Measures for the investigation of responsibility for violating the provisions on the collection and use of support funds for the resettlement of large and medium-sized reservoirs

Article 1 In order to standardize the collection and use management of the late resettlement support fund for large and medium-sized reservoirs (hereinafter referred to as the late resettlement support fund), enforce financial discipline, and ensure the safety and effectiveness of the collection and use management of the late resettlement support fund, these measures are formulated in accordance with relevant laws and administrative regulations such as the Regulations on Punishment of Civil Servants of Administrative Organs, the Regulations on Punishment of Financial Violations, and the Regulations on Land Acquisition Compensation and Resettlement for Large and Medium-sized Water Conservancy and Hydropower Projects. Article 2 Units, responsible leaders and directly responsible personnel who violate the provisions on raising and using late-stage support funds, and individuals who violate the provisions on raising and using late-stage support funds belong to the following persons (hereinafter referred to as relevant responsible persons), and shall be punished by the supervisory organ or the appointment and removal organ according to the management authority:

(1) Civil servants of administrative organs;

(two) the staff authorized by laws and regulations with the function of public affairs management and approved by reference to the Civil Service Law of People's Republic of China (PRC);

(3) Staff members of organizations entrusted by administrative organs according to law, except laborers;

(4) Persons appointed by administrative organs in enterprises, institutions and social organizations.

The financial department of the people's government at or above the county level shall, within the scope of its functions and powers, make a decision on handling and punishment for acts that violate the provisions on the collection and use of late support funds according to law.

Article 3 Where the local people's government, its relevant departments and the local financial Ombudsman's office of the Ministry of Finance arbitrarily reduce or exempt the late-stage support fund, arbitrarily adjust the fund collection standard or expand the deduction scope of social sales electricity, it shall be ordered to make corrections, adjust relevant accounting accounts, supplement the funds to be collected, and return the illegal income within a time limit. Give a warning or informed criticism to the unit. Give warning, demerit or gross demerit to the relevant responsible personnel; If the circumstances are serious, demotion or dismissal shall be given. Fourth provincial power grid enterprises and their staff failed to report the actual electricity sales last month and the late support funds that should be paid to the local Office of the Financial Ombudsman of the Ministry of Finance, and were ordered to make corrections. Give a warning or informed criticism to the unit. Article 5 If provincial power grid enterprises and their staff fail to pay the late support funds in full and on time as required, they shall be ordered to make corrections, adjust relevant accounting accounts and collect the funds that should be paid. Give a warning to the unit, confiscate the illegal income, and impose a fine of 10% to 30% of the fund amount; A fine of 3000 yuan to 50 thousand yuan shall be imposed on the relevant responsible personnel. Article 6 Where the local people's government and its relevant departments intercept or misappropriate the later support funds, they shall be ordered to restore the original state within a time limit and return the illegal income. Give a warning or informed criticism to the unit. Give disciplinary punishment to the relevant responsible personnel for gross demerit; If the circumstances are serious, demotion or dismissal shall be given; If the circumstances are serious, they shall be dismissed. Article 7 Provincial power grid enterprises and their staff who intercept or misappropriate late-stage support funds shall be ordered to make restitution, return illegal income within a time limit, and be fined less than 3 times the amount of funds intercepted or misappropriated. Give a warning or informed criticism to the unit. Article 8 provincial power grid enterprises and their staff who directly retain the fees from the overdue fine income collected by them shall be ordered to make corrections, adjust the relevant accounting accounts and collect the overdue fine that should be paid. Article 9 If local financial departments, immigration management agencies and their staff fail to timely allocate funds according to the use plan and designated purposes of the later support fund, they shall be ordered to make corrections, adjust relevant accounting accounts, recover relevant financial funds, and return illegal income within a time limit. Give a warning or informed criticism to the unit. Give disciplinary punishment to the relevant responsible personnel for gross demerit; If the circumstances are serious, demotion or dismissal shall be given; If the circumstances are serious, they shall be dismissed. Tenth local financial departments, immigration management agencies failed to submit the budget (final accounts) of the annual support fund in accordance with the provisions, or failed to report the budget (final accounts) to the higher authorities for the record, and shall be ordered to make corrections. Give a warning or informed criticism to the unit. Give warning, demerit or gross demerit to the relevant responsible personnel; If the circumstances are serious, demotion shall be given; If the circumstances are serious, he shall be removed from his post. Eleventh specific use and management of the late support fund institutions and their staff, not in accordance with the provisions of the state scope of use and support methods to use the late support fund, shall be ordered to make corrections, recover the relevant financial funds, return the illegal income within a time limit. Give a warning or informed criticism to the unit. Give disciplinary punishment to the relevant responsible personnel for gross demerit; If the circumstances are serious, demotion or dismissal shall be given; If the circumstances are serious, they shall be dismissed. Twelfth specific use and management of the late support fund institutions have not established the immigrant personal or family files and the account books and accounts issued by the fund, and shall be ordered to make corrections within a time limit. Give warning, demerit or gross demerit to the relevant responsible personnel; If the circumstances are serious, demotion shall be given; If the circumstances are serious, he shall be removed from his post. Thirteenth local people's governments that use the late-stage support fund fail to submit the fund use report to the financial department of the people's government at a higher level and the immigration management institution according to the regulations, and shall be ordered to make corrections; If the circumstances are serious, give a warning or informed criticism.
