Compensation standard for land occupation of water conservancy projects in 2020

1. Compensation mode The principle of combining paid collection with equivalent substitution shall be implemented for reservoir collection. No unit or individual may requisition the reservoir without compensation. If all or part of water conservancy projects and their facilities are requisitioned for construction, corresponding remedial measures should be taken: if a replacement reservoir can be built and the original benefits of the reservoir can be guaranteed, or if the original functions need to be restored in different places, the requisitioner is responsible for building a replacement reservoir with the same benefits as the original reservoir or making compensation according to the replacement price of the reservoir; If it is impossible to build an alternative reservoir, or if it does not need to be built in a different place, the requisitioner shall make compensation according to the replacement price of the restored reservoir; The land compensation fee in the reservoir replacement price compensation fee shall be implemented in accordance with the Detailed Rules for the Implementation of Land Acquisition Compensation and Resettlement in Shapingba District of Chongqing (Sha Fu Fa [2013] No.98). If the compensation standard for land acquisition is adjusted, it shall be implemented according to the adjusted standard. The specific compensation amount of the expropriated reservoir shall be calculated and put forward by the management unit of the expropriated reservoir, evaluated by the water conservancy and hydropower survey and design unit above Grade C, and approved by the District Agriculture Committee. Units and individuals who requisition reservoirs shall be responsible for the construction of reserve reservoirs themselves, and shall start the construction of reserve reservoirs at the same time as the development and construction projects start. Development and construction projects can be completed and put into use only after they have passed the acceptance by the water administrative department. The compensation fee for requisition of reservoir shall be a unified receipt for non-operating settlement in Chongqing under the unified supervision of the Municipal Finance Bureau.

2. The compensation fees collected shall be dealt with separately according to the following provisions: if an alternative reservoir can be built, the compensation fees shall be used by the water conservancy department for the construction of the alternative reservoir; If the construction of a reservoir in a different place can continue to benefit the original reservoir, the compensation fee shall be used by the water conservancy department for the construction of the reservoir; If it is impossible to build an alternative reservoir or build a reservoir, the funds invested by the original beneficiary units (referring to individuals, organs, villages, streets (towns), districts, cities, countries and other organizations) (including investment and labor services) will be returned from the compensation fees collected. The District Agriculture Committee and the District Finance Bureau are responsible for the supervision and inspection of the collection, use and management of compensation fees.

Article 22 Land compensation fees and resettlement subsidies for land requisitioned by large and medium-sized water conservancy and hydropower projects shall be the same as those for infrastructure projects such as railways, and shall be implemented in accordance with the standards stipulated by the provinces, autonomous regions and municipalities directly under the Central Government where the requisitioned land is located. The compensation standards for scattered trees and young crops on the expropriated land shall be implemented in accordance with the standards stipulated by the provinces, autonomous regions and municipalities directly under the Central Government where the expropriated land is located. The attachments on the expropriated land shall be compensated according to their original scale, original standards or the principle of restoring their original functions; Appropriate subsidies should be given to poor immigrants whose compensation expenses are not enough to build basic housing. Other units or individuals who use state-owned cultivated land according to law shall be compensated according to the compensation standard for expropriation of cultivated land; Units or individuals that use unused state-owned land with undetermined purposes shall not be compensated. After the immigrants move away, the scattered trees and houses owned by the immigrants above the submerged line around the reservoir shall be compensated according to the standards stipulated in the second and third paragraphs of this article respectively.
