With the approval of the State Council, Lao Ren Lao (1982) No.42 is hereby notified as follows about the treatment of state-owned enterprises, institutions and persons allowed to leave the country for settlement:

1. Retirement expenses and living expenses of retired people who have settled abroad enjoy the same treatment as those of retired people in China. Its retirement expenses, retirement living expenses and non-staple food price subsidies, grain (coal) price subsidies, enterprise employees' work-related disability subsidies, subsidies paid by the people >: disability pensions paid by departments, etc. , paid by the unit that pays the retirement and resignation fees (disability payments are paid by retirement fees and retired students)

The living expenses are paid by the unit to the person in my original place of residence, or entrusted to relatives and friends in China until my death. The foreign exchange required to pay this treatment shall be handled by the local China bank in accordance with the relevant provisions of the Detailed Rules for the Implementation of the Examination and Approval of Individual Foreign Exchange Applications issued by the State Administration of Foreign Exchange.

Retired and resigned persons who have settled abroad shall provide their own survival certificates issued by China embassies and consulates abroad or local notary offices every six months. The certificate issued by a notary public must be certified by the Chinese embassy or consulate abroad (if you live in a country that has not yet established diplomatic relations with China, you must be certified by the embassy or consulate of a third country that has established diplomatic relations with China). Payment unit, with the above certificate, pays on schedule.

Second, retired and resigned people who have settled abroad and their immediate family members shall be handled according to the provisions of the Ministry of Finance on travel expenses such as cars, boats, luggage handling, hotels and food subsidies required for domestic trips; All the expenses required for traveling abroad will be borne by me.

Third, after the death of a retired or resigned person who has settled abroad, the unit that paid the retirement fee and the retirement living expenses shall pay the funeral expenses, the pension for supporting immediate family members or the relief expenses according to the current regulations of the original work unit. Immediate family members who have settled abroad shall, in accordance with the notarization and authentication procedures in Article 1 of these Provisions, provide the units that pay retirement and resignation benefits with the death certificates of retired and resigned personnel.

Four, retired and resigned personnel who have settled abroad, in addition to enjoy the treatment according to the provisions of Articles 1, 2 and 3, no longer enjoy other benefits.

Five, retirees who have settled abroad, approved to return to China to settle down, the original payment of retirement fees and retirement living expenses should be in accordance with the provisions of retirement, resignation, and other retirees of the same unit. However, those who have received retirement fees and living expenses in one lump sum for five years and have lived abroad for less than five years shall be counted from the month of going abroad.

After several years, you can enjoy the first preferential treatment in this notice.

Six, this notice also applies to retirees who are allowed to settle in Hong Kong and Macao, as well as foreign retirees who leave China to settle in foreign countries or Hong Kong and Macao.

Seven, the collective ownership of enterprises and institutions, retirees to settle abroad, by the provinces, municipalities and autonomous regions, the procedures can be handled with reference to these provisions.

Eight, this notice shall be implemented as of the date of issuance. If the relevant provisions in the past are inconsistent with this notice, this notice shall prevail. In the past, according to the relevant provisions, people who received a one-time five-year retirement fee and retirement living expenses and still lived abroad or in Hong Kong and Macao, their treatment remained unchanged.
