The term "water resources" as mentioned in these Regulations refers to surface water, groundwater and reclaimed water.
"Reclaimed water" as mentioned in these Regulations refers to the water that can be reused in a certain range after the sewage has been treated to a certain water quality standard. Article 3 In the development and utilization of water resources, a water intake permit system and a paid use system shall be implemented according to law. Article 4 The municipal, district and county people's governments shall implement water-saving measures, popularize and apply new water-saving technologies, new processes and new equipment, and promote the construction of a water-saving society. Article 5 The municipal, district and county people's governments shall encourage the conservation and protection of water resources. Units and individuals that have made remarkable achievements in saving and protecting water resources shall be commended and rewarded. Sixth water resources development, utilization, allocation, conservation and protection, the implementation of unified management and hierarchical management system. Article 7 The water administrative department of the municipal, district and county people's governments shall be responsible for the management and supervision of water resources within their respective administrative areas.
The water resources of Taihe Reservoir, Mengshan Reservoir, central city, Dawu water source and water diversion outside the area are managed by the municipal water administrative department in a unified way.
The water resources management institutions affiliated to the municipal, district and county water administrative departments shall be responsible for the daily management of water resources according to their functions. Eighth development and reform, economy and information technology, finance, land and resources, housing and urban and rural construction, environmental protection, planning, agriculture, forestry, health, price and other departments shall, according to their respective responsibilities, do a good job in the protection and management of water resources. Chapter II Planning, Development and Utilization of Water Resources Article 9 The municipal, district and county people's governments shall formulate plans for the protection, development and utilization of water resources and incorporate them into the national economic and social development plans of the governments at the same level. Planning is divided into comprehensive planning and professional planning. Comprehensive planning should be coordinated with overall land use planning, overall urban planning and environmental protection planning. Professional planning should conform to the comprehensive planning. Article 10 A comprehensive scientific investigation, investigation and evaluation shall be conducted when making plans for the protection, development and utilization of water resources. Comprehensive scientific investigation, investigation and evaluation of water resources shall be carried out by the municipal, district and county water administrative departments in conjunction with relevant departments. Article 11 The municipal water administrative department shall, according to the planning of water resources protection, development and utilization, formulate plans and plans for water resources dispatching and allocation, and implement unified dispatching and rational allocation of water diversion, surface water and groundwater outside the region in accordance with the principles of giving priority to water use, rationally utilizing surface water, controlling the exploitation of groundwater, actively utilizing rainwater and flood, promoting the use of reclaimed water, and vigorously saving water.
The water resources dispatching and allocation scheme shall be reported to the Municipal People's Government for approval. Twelfth units and individuals that take water resources within the administrative area of this Municipality shall, in addition to the circumstances stipulated by laws and regulations, apply to the water administrative department according to law.
Non-irrigation water daily takes less than 40 thousand cubic meters of surface water, less than 20 thousand cubic meters of groundwater and irrigation water, which is approved by the municipal water administrative department.
Those who take water outside the scope specified in the preceding paragraph shall be reported to the provincial water administrative department for approval. Thirteenth municipal water administrative department shall decide whether to approve or disapprove within forty-five working days from the date of accepting the application for water intake; In urgent need of water, it shall decide whether to approve or disapprove within twenty working days.
Water intake units or individuals can only build water intake projects after obtaining the approval documents for water intake applications.
After the completion of the water intake project, the water intake unit or individual shall submit an application for acceptance to the municipal water administrative department and submit relevant technical data. After acceptance, a water permit will be issued. Fourteenth new construction, renovation and expansion projects need to apply for water, the water resources of the construction project should be demonstrated. Without water resources demonstration or unqualified demonstration, the water administrative department shall not approve the water permit. Without obtaining the water permit, the development and reform, economic and information departments shall not approve the project, and the environmental protection department shall not approve its environmental impact assessment report.
The construction unit shall entrust a unit with corresponding water resources demonstration qualification to prepare a water resources demonstration report (table). Among them, the construction project with less water intake, the construction unit shall, according to the relevant provisions of the province, prepare the water resources demonstration table of the construction project.
Units undertaking water resources demonstration shall wait for registration at the municipal water administrative department with qualification certificates and personnel qualification certificates. Fifteenth municipal water administrative departments shall implement hierarchical management according to the technical ability and construction ability of sinking construction units or individuals. Sixteenth sinking construction units or individuals shall register with the district and county water administrative departments.
The following materials shall be provided for the record registration:
(1) Business license;
(two) professional and technical personnel qualification certificate;
(3) Relevant certification materials of mechanical equipment;
(4) Other relevant materials that need to be issued.
When a water intake unit or individual needs to drill a well, it shall choose a sinking construction unit or individual that has been registered for the record to carry out the construction.
