on the unit; The person in charge of the unit shall be fined from 200 yuan to 500 yuan.

(a) the design of fire water source facilities violates the relevant fire technical specifications and fails to be rectified according to the audit opinions of public security fire control institutions;

(two) the design of fire water source facilities has not been audited by public security fire control institutions, or has not been designed and constructed in accordance with the audited fire water source facilities. Thirteenth in violation of the provisions of any of the following acts, the public security fire department shall order it to repair or compensate, and impose a fine of 2000 yuan to 5000 yuan on the unit; The responsible person shall be fined more than 500 yuan 100 yuan.

(a) the unit or individual damages the fire water source facilities and hinders the normal use of the fire water source facilities;

(2) Dismantling, moving, misappropriating, stopping or blocking fire water source facilities without authorization;

(three) units and individuals use fire water source facilities without authorization. Fourteenth public security fire control institutions shall supervise and inspect the fire water source facilities according to law, and if they find that they do not meet the requirements of fire control management, they shall issue a "Fire Supervision and Inspection Opinion" to the responsible unit or the relevant responsible person, and order them to make rectification within a time limit. One of the following acts, the unit at 500 yuan more than 2000 yuan fine; The person in charge of the unit shall be fined more than 500 yuan 100 yuan.

(a) after receiving the "fire supervision and inspection opinions", it fails to make rectification within the time limit or refuses to make rectification;

(two) do not perform the duties of fire water source facilities management. Fifteenth in violation of the provisions, which constitutes a public security administration punishment, shall be punished by the public security organs in accordance with the "Regulations of the people's Republic of China on administrative penalties for public security"; If a crime is constituted, criminal responsibility shall be investigated according to law. Sixteenth public security fire supervision personnel must strictly perform their duties, and those who fail to audit, supervise and inspect and accept according to the regulations, resulting in losses, shall be given administrative sanctions according to the circumstances; If a crime is constituted, criminal responsibility shall be investigated according to law. Seventeenth specific issues in the application of these Provisions shall be interpreted by the Municipal People's government. Eighteenth the provisions shall come into force as of the date of promulgation.
