Hydrological regulations of Hunan province

Chapter I General Provisions Article 1 In order to strengthen hydrological work and promote the development of hydrological undertakings, these Regulations are formulated in accordance with the provisions of the Water Law of People's Republic of China (PRC), the Flood Control Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to hydrological planning and construction, hydrological and water resources monitoring, hydrological and water resources information and forecast, water resources investigation and evaluation, hydrological supervision and management and other activities within the administrative area of this province. The water administrative department of the third provincial people's government is responsible for the supervision and management of hydrology in the whole province, and its subordinate hydrological institutions are responsible for the specific work of hydrological supervision and management.

The water administrative departments of the people's governments of cities, autonomous prefectures and counties (cities, districts) with districts shall be responsible for guiding the hydrological work within their respective administrative areas. Article 4 Hydrological undertakings are basic public welfare undertakings for economic construction and social development.

The people's governments at or above the county level shall strengthen their leadership over hydrological work, incorporate hydrological undertakings into national economic and social development plans, take measures to accelerate the modernization of hydrology, and ensure the coordinated development of hydrological undertakings and economy and society.

The provincial people's government shall include the funds required for hydrological services into the provincial financial budget, and the people's governments of cities, autonomous prefectures and counties (cities, districts) with hydrological institutions and hydrological monitoring stations (points) shall arrange corresponding funds for the development of local hydrological services, and the specific measures shall be formulated by the provincial people's government. Fifth units and individuals that have made outstanding contributions in hydrological work shall be commended and rewarded by the people's government or relevant departments. Chapter II Hydrological Planning and Station Network Construction Article 6 The water administrative department of the provincial people's government shall, according to the national economic and social development plan of their respective administrative areas, organize the compilation of hydrological planning and submit it to the provincial people's government for approval.

Hydrological planning is organized and implemented by the provincial hydrological institutions. Article 7 Hydrological planning shall conform to the comprehensive river basin planning and regional comprehensive planning.

Hydrological planning should include the construction of hydrological and water resources station network, hydrological infrastructure construction, hydrological information construction, hydrological and water resources monitoring and information forecasting, hydrological science and technology development, hydrological team construction and so on. Eighth hydrological and water resources station network construction should follow the principle of reasonable layout, complete functions, effective utilization, taking into account the current and long-term needs.

The hydrological and water resources station network within the administrative area of this province shall be organized and constructed by the provincial hydrological institutions according to the national and provincial hydrological planning. Ninth large reservoirs, hydropower stations and key medium-sized reservoirs, hydropower stations, water conservancy projects and other water engineering units should be supporting the construction of special hydrological stations or hydrological monitoring and hydrological forecasting facilities. Article 10 The establishment of special hydrological stations shall conform to the requirements of hydrological planning and technical specifications. Chapter III Hydrology, Water Resources Monitoring and Data Management Article 11 Whoever engages in hydrology and water resources monitoring, hydrology and water resources information and forecasting, hydrological forecasting system engineering design and implementation, and water resources investigation and evaluation shall obtain a qualification certificate for hydrology and water resources investigation and evaluation in accordance with state regulations. Twelfth hydrological and water resources monitoring activities should be carried out in accordance with national technical standards, and ensure the monitoring quality.

The monitoring points of water level, rainfall and groundwater set by hydrological institutions may be entrusted to other units or individuals for management. The entrusted unit or individual shall perform its duties in accordance with the entrusted matters. Thirteenth personnel engaged in hydrological and water resources monitoring shall be loyal to their duties and perform their duties, and shall not forge hydrological data, and shall not omit, delay or conceal hydrological information. Article 14 The water administrative departments of the people's governments of provinces, cities divided into districts and autonomous prefectures shall organize hydrological institutions at the same level to dynamically monitor and evaluate the water quality of water functional areas. Fifteenth units engaged in hydrological and water resources monitoring shall, in accordance with the national technical standards, sort out the monitored hydrological data and submit them to the provincial hydrological institutions on an annual basis.

Provincial hydrological institutions shall review and compile the hydrological data of the whole province and establish a hydrological database.

Basic hydrological data shall be disclosed in accordance with the relevant provisions of the state. Sixteenth hydrological institutions should strengthen the management of hydrological data. No unit or individual may provide or transfer hydrological data in violation of the provisions of these regulations. Seventeenth the following matters involving hydrological data, hydrological data provided by hydrological institutions shall be used:

(a) all kinds of comprehensive planning, water resources development and utilization planning;

(two) the planning, feasibility study and design of construction projects and their water resources demonstration and flood control evaluation;

(3) investigation and evaluation of water resources and evaluation of water environment;

(four) the establishment, reconstruction and expansion of important water intakes, drainage outlets and sewage outlets;

(5) Important hydrological and water resources forecasting schemes;

(six) other matters stipulated by the state.

The matters specified in the preceding paragraph shall be subject to the examination and approval of the water administrative department of the provincial people's government, and the hydrological data approved by the provincial hydrological institution shall be used; With the approval of the water administrative department of the people's government of a city, autonomous prefecture or county (city, district) divided into districts, the hydrological data approved by the hydrological institution of a city or autonomous prefecture divided into districts shall be used. Eighteenth hydrological institutions shall provide hydrological data for the people's governments at the same level to organize social welfare activities involving public safety.
