Chapter 1 General Provisions Article 1 In accordance with the "Water Law of the People's Republic of China" (hereinafter referred to as the "Water Law") and in combination with the actual conditions of this province, these measures are formulated. Article 2 The term “water resources” as mentioned in these Measures refers to surface water and groundwater.

The "Water Law" and these Measures must be observed when developing, utilizing, protecting, and managing water resources, preventing and controlling water damage, and conducting water-related activities within the administrative region of this province. Article 3 People's governments at all levels (including administrative offices, the same below) shall encourage and support various undertakings that develop and utilize water resources in accordance with the law and prevent and control water hazards, and protect the legitimate rights and interests of entities and individuals that develop and utilize water resources in accordance with the law. Article 4 The development and utilization of water resources and the prevention and control of water hazards shall be comprehensively planned, taken into consideration, ensuring key points, comprehensively utilized, focusing on benefits, and giving full play to the multiple functions of water resources. Article 5 People's governments at all levels shall strengthen the protection of water resources, take effective measures to conserve water sources, prevent soil erosion and water pollution, and improve the ecological environment.

Any unit or individual has the obligation to protect water resources and water projects, and has the right to supervise and report behaviors that damage water projects and pollute water bodies. Article 6 The water conservancy department of the people's government at or above the county level is the water administrative department of the people's government at the same level and is responsible for the unified management of water resources within its own administrative region. Other relevant departments, in collaboration with the water administrative department, are responsible for relevant water resources management work. Chapter 2 Development and Utilization Article 7 The water administrative departments of the people's governments at or above the county level shall, together with relevant departments, conduct comprehensive scientific inspections and surveys and evaluations of water resources as a basis for formulating plans for agriculture, industry, and urban development. Article 8 The development and utilization of water resources and the prevention and control of water hazards must be planned uniformly according to river basins or regions. Planning is divided into comprehensive planning and professional planning.

Comprehensive plans for the basins of important rivers and lakes determined by the province shall be prepared by the provincial water administrative department in conjunction with relevant departments and local people's governments, submitted to the provincial people's government for approval, and reported to the water administrative department of the State Council for record ; Comprehensive plans for other river basins or regions shall be prepared by the water administrative department in conjunction with relevant competent departments according to their management authority, and shall be submitted to the people's government at the same level for approval, and shall be reported to the water administrative department at the next higher level for record.

The approved plan is the basic basis for the development and utilization of water resources and the prevention and control of water damage. Article 9 For the construction of water projects and construction projects that have an impact on water projects or water resources, feasibility plans must be submitted to the water administrative department. After review and approval, they can be submitted for approval according to capital construction procedures. If the interests of other regions and departments are involved, the construction unit must seek their opinions in advance.

According to the approved project construction plan, the design documents and construction plans related to flood control should be prepared and submitted to the water administrative department for review, and their supervision should be accepted during the construction; after the project is completed, it must be reviewed by the water administrative department Participate in the acceptance inspection, and those that do not meet flood control safety requirements will be rebuilt within a time limit. Article 10 If the construction of engineering facilities, channel improvement and other activities cause the deterioration of river conditions and the collapse of river bank embankments, affecting flood control safety, water supply sources, channel water volume, and drainage and irrigation benefits, the construction unit must take remedial measures or provide compensation. Article 11 In the establishment of water conservancy projects, responsibilities and burdens shall be divided into different levels.

Establish rural water conservancy development funds and rural water conservancy labor accumulation systems at the county and township levels in accordance with national regulations. Chapter 3 Protection of Water, Water Areas and Water Projects Article 12 People's governments at or above the county level shall delimit protected areas based on the uses of water bodies and take measures to ensure that water quality meets prescribed standards.

The water administrative departments of the people's governments at or above the county level shall cooperate with the environmental protection departments to supervise and manage water pollution prevention and control, strengthen water quality monitoring, and control the discharge of sewage and pollutants into rivers, lakes and other waters. Article 13 No sewage outlets shall be set up in reservoirs, artificial waterways or channels.

Abandoned wells should be closed in a timely manner, and it is prohibited to discharge harmful substances into abandoned wells to prevent groundwater pollution.

Units or individuals that damage water engineering facilities through sewage discharge shall take timely remedial measures and compensate for the losses.

If a pollutant-discharging unit causes pollution to a water body, it shall be dealt with in accordance with the "Law of the People's Republic of China on the Prevention and Control of Water Pollution". If the polluted water body needs to be flushed, diluted or pumped, the pollutant-discharging unit shall bear the responsibility. Required fees. Article 14 The water administrative department and relevant departments shall strengthen the supervision and management of the development and utilization of groundwater to maintain a balance between extraction and replenishment. In areas that have been over-exploited, mining should be strictly controlled.

Units that exploit groundwater should conduct regular monitoring of groundwater, grasp the changing trends of water level, water quantity, and water quality, establish technical files, and provide information to the water administrative department and relevant departments in a timely manner.

If the exploitation of groundwater results in a drop in groundwater level, depletion or ground subsidence, causing losses to other units or individuals, remedial measures must be taken to compensate for the losses.

Article 15 The management and protection scope of river courses and state-owned water projects shall be proposed by the water administrative department of the people's government at or above the county level in accordance with the following standards and submitted to the people's government at the same level for delineation:

(1) There are The river management scope of embankments includes the waters, sandbanks, beachlands (including arable land), flood conduction areas, embankments and their berms, reinforced embankment filling areas, soil pile areas, etc. between the dry embankments on both sides. (3) Management of water projects such as reservoir dams, spillways, hydropower stations, sluices, ship locks, and electromechanical drainage and irrigation stations The scope is 30 meters to 500 meters outward from the project edge line. The scope of management and protection of collectively owned water projects shall be delimited by the local people's government with reference to the provisions of the preceding paragraph and actual needs.
