What do three non-personnel mean?

The "three non-personnel" refer to those who "enter the country illegally, reside illegally and work illegally".

1. Illegal entry

Illegal entry refers to the illegal behavior that foreigners enter our country without holding a valid entry visa or legal and valid entry certificate issued by the competent authorities of China, or without entering our country from a port that is open to the outside world or designated by our country, or without inspection by the frontier inspection station.

2. illegal residence

illegal residence refers to the illegal behavior of foreigners who live (stop) in China and fail to apply for a visa or residence permit within the valid stay period stipulated in the visa or residence permit.

Specifically speaking, when entering the country, the white card issued by the Immigration Bureau, even if it is a multiple-entry visa, is considered illegal residence. You can't get a visa to a third country after staying illegally. But if you work illegally in the United States, and then the I-94 form expires, it is not overstaying. However, if you are found to be working illegally by the Immigration Bureau, you will be living illegally from the day you are caught.

3. Illegal employment

Illegal work refers to the act of engaging in social labor without obtaining legal employment status in China and obtaining labor remuneration.

The meaning of employment is the activities that people in a certain age are engaged in to obtain remuneration or business income. If we make further analysis, we need to define employment from three aspects: employment conditions refer to a certain age; Income conditions refer to obtaining certain labor remuneration or operating income; Time conditions, that is, the length of working hours per week.

according to the detailed rules for the implementation of the law of the people's Republic of China on the entry and exit of foreigners, foreigners who illegally enter or leave China can be fined between 1 yuan and 1, yuan, detained for more than 3 days and less than 1 days, and can also leave the country within a time limit or be deported.

Legal basis:

Law of the People's Republic of China on Exit and Entry Administration:

Article 59 _ Persons suspected of violating exit and entry administration may be questioned on the spot; After cross-examination on the spot, under any of the following circumstances, cross-examination can be continued according to law:

On-the-spot questioning and continuing questioning shall be conducted according to the procedures stipulated in the Law of the People's Republic of China on People's Police. If the public security organ of the local people's government at or above the county level or the entry-exit frontier inspection organ needs to summon the personnel suspected of violating the exit-entry administration, it shall be implemented in accordance with the relevant provisions of the Law of the People's Republic of China on Public Security Administration Punishment.

article 6 _ if a foreigner falls under any of the circumstances specified in the first paragraph of article 59 of this law, he can't rule out his suspicion after being questioned on the spot or continuing to be questioned, and needs further investigation, he may be detained for examination. To carry out detention review, a decision on detention review shall be presented and an inquiry shall be made within twenty-four hours. If it is found that the detention review should not be carried out, the detention review should be lifted immediately. The detention review period shall not exceed thirty days; If the case is complicated, it may be extended to 6 days with the approval of the public security organ of the local people's government at the next higher level or the entry-exit frontier inspection organ. For foreigners with unknown nationality and identity, the detention review period shall be counted from the day when their nationality and identity are ascertained.
