What are the procedures or visas for foreigners to settle permanently in China?

Article 1 In order to regulate the administration of examination and approval of foreigners' permanent residence in China, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Administration of Entry and Exit of Foreigners and its implementing rules.
Article 2 The permanent residence of foreigners in China means that the duration of foreigners' residence in China is unlimited.
Article 3 The Alien's Permanent Residence Permit is a legal identity document for foreigners who have obtained the permanent residence qualification in China to stay in China, and can be used independently.
Article 4 Foreigners who have obtained the qualification of permanent residence in China shall enter and leave China with valid passports and permanent residence permits for foreigners.
Article 5 The organs that accept foreigners' applications for permanent residence in China are the public security organs of the municipal people's government divided into districts and the public security sub-bureaus and county bureaus of municipalities directly under the Central Government. The organs that examine foreigners' applications for permanent residence in China are the public security departments and bureaus of all provinces, autonomous regions and municipalities directly under the Central Government; The authority that examines and approves foreigners' applications for permanent residence in China is the Ministry of Public Security.
Article 6 Foreigners applying for permanent residence in China shall abide by the laws of China, be in good health and have no criminal record, and meet one of the following conditions:
(a) direct investment in China, investment stability for three consecutive years, good tax record;
(2) Having served as deputy general manager or deputy factory director or above in China, or having served as an associate professor or associate researcher or above and enjoying the same treatment, having served continuously for four years, having resided in China for not less than three years in four years, and having a good tax record;
(3) Having made significant and outstanding contributions to the special needs of China and the country;
(4) Spouses of persons referred to in items 1, 2 and 3 of this paragraph and their unmarried children under 18;
(5) The spouse of a China citizen or a foreigner who has obtained the permanent residence qualification in China, whose marriage relationship has lasted for five years, has lived in China for five years continuously, has lived in China for not less than nine months every year, and has a stable living guarantee and residence;
(6) Unmarried children under the age of 18 who take refuge in their parents;
(seven) no immediate family members abroad, take refuge in the immediate family members in China, and have reached the age of 60, and have lived in China for five consecutive years, and have lived in China for not less than nine months every year, and have a stable living guarantee and residence.
The term "fixed number of years" as mentioned in this article refers to the continuous term before the date of application.
Article 7 The registered capital actually paid by foreigners investing in China mentioned in Item (1) of Paragraph 1 of Article 6 of these Measures shall meet one of the following conditions:
(1) The total investment in encouraged industries listed in the catalogue of foreign-invested industries published by the state is more than 500,000 US dollars;
(two) the total investment in the western region of China and the key counties of national poverty alleviation and development work is more than 500 thousand US dollars;
(3) The total investment in Central China is more than US$ 6,543,800+0,000;
(4) The total investment in China is more than 2 million US dollars.
Article 8 The term "foreigner" as mentioned in Item 2 of Paragraph 1 of Article 6 of these Measures shall meet one of the following conditions:
(a) institutions affiliated to various departments or provincial people's governments in the State Council;
(2) Key institutions of higher learning;
(3) Enterprises and institutions that implement national key projects or major scientific research projects;
(4) High-tech enterprises, encouraged foreign-invested enterprises, foreign-invested advanced technology enterprises or foreign-invested products export enterprises.
Article 9 An applicant shall truthfully fill in the Application Form for Permanent Residence of Foreigners in China when applying, and submit the following materials:
A valid foreign passport or a certificate that can replace a passport;
(2) A health certificate issued by the health and quarantine department designated by the government of China or a foreign health and medical institution certified by China's embassy or consulate abroad;
(3) A certificate issued by China's embassy or consulate abroad that it has no overseas criminal record;
(4) Four two-inch recent bareheaded color photos;
(5) Other relevant materials as stipulated in these Measures.
Article 10 The personnel referred to in Item 1, Paragraph 1, Article 6 of these Measures shall also submit the approval certificate, registration certificate, joint annual inspection certificate, capital verification report and personal tax payment certificate of foreign-invested enterprises when applying.
Enterprises with encouraged foreign investment shall also submit the Confirmation Letter of National Encouraged Foreign Investment Projects.
Article 11 When applying for the personnel in Item 2, Paragraph 1 of Article 6 of these Measures, the following materials shall also be submitted:
(a) the certificate of my position or title issued by the employer;
(2) Foreign expert certificate or foreigner employment certificate;
(three) the employer's registration certificate, annual inspection certificate and personal tax payment certificate; If the employing unit is a foreign-invested enterprise, it shall also submit the approval certificate of the foreign-invested enterprise and the joint annual inspection certificate;
(four) personnel working in enterprises and institutions that implement national key projects or major scientific research projects, and submit project certification documents issued by provincial and ministerial government departments; Personnel working in high-tech enterprises are required to submit high-tech enterprise certificates; Personnel working in encouraged foreign-invested enterprises, foreign-invested advanced technology enterprises and foreign-invested product export enterprises shall submit the Confirmation of National Encouraged Foreign-invested Projects or the Confirmation of Foreign-invested Advanced Technology Enterprises or the Confirmation of Foreign-invested Product Export Enterprises.
Article 12 When applying for item (3) of the first paragraph of Article 6 of these Measures, a letter of recommendation and relevant certificates issued by the competent department of China municipal government shall also be submitted.
