Can illegal immigrants legally immigrate to Spain after being sent back to China?
Spanish immigration experts answer: In 2004, the Basque regional parliament appealed to the Constitutional Court against several points in the reform of the foreigners' law la Ley Organica 14/2003 promulgated in June 2003, which was considered unconstitutional.
Nearly a decade later, the Constitutional Court ruled on the appeal. Part of the appeal was accepted. Among them, the Aliens Law stipulates that while expelling foreigners who are prohibited from entering or leaving the country illegally and foreigners who immigrate to Spain illegally, those who are repatriated or deported are prohibited from entering Schengen countries for the next three years. The Constitutional Court held that this clause did not conform to the Spanish constitutional theory and should be abolished. In other words, in the future, all illegal immigrants repatriated by the Spanish government can obtain legal Spanish immigrant visas and re-enter Spain after leaving the country.
