The foreign student was reported to the police by his proprietor when he was asking for a salary, saying that he had mental problems and was prone to violence.

China Overseas Chinese Mutual Aid Association and local immigration lawyers have pointed out that foreign students should avoid becoming any form of "black workers" to ensure their legal study and work status, otherwise they may be repatriated by the Immigration Bureau.

Sasa (pseudonym), an overseas student, came to Vancouver last September and met the woman owner of a restaurant in Vancouver in May 438+10. Because Sasa is close to her original residence in China, they get along well as fellow villagers. The shopkeeper claimed to have emigrated for many years, hoping to provide experience and help for studying in Sasa.

Sasa recalled that the shopkeeper was eloquent and was very kind to her at first. He repeatedly asked her to treat her as a close friend, even a relative, and invited Sasa to work in her shop on the grounds that "fellow villagers should take care of each other". Although Sasa took the initiative to worry that he could not work legally without a work permit, the proprietor said: "The family can't manage that much, and it doesn't matter if you don't have a work permit." And pay 8.5 yuan every hour.

Sasa pointed out that she is actually not short of money, and her parents can support her study and life abroad. But because she trusted the proprietor and wanted to exercise her ability, she finally accepted the invitation and started working in June+10 this year.

However, to Sasa's surprise, the proprietor first asked the newcomers to receive two days' unpaid "training", but after the "training", the proprietor began to complain that Sasa's working ability was not strong. After working for 1 month, Sasa gave up his job in the store, and the shopkeeper began to pay in arrears for various reasons.

In desperation, Sasa went to the store one night in April to give a theory, and kindly sent his sketches to the proprietor, hoping to solve the problem calmly, but the proprietor suddenly changed his previous moderate attitude, not only tore up Sasa's paintings, but also used his hometown words to say all kinds of things that hurt Sasa's self-esteem and refused to pay again.

Stimulated by the shopkeeper's constant words, Sasa said that he became very excited, claiming that he accidentally knocked down the cash register of the store, so the shopkeeper called the police and reported to the police that Sasa was mentally ill. Because Sasa's English ability is limited, the police handcuffed her and took her outside the mall. What Sasa heard was that, at the strong request of the operator, the police verbally warned Sasa not to enter the mall for one year, let alone go near the operator and her store.

Afterwards, Sasa felt that his personality was greatly insulted, and his mental state of insomnia and depression gradually emerged. What is most difficult for her to understand is why the operator suddenly changed from "feeling like family" to "hating her guts" and provided untrue data to the police, such as "I never knew Sasa" and "Sasa was mentally ill".

Sasa said that she had consulted a local professional organization about the complaint procedure, and she was advised to complain to the Small Claims Court and the Employment Standards Division of the British Columbia Department of Labor. Sasa also called on other international students to pay special attention to protect themselves, and not to accept any opportunity to work as a "black worker" without a work visa.

Ming Pao also called 12 to ask the restaurant owner about the situation. She insists that the restaurant absolutely does not employ illegal workers, and all workers have work permits.

Wang Renduo, an immigration lawyer who advised to be carefully repatriated, pointed out that international students did not hold a legal work visa and had labor disputes with their employers when working as "illegal workers". Once the incident broke out, the immigration bureau knew that their student visas would be cancelled at any time because of illegal work, and may even be repatriated.

Wang Renduo said that this kind of labor dispute is usually reasonable, and the wife said that her wife is right. Immigration officers will not have much patience to listen to how international students are exploited by their employers, but will only pay attention to whether international students have violated visa regulations to speed things up. Wang Renduo pointed out that generally speaking, if the behavior of illegal workers is "your love and my wish" between international students and employers, it is difficult for international students to explain under what circumstances they were forced or exploited.

However, Wang Renduo also said that it is not completely impossible for international students to explain to immigration officials that they are working for their employers involuntarily, but whether immigration officials listen or not is another matter. Therefore, Wang Renduo called on international students to apply for a work visa before working, so that they can work within the legal scope and get better protection.

He called on international students to pay special attention to protecting their rights and interests, consider the consequences before taking action, and seek information and help from relevant departments of the school in time.

Wu pointed out that international students are relatively isolated and vulnerable groups. They usually don't know enough about the local situation or lack access to information, so they should pay special attention to be vigilant and protect themselves.

Wu mentioned that schools have the responsibility to provide students with study and life guidance. Foreign students should not only listen to anecdotal reports, but should fully understand the information, taking into account the safety, consequences and how to seek assistance once it happens.