Thirteenth at the time of application, the person referred to in Item 4 of Paragraph 1 of Article 6 of these Measures shall also submit a marriage certificate if he belongs to his spouse; If it is an unmarried child under the age of 18, it is also necessary to submit a birth certificate or a parent-child relationship certificate; If it is adoption, proof of adoption is required. The above-mentioned certificates issued by relevant foreign institutions shall be certified by Chinese embassies and consulates in that country.
Article 14 When applying, the persons referred to in Item (5) of Paragraph 1 of Article 6 of these Measures shall also submit the permanent residence certificate of their nationality spouse or the permanent residence certificate of foreigners of their foreign spouses, marriage certificate, notarized living guarantee certificate and house lease or property right certificate. The above-mentioned certificates issued by relevant foreign institutions shall be certified by Chinese embassies and consulates in that country.
Article 15 When applying, the persons referred to in Item (6) of Paragraph 1 of Article 6 of these Measures shall also submit the permanent residence certificate of their nationality parents or the permanent residence certificate of their foreign parents, birth certificate or proof of parent-child relationship; If it is adoption, proof of adoption is required. The above-mentioned certificates issued by relevant foreign institutions shall be certified by Chinese embassies and consulates in that country.
Article 16 When applying, the personnel referred to in Item 7 of Paragraph 1 of Article 6 of these Measures shall also submit the permanent residence certificate of China citizens or foreigners in the refuge, notarized proof of kinship, notarized proof that the refuge has no immediate family members abroad, notarized proof of economic source or economic guarantee of the refuge, notarized proof of lease or property right of the refuge. The above-mentioned certificates issued by relevant foreign institutions shall be certified by Chinese embassies and consulates in that country.
Article 17 If a foreigner applies for permanent residence in China, he or her parents or clients of unmarried children under the age of 18 shall apply to the public security organ of the municipal people's government or the public security bureau or county bureau of the municipality directly under the Central Government where he or she mainly invests or has a long-term residence.
Where the client applies, it shall submit the power of attorney issued by the applicant. The power of attorney issued by the applicant abroad must be certified by the embassy or consulate of China in that country.
Article 18 The public security organ shall make a decision of approval or disapproval within six months from the date of accepting the application of foreigners for permanent residence in China.
Article 19 Aliens who have been approved to reside permanently in China shall be issued the Alien Permanent Residence Permit by the Ministry of Public Security; If the applicant is abroad, the Ministry of Public Security will issue a confirmation form for foreigners' permanent residence. The applicant shall apply for a D visa with the Confirmation Form for Permanent Residence of Foreigners in China's embassies and consulates abroad, and obtain a permanent residence permit for foreigners from the public security organ that accepted the application within 30 days after entering the country.
Article 20 Foreigners who have been approved for permanent residence in China shall stay in China for not less than three months each year. If it is really necessary to stay in China for a cumulative period of three months each year, it must be approved by the public security department or bureau of the province, autonomous region or municipality directly under the Central Government where you live for a long time, but the cumulative residence in China within five years shall not be less than one year.
Article 21 A foreigner's permanent residence permit is valid for five or ten years.
Foreigners under the age of 18 who have been approved for permanent residence in China shall be issued with a permanent residence permit valid for five years; Foreigners over the age of 18 who have been approved for permanent residence in China will be issued with a permanent residence permit valid for 10 years.
Article 22 If the Alien Permanent Residence Permit expires, its contents are changed, damaged or lost, the holder shall apply to the public security organ of the municipal people's government with districts or the public security bureau or county bureau of the municipality directly under the Central Government for renewal or replacement. If the public security organ has not lost the qualification of permanent residence in China after examination, it shall issue a new or reissued certificate within one month.
Twenty-third foreigners holding the "Permanent Residence Permit for Foreigners" shall apply for renewal within one month before the expiration of the certificate; If the contents of the certificate change, it shall apply for renewal within one month after the situation changes; If the certificate is damaged or lost, it shall apply for renewal or replacement in time.
Twenty-fourth foreigners with permanent residence in China have one of the following circumstances, the Ministry of Public Security may cancel their permanent residence in China, and at the same time confiscate their permanent residence certificates for foreigners or declare them invalid:
May cause harm to national security and interests;
(2) Being deported by the people's court;
(3) Obtaining the qualification of permanent residence in China by illegal means such as providing false materials;
(4) Having resided in China for less than three months each year or in China for less than five years without approval.
Article 25 Foreigners who have been granted permanent residence in China before the implementation of these Measures shall, within six months from the date of implementation of these Measures, apply to the public security organ of the Municipal People's Government or the public security bureau or county bureau of the municipality directly under the Central Government for the Permanent Residence Permit for Foreigners.
Twenty-sixth applications for permanent residence in China and the issuance, renewal and replacement of permanent residence permits for foreigners shall be subject to the relevant charging items and standards in accordance with the provisions of the competent department of price and finance of the State Council.
Article 27 The meanings of the following terms in these Measures:
(1) "Immediate family members" refer to parents (parents of spouses), grandparents (grandparents), adult children and their spouses, adult grandchildren and their spouses aged 18;
(two) "above" and "within" include the number.
Article 28 These Measures shall be interpreted by the Ministry of Public Security and the Ministry of Foreign Affairs.
Article 29 These Measures shall come into force as of the date of promulgation.
