Regulations on Resettlement in Reservoir Area of Hydropower Station in Dahua Yao Autonomous County

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the basic principles stipulated in the Law of People's Republic of China (PRC) on Regional National Autonomy in order to do a good job in the resettlement of migrants in the reservoir area of hydropower stations (hereinafter referred to as the reservoir area) and promote the economic development and social stability in the reservoir area. "Regulations on the Autonomy of Dahua Yao Autonomous County" and relevant laws and regulations, combined with the actual resettlement of migrants in Dahua Yao Autonomous County (hereinafter referred to as Autonomous County). Article 2 The term "reservoir resettlement" as mentioned in these Regulations refers to the population in the flooded area, engineering construction area and affected area of the hydropower station reservoir area approved by the state organs at higher levels as resettlement targets. These Regulations shall apply to the resettlement, development, construction and management of large, medium and small hydropower stations in Autonomous County. Article 3 Immigrants in the reservoir area shall receive flood compensation, resettlement subsidies and later production and living support according to law, and enjoy the relevant preferential policies of the state and autonomous regions for poor areas. Article 4 The immigrants in the reservoir area of Autonomous County adhere to the principles of state support, preferential policies, support from all parties and self-reliance, correctly handle the relationship between the state, the collective and the individual, implement the policy of development-oriented immigration, combine resettlement with reservoir construction, resource development, soil and water conservation, environmental protection and economic development, and properly resettle immigrants through various forms, so that the life of immigrants can reach or exceed the county average. Article 5 When building a hydropower station in an autonomous county, the owner of the power station shall properly handle the relationship between the power station project and the interests of the immigrants, combine the power station project with the resettlement and development of the immigrants in the reservoir area, actively support the resettlement and development of the immigrants in the reservoir area, and promote the development of the economy and various undertakings in the reservoir area. Sixth autonomous county hydropower station owners should take care of the interests of immigrants in the reservoir area and the production and life of local immigrants. Seventh Autonomous County People's government organization and leadership in the county hydropower station reservoir resettlement and reservoir development and construction work.

Autonomous county immigration administrative department is responsible for the organization, management and implementation of the county reservoir resettlement and later support.

The township (town) people's government and the village (street) people's committee in the reservoir area are responsible for the organization, management and implementation of the post-resettlement support within their respective jurisdictions.

The relevant departments and units of Autonomous County shall attach importance to and support the resettlement and support of immigrants, and cooperate with each other within the scope of their respective duties. Chapter II Resettlement and Management Article 8 When building a hydropower station in an autonomous county, a resettlement plan must be prepared. Resettlement planning shall be approved by the autonomous county and reported to the state organs at higher levels for approval.

Resettlement planning should include inundation compensation, resettlement subsidies and support for later production and life, should be forward-looking and have room for development, and budget the corresponding resettlement funds to ensure that the immigrants in the reservoir area get due compensation and support. Ninth reservoir resettlement should be carried out in accordance with the resettlement plan, and complete the task on schedule. After the resettlement work is completed, it shall be accepted. Tenth Autonomous County adhere to the principle of unified leadership, graded responsibility and classified resettlement, according to the remaining resources and environmental capacity of the reservoir area, formulate and implement the resettlement plan, and properly resettle the immigrants in the reservoir area. Eleventh power station owners and competent departments shall, according to the resettlement plan, timely and fully allocate resettlement funds to ensure timely and reasonable resettlement of immigrants in the reservoir area. Twelfth autonomous counties through the county in situ resettlement, resettlement in different places and relocation outside the county and other ways to resettle immigrants in the reservoir area. Thirteenth in accordance with the resettlement plan must be relocated, by the Autonomous County People's government unified organization relocation. After the implementation of compensation and resettlement conditions, immigrants shall not refuse to move or delay the move for an excuse. Immigrants who have moved out or resettled in different places will not be resettled if they return without authorization. The relocation of immigrant houses shall be paid according to the compensation standard, and part of the cost of overbuilding shall be borne by itself. Fourteenth resettlement sites by the state organs at higher levels to coordinate the implementation, by the Autonomous County People's government to organize resettlement, and in consultation with the people's government to move in, for land use permits, housing ownership certificates and household registration procedures. Life in the early stage of development shall be subsidized in accordance with state regulations. Fifteenth Autonomous County resettlement sites in the land, by the Autonomous County People's government in accordance with the law to clarify the procedures for land use, and the implementation of land contractual management rights or land use permits. Houses, fruit trees and trees belonging to individual immigrants in resettlement areas can be inherited, donated or mortgaged or transferred according to law. Article 16 Where a person voluntarily visits relatives and friends outside the reservoir area of the county or contacts the resettlement by himself, the competent resettlement department of the Autonomous County shall, through consultation, go through the relevant formalities and issue resettlement subsidies according to the regulations. Seventeenth surplus land and other resources in the reservoir area shall be organized by the township (town) people's government to organize villagers' committees and villagers' groups in accordance with the principle of unified planning and orderly development.

Living allowance for local resettlement of immigrants shall be paid in accordance with state regulations. Article 18 The owner of a power station arbitrarily exceeds the normal water level of the reservoir and the design flood standard, thus causing damage to cultivated land, crops, water conservancy, roads and houses. The owner of the power station shall arrange funds in time and be responsible for recovery, improvement or compensation. Article 19 Immigrants whose cultivated land is less or whose surplus resources are more are flooded or requisitioned in the reservoir area shall not be treated as immigrants after one-time compensation by the state, or those who have a fixed source of livelihood and whose living standards have steadily recovered and reached the local upper-middle level, and other dynamic populations in the reservoir area have been verified.
