Measures for the Administration of Groundwater Resources in Shiyang River Basin of Gansu Province

Chapter I General Provisions Article 1 In order to strengthen the management of groundwater resources in Shiyang River Basin, protect the ecological environment, scientifically utilize and effectively protect groundwater resources, and consolidate the achievements of basin management, these measures are formulated in accordance with the Water Law of People's Republic of China (PRC), the Regulations on the Administration of Water Permit and Water Resources Fee Collection, the Regulations on the Administration of Water Resources in Shiyang River Basin of Gansu Province and other laws and regulations, and in combination with the actual situation of the basin. Article 2 These Measures shall apply to the development, utilization, conservation and protection of groundwater resources in Shiyang River Basin. Article 3 The management of groundwater resources in river basins shall adhere to the principles of giving priority to protection, rational development, scientific allocation and balance between exploitation and compensation, reduce agricultural water consumption, save domestic water consumption, increase ecological water consumption, ensure industrial water consumption, and promote the construction of ecological security barriers in inland rivers. Relevant planning within the basin should be adapted to the carrying capacity of groundwater resources, strictly control the development and utilization of groundwater, and prohibit illegal access to groundwater. Article 6 People's governments at all levels in the basin shall actively take effective measures to save and protect groundwater resources and prevent groundwater pollution. Seventh projects involving the use of groundwater, without obtaining the approval of water permit, the competent department of the project shall not be approved or approved. Article 8 All units and individuals in the basin have the obligation to protect groundwater resources and have the right to supervise and report illegal exploitation and destruction of groundwater resources.

When river basin management agencies and water administrative departments of cities and counties (districts) investigate and deal with illegal acts according to law, relevant departments shall cooperate. Chapter II Development and Utilization Article 9 The development and utilization of groundwater in the basin shall strictly implement the key control plan of Shiyang River Basin, gradually reduce the amount of groundwater exploitation, and encourage surface water to replace part of groundwater recharge.

The development and utilization of groundwater resources in the basin provide support for the construction of economic society and ecological civilization. Article 10 People's governments at all levels in the river basin shall, when building new construction projects and relocating and resettling immigrants, make rational distribution in areas with existing supply conditions of surface water or groundwater through scientific argumentation. Under special circumstances, the adjustment of the total amount of water must be approved by the river basin management agencies and organized to demonstrate, and after being audited by the provincial administrative department, it shall be submitted to the provincial people's government for approval. Twelfth river basin management agencies should guide the people's governments of cities and counties (districts) in the river basin to scientifically formulate water quotas, reasonably determine the proportion of water used in the industry, improve the water rights transfer system, and accelerate the construction of water rights market. Encourage the use of advanced water-saving technologies and water rights replacement to solve water conflicts. Article 13 River basin management institutions shall carry out investigation and evaluation of groundwater resources and division of functional zones, delimit prohibited and restricted groundwater exploitation zones after scientific argumentation, and publish them after being submitted to the provincial people's government for approval.

In the forbidden area of groundwater exploitation, it is forbidden to build new wells and strictly control old wells, except for the upgrading of wells for drinking water for people and livestock and ecological water. Article 14 The term "old well renewal" as mentioned in these Measures refers to the newly-built pumping well within a radius of 60 meters from the original well location, due to the drying up of the intake well or the small water volume and the collapse of the shaft wall.

The old well should be backfilled in advance when the sinking operation is renewed. Drinking wells for people and livestock cannot be backfilled in advance because of too little water, which shall be approved by the river basin management agency. However, after the operation of the updated well, the old well should be backfilled. Fifteenth river basin management agencies should strengthen the monitoring of groundwater, and the completion of the annual exploitation and reduction of groundwater in cities and counties (districts) should be confirmed by the provincial water administrative department. Article 16 Intelligent metering facilities shall be installed for groundwater intake in the basin, and the normal operation of metering facilities shall be ensured. Seventeenth prohibit the addition of groundwater in the basin for thermal power generation, landscape engineering and other high water consumption industries. It is forbidden to use groundwater for water source heat pumps or cooling projects. Chapter III Permit for Water Intake Article 18 Anyone who wants to take groundwater in Shiyang River Basin shall apply for a permit for water intake.

Units or individuals applying for new wells shall apply to the local county (district) water administrative department for water intake permit, which shall be submitted to the river basin management agency for examination and approval after being audited by the municipal water administrative department. To apply for the renewal of old wells, the county (district) water administrative department may directly report to the river basin management agency for examination and approval, and report to the municipal water administrative department for the record. Article 19 Groundwater in river basins is restricted by regions. For counties (districts) whose total water intake is close to the total control index, the approval of new water intake in this area shall be restricted; If the total water intake reaches or exceeds the total water consumption, no new water intake is allowed. Twentieth the implementation of groundwater level control and management. In a county (district) as a unit, if the groundwater level in a certain area has dropped by more than 1 m annually and continuously for more than 3 years, the new water intake in this area will be suspended, and the renewal of old wells will be strictly controlled.
