Relocation Policy of Rural Migrants in 2022

In 2022, the policies for the relocation of rural migrants are as follows:

1. Compensation standards for expropriation of agricultural land, ground attachments and land other than young crops shall be formulated by provinces, autonomous regions and municipalities directly under the Central Government;

2. For rural villagers' houses, according to the principle of compensation before relocation and improvement of living conditions, we should respect the wishes of rural villagers, give fair and reasonable compensation by rearranging the homestead, providing resettlement houses or monetary compensation, compensate the relocation and temporary resettlement expenses caused by expropriation, and protect the living rights and legitimate housing property rights of rural villagers;

3. Collective houses in villages in cities shall be assessed and compensated in accordance with the Regulations on the Expropriation and Compensation of Houses on State-owned Land and the market price of similar real estate around the demolished houses during the demolition. If it is a house on rural collective land, it will be compensated according to the relevant spirit of the Regulations on Expropriation and Compensation of Houses on State-owned Land, the market price of surrounding houses and the living conditions of the expropriated people. Urban village residents who meet the housing security conditions shall be given priority in obtaining housing security.

Legal basis: Article 47 of the Land Administration Law of the People's Republic of China.

The compensation for land expropriation is stipulated. If land is expropriated, compensation shall be given according to the original use of the expropriated land. Cultivated land compensation fee includes four contents:

(1) Land compensation fee. The standard is 6 to 10 times of the average annual output value in the three years before the cultivated land is requisitioned;

(2) Resettlement compensation fee. The resettlement subsidy standard for each agricultural population in need of resettlement is 4 to 6 times of the average annual output value of cultivated land occupied by the land acquisition unit in the three years before expropriation;

(3) Compensation fees for ground attachments and young crops. The compensation fee for ground attachments and young crops is the compensation fee for artificially formed houses, structures, trees and young crops on the expropriated land;

(four) the special provisions on the requisition of vegetable fields, that is, in addition to paying the above fees, the land-using units must also pay the new vegetable field development and construction fund. If the land compensation fees and resettlement compensation fees paid in accordance with the above provisions are insufficient to maintain the original living standards of landless farmers, the resettlement subsidies may be increased with the approval of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government. However, the sum of land compensation fees and resettlement subsidies shall not exceed 30 times of the average annual output value of the land in the three years before expropriation;

(5) Where the expropriation of land involves homestead or rural construction land, the standards of land compensation fees and housing subsidies shall be determined by provinces, autonomous regions and municipalities directly under the Central Government, and compensation shall be made according to the market value in principle.
