Is the AICPA exam useful for immigrants?
Professionals holding advanced degree/aliens with exceptional ability (EB-2) belong to the second priority category of U.S. employment-based immigrants. According to U.S. immigration law, green card applicants in this category are foreigners with a master's degree (or a bachelor's degree plus five years of relevant work experience), as well as those who have special talents in science, art, culture, business and other fields and can be familiar with the United States. Foreign nationals who contribute to the national interest.
Green card applicants in this category can apply for a green card through two channels. The first is to apply for a labor certificate through the Department of Labor, and then apply for a green card at the Immigration Bureau; the other is to submit the green card application directly to the immigration. bureau, demonstrate that their talents are in the national interest of the United States and thereby request an exemption from the labor certification application process. The former procedure requires that the green card applicant already has an employer in the United States, which will not be introduced here. The second application can be submitted by the green card applicant himself and does not require an employer, so it is very suitable for highly educated people who are not yet in the United States. This category is called a National Interest Waiver (NIW).
If applying for the National Interest Waiver category, the applicant must first prove at least three of the following six conditions: 1) Hold a degree, diploma or training certificate awarded by a higher academic institution such as a university; 2 ) At least ten years of relevant work experience; 3) Holding a practicing certificate required by a specific industry; 4) Enjoying a high salary to prove special talents; 5) Having membership in a relevant association; 6) Recognizing his or her achievements by peers, professional organizations or business organizations or contribution.
The above are requirements for high education or special talents. If the applicant applies for a green card under the National Interest Waiver category, he or she must prove the following three points in accordance with U.S. case law: 1) The applicant’s work is inherently important, 2) The applicant’s contribution to the United States It will be nationwide. 3) Requiring applicants to apply for green cards through labor certification is not conducive to the national interests of the United States. (This provision comes from the case of New York State Department of Transportation v. U.S. Immigration Services. U.S. Board of Immigration Appeals case.)
If the applicant can meet the above requirements, then there is no need for an employer in the United States to help apply , and there is no need to apply for a labor certificate through the Department of Labor. The Immigration Bureau can directly approve the green card application.
The U.S. Immigration Law and Immigration Service have much looser requirements for this category than for outstanding talents. Many domestic scientific researchers, experts, professors, students and scholars have obtained U.S. green cards through this method.
Bachelor degree or above + AICPA license + 5 years of work experience, applying for EB-2 green card immigration will be a very convenient option! There is no need for an employer in the United States to help with the application, nor does it need to apply for a labor certificate through the Department of Labor. The Immigration Bureau can directly approve the green card application. Therefore, obtaining the AICPA certificate is an important weight for immigration.
