Notice of the Ministry of Civil Affairs on Issuing Several Provisions on Marriage Registration between Overseas Chinese and Domestic Citizens, Hong Kong and Macao Compatriots and Mainland Citizens

Civil Affairs Departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government:
Several Provisions on Marriage Registration between Overseas Chinese and Domestic Citizens, Compatriots from Hong Kong and Macao and Mainland Citizens have been approved by the Ministry of Foreign Affairs, the Ministry of Public Security, the Ministry of Justice and the Overseas Chinese Affairs Office of the State Council, and are hereby promulgated for implementation. Where local regulations are in conflict with these Provisions, these Provisions shall prevail.
Attachment: Several Provisions on Marriage Registration between Overseas Chinese and Domestic Citizens, and between Hong Kong and Macao Compatriots and Mainland Citizens.
In order to facilitate the marriage registration between overseas Chinese and domestic citizens, compatriots from Hong Kong and Macao and mainland citizens, the following provisions are made in accordance with the Marriage Law of the People's Republic of China and the Measures for Marriage Registration:
A, overseas Chinese and domestic citizens, Hong Kong and Macao compatriots and mainland citizens get married, and both parties voluntarily divorce and remarry. Where it is required to be handled in China (Mainland), both men and women must apply for registration with the marriage registration authority of the people's government at or above the county level where one of the domestic (Mainland) parties is located.
Two, both men and women to apply for marriage registration, shall hold the following documents:
I. Domestic citizens
(a) the household registration certificate issued by the local police station;
(two) the certificate of my date of birth, nationality, occupation and marital status issued by the work unit or the people's government of a city or town street office or a rural township (town).
B. Overseas Chinese
(a) Passport issued by my embassy or consulate in that country;
(2) A certificate issued by the notary office of the country of residence and certified by our embassy or consulate in that country that I have no spouse, or a certificate issued by our embassy or consulate in that country that I have no spouse.
C, Hong Kong and Macao compatriots
(1) Hong Kong and Macao resident identity cards, Hong Kong and Macao compatriots' home visit certificates or seamen's certificates;
(2) A certificate of marital status issued by the Hong Kong Marriage Registry and certified by a Hong Kong lawyer entrusted by the judicial administrative organ, and a statement that the applicant has never registered marriage elsewhere.
(3) A certificate of marital status issued by the Macao Administrative Bureau or the police station;
The staff of our institutions in Hong Kong and Macao and the members of Hong Kong and Kowloon Federation of Trade Unions, Hong Kong Chinese General Chamber of Commerce, Hong Kong Federation of Educators, Macao Federation of Trade Unions, Macao Chinese Education Association and Macao Chinese General Chamber of Commerce may be exempted from the certificates specified in items (2) and (3) upon the proof of marital status issued by their institutions or associations.
In addition, when overseas Chinese and compatriots from Hong Kong and Macao apply for marriage registration, they must also hold a certificate of employment in foreign countries and Hong Kong and Macao or a reliable proof of economic source; Pre-marital health examination certificate issued by the hospital at or above the county level designated by the marriage registration authority. Hong Kong and Macao compatriots who have not registered for marriage in their place of origin must also hold a certificate of marital status issued by the people's government of a township (town) in their place of origin (or their original place of residence or work unit), the subdistrict office of the city or town where they are located, or a letter of guarantee issued by two mainland relatives and friends who know the situation.
If the party applying for marriage registration divorces, it must also hold a divorce certificate; Widowed, must hold a spouse's death certificate; If you have lived together, you must have an agreement to leave the cohabitation relationship.
Third, for overseas Chinese from countries (regions) that have no diplomatic relations with China to apply for marriage registration with domestic citizens, they must hold a certificate of no spouse notarized by the notary office of the country (region) where the overseas Chinese are located and certified by the embassy or consulate of a third country that has diplomatic relations with China and the country where the overseas Chinese are located; If it is clearly difficult to obtain the above-mentioned certificate, according to the proof of marital status issued by the people's government of the township (town) of origin and the sub-district office, the letter of guarantee of no spouse issued by two relatives and friends who know the situation in China, and the written statement of no spouse issued by myself, after being audited by the civil affairs department at or above the county level in conjunction with the overseas Chinese affairs department, marriage registration can be handled.
4. If both men and women divorce voluntarily and have properly handled the child support and property, they must apply to the marriage registration authority for divorce registration. If one party requests a divorce or one party cannot apply for a divorce at the marriage registration office, the relevant departments can mediate or directly file a divorce lawsuit with the people's court where the domestic (mainland) party's household registration is located. Five, after the divorce, both men and women voluntarily restore the relationship between husband and wife, apply for marriage registration according to law. Both men and women hold the certificate that they have not remarried after divorce, and apply to the marriage registration authority for remarriage registration and return the divorce certificate.
Six, both men and women apply for marriage registration, the marriage registration authority to understand the situation, must truthfully provide. Those who deliberately conceal facts or forge documents shall not be registered by the marriage registration authority, and if the circumstances are serious, they shall be submitted to the local judicial organs for handling according to law.
Seven, overseas Chinese and domestic citizens, Hong Kong and Macao compatriots and mainland citizens to apply for marriage registration and get a marriage certificate, must be affixed with photos of both sides. Marriage certificate and divorce certificate shall be stamped with the special seal for marriage registration of the people's government at or above the county level. The marriage registration authority shall collect marriage certificate fees and registration fees when handling marriage registration. I shall bear the translation expenses.
