Article 3 The people's governments at or above the county level shall incorporate the prevention and control of desertification into the national economic and social development plan, formulate medium-and long-term plans and annual plans, implement the target responsibility assessment and reward system for the administrative leadership of the government to prevent and control desertification, and report the prevention and control of desertification to the people's congress at the same level and its standing committee every year. Article 4 The provincial forestry administrative department shall be responsible for sand prevention and control in the whole province under the leadership of the provincial people's government, and its subordinate sand prevention and control management institutions shall be responsible for the specific implementation of these measures.

City (state) and county (city, district) people's governments and their forestry administrative departments are responsible for the work of sand prevention and control within their respective administrative areas.

The competent meteorological departments of agriculture, animal husbandry, water conservancy, land resources and environmental protection of the people's governments at or above the county level shall, in accordance with their respective functions and duties, cooperate closely and do a good job in preventing and controlling desertification. Article 5 The work of preventing and controlling desertification should be planned in a unified way and implemented step by step, with prevention first and combining prevention with control, and whoever develops, protects, governs and benefits.

People's governments at all levels shall organize and mobilize all social forces, carry out national sand control activities as planned, and gradually improve the ecological environment in sand areas. Article 6 People's governments at all levels shall commend and reward units and individuals that have made remarkable achievements in the prevention and control of desertification and its scientific research and technology popularization; Those who have made outstanding contributions will be rewarded handsomely. Article 7 The provincial forestry administrative department shall, according to the national sand prevention and control plan, combined with the actual situation of this province, work out the sand prevention and control plan jointly with the relevant departments, and report it to the relevant departments designated by the State Council or the State Council for approval and implementation after being audited by the provincial people's government.

The forestry administrative department at or above the county level shall, according to the plan for preventing and controlling desertification at the next higher level and in combination with local conditions, formulate the plan for preventing and controlling desertification in this administrative region, which shall be audited by the people's government at the same level and submitted to the people's government at the next higher level for approval before implementation.

Without the approval of the original approving authority, no unit or individual may change the planning of sand prevention and control. Article 8 People's governments at or above the county level shall establish nature reserves and strengthen protection and management in areas where typical natural landscapes, sandy vegetation and rare and endangered wild animals are concentrated or have special protection value on desertified land. Article 9 Desertification land is divided into closed protected areas, prevention protected areas and control and utilization areas. Closed protected areas refer to the native deserts of Tengger, Badain Jaran and Kumtag in this province; Prevention and protection areas refer to Gobi, wind erosion, fixed sandy land and fixed sand dunes; The control and utilization areas refer to the wind-blown sand mouth, mobile sand, sand dunes, semi-fixed sand dunes, sandy land and land with obvious desertification trend. Tenth in the closed protected areas, all activities that destroy vegetation are strictly prohibited.

In the closed protected areas, it is really necessary to carry out key projects such as railways and highways, which shall be audited by the provincial people's government and reported to the department designated by the State Council or the State Council for approval. Eleventh in the prevention and protection areas, it is forbidden to cut down, dig vegetation and grazing, reclamation, mining, dredging, shoveling mirabilite, burning Peng Hui and other activities that destroy vegetation.

In the prevention and protection zones, it is forbidden to resettle immigrants.

Those who engage in development and construction activities in the sand prevention reserve shall submit an ecological environment impact report with the content of sand prevention and control, which shall be audited by the forestry administrative department at or above the county level and submitted for approval in accordance with the relevant provisions of the state. Development and construction projects should be planned to prevent and control desertification, and the control funds should be included in the project budget, which should be implemented simultaneously with the main project, and the forestry administrative departments at or above the county level should be responsible for the acceptance. Twelfth in the utilization area, it is forbidden to cut down and dig shrubs, herbs and other sand-fixing plants.

The local people's government in the control and utilization area shall organize relevant departments, units and individuals to take artificial, aerial seeding, sand sealing (beach) and other measures to plant trees and grass, and focus on controlling and increasing vegetation; It is also possible to transfer the management right of desertified land to citizens, legal persons and other organizations at home and abroad for management. Thirteenth towns, villages, factories and mines, military camps, national defense industrial bases, agriculture, animal husbandry and fishery management areas, railways, highways, reservoirs around the desertification land, the implementation of the responsibility system for unit governance, respectively, by the responsible units responsible for governance, governance in accordance with the letters of responsibility issued by the people's governments at or above the county level. Fourteenth people's governments at all levels encourage units and individuals to carry out public welfare sand prevention and control activities in various forms such as donation, labor service, equity participation and cooperation; Forestry administrative departments at all levels shall provide management sites, tree seedlings and technical guidance; The relevant departments and units shall reduce or exempt the related expenses.

Units and individuals engaged in profit-making sand control shall conduct control in accordance with the technical requirements of the forestry administrative departments at or above the county level or the relevant competent departments. Fifteenth units and individuals engaged in profit-making sand control shall obtain the right to use the desertified land according to law, and sign a control agreement to control it according to the control plan.

After the completion of the control task, the competent forestry administrative department at or above the county level shall organize the acceptance, and the people's government at or above the county level shall issue a certificate of desertification land control; Unqualified acceptance should continue to be handled.

Those who have obtained the certificate of desertification land management can independently operate, develop, utilize, inherit, transfer and mortgage according to law, and no unit or individual may infringe upon their legitimate rights and interests.
