Students' residence is usually valid for one year, and they can apply for an extension of one year after each expiration. When applying for and extending students' residence, you need to provide school certificates, proof of funds, proof of insurance purchase, etc. Students are not allowed to work formally in residence, but those who meet the requirements and have no conflict with their studies can apply for a work permit.

Work residence

Work residence is a kind of residence that allows foreigners to legally live and work in Spain, and they can pay social insurance and enjoy the benefits in Spain. There are two forms of work, one is permiso de trabajo por cuenta ajena. When applying, you need to provide the work contract and the employer's company materials. Another name is Permiso de Trabajo Por Cuenta Propia, that is, investing, opening a shop or company in Spain and others apply for residence. When applying, they need proof of deposit, business license of company or shop, etc.

The validity period of work residence is 1 year for the first time, 2 years for the second time, 2 years for the third time and 5 years for the fourth time, commonly known as long-term residence. At this time, it is no longer subdivided into work or boss's residence, and there are no restrictions on working or being a boss.

family house

Family residence is a kind of residence enjoyed by the applicant's family living in Spain. When an applicant applies for family reunion residence for his immediate family members in China, the Immigration Bureau will assess whether the applicant's financial strength can afford the life of his family members, and the applicant needs to submit proof of family relationship, economic proof, housing conditions, etc. The applied family members only have the right of residence and cannot work. The expiration time of residence is usually the same as that of the dependent. However, after meeting the conditions for applying for work residence, you can also apply to change your family residence into an independent ordinary work residence and obtain the right to work residence.

Take root and live

Rooted residence is a channel provided by the Spanish government to legalize the status of illegal immigrants. That is to say, this residence is granted to people who have no legal status in Spain but have lived for three years and have not left for a long time, and have been quite integrated into Spanish society. Rooting itself is divided into work roots, boss roots and family roots. The application materials include proof of residence time, integration report, and other specific materials needed by various rooted places of residence (for example, work roots need work contracts, family roots need proof of immediate family members, etc.). ). Rooted residence needs to be changed every year, but after obtaining rooted residence, it can also be changed to ordinary work residence as needed.

Work supplies

Work permit for law students: work permit for foreign students.

The Spanish government allows international students to work and study after school, but they need to apply for a legal work permit. Working hours shall not conflict with class hours and shall not exceed 77% of normal work (about 30 hours/week). According to Spanish labor law, they must sign a work contract with their employers. Employers are obliged to apply for social welfare insurance for migrant students, and pay 94% of the insurance premium, and the other 6% will be deducted from their wages.

Documents required for Spanish students to apply for a work permit:

The application for student work permit must be submitted by the boss or the company for the first time, and the required documents are:

Company:

Work contract: the daily, weekly, monthly and annual working hours must be indicated, and if it is full-time, it shall not exceed 3 months;

The company's registration documents with the Social Insurance Bureau;

The company registration code of DNI or the board of directors. If the company has a legal representative, there must be a document authorizing the shareholders and bosses of the company to exercise the rights of the legal representative;

Student:

Application form;

A valid passport;

Effective student accommodation;

Documents issued by the school to prove that work does not interfere with study time;

Spanish diploma or certification diploma;

This work permit follows the valid period of the student's residence, and the residence permit will automatically stop when it expires. Students can apply for the renewal of work permit by themselves, and the required documents are similar to those mentioned above. If it is the same company, just provide the employer's residence and work contract.

Student internship permit

Holders of student residence permits are not allowed to take part in gainful employment, unless the work the student is engaged in does not conflict with his study, and the income from the work is not enough to pay for his living expenses in studying in the West, and an internship permit agreement must be signed with schools and internship enterprises before starting work.

Students can work after obtaining the internship permit. This kind of work contract is generally part-time and the hours are limited. If there is a full-time work contract, the working hours cannot conflict with the students' study time, that is, they can only use the holidays to do full-time, and the specific internship time depends on the regulations of the school. Moreover, the validity period of the work permit granted can only be the same as the student residence period of the student at most, and shall not exceed the validity period of the student ID card. Therefore, the work permit must be updated at the same time as the student residence is updated.

Students who have not lived for three years can apply for a work permit. The work permit is a piece of paper, and the validity period is the same as the student's place of residence. There is no need to apply for returning to China or make an appointment for a work permit. After preparing the materials, the boss will personally hand in the documents, which will be valid for at least three months. The longer the validity period, the better. It will be approved about one month after submission. After receiving the approval letter, you can get insurance, but you can only get half insurance, because theoretically this student can only work after school. However, it must be noted that students must change their residence within 60 days before the expiration, and apply for a work permit again after obtaining approval, because the work permit will naturally expire when the student residence expires.

You can apply for work residence directly after three years, and you will get a work residence card later. When applying for work residence, you need to stay for three years, and you need to make an appointment three months before the student's residence expires. It will be approved in about three months from the date of delivery. Even if you change your work residence, you must change your student residence before the expiration of your work residence, so that if your work residence is rejected, you will not become a black household.

Students apply for a replacement card 60 days before the expiration of their residence, and now they need to make an appointment. Please pay attention to the appointment time given at that time 4 months before the expiration.

If the student's residence has not expired and the work residence has been approved, he can get the work residence card directly. After having a work residence status, students may not change it after the expiration of their residence period. Because work and residence can be both work and study, there is no need for students to stay.

Continuing student residence does not affect the change of work residence. On the contrary, please be sure to extend the student residence until the work residence is approved.
