chapter I general provisions article 1 in order to strengthen the management of bidding for hydropower construction projects (hereinafter referred to as hydropower bidding) and clarify the responsibilities of all parties, these provisions are formulated in accordance with the State Council's "interim provisions on several issues concerning the reform of the management system of construction industry and capital construction" and combined with the specific conditions of hydropower construction work. Article 2 The tendering and contracting system is to select construction enterprises and equipment manufacturers through competition under the guidance of national policies, and determine the responsibilities by contract, so as to ensure the project quality, shorten the construction period, reduce the project cost and improve the investment benefit. Article 3 Bidding and tendering are economic activities between legal persons, and departments or enterprises without legal qualifications cannot organize bidding or participate in bidding. Article 4 These Provisions shall apply to all large and medium-sized hydropower projects invested and built in China that are contracted by bidding. Chapter II Management of Bidding Article 5 The Ministry of Energy manages and supervises the bidding of large and medium-sized hydropower projects, and its main responsibilities are:

1. Formulating and promulgating relevant provisions or measures for bidding of hydropower projects according to relevant national laws and regulations.

3. Establish the project leading organization of large-scale hydropower projects in conjunction with relevant competent departments, and approve the project owners and the construction units of major national construction projects.

owner unit: the owner unit (hereinafter referred to as the owner) is responsible for the project construction declaration, fund raising and repayment, undertaking the task of hydropower station construction, and being responsible to the state and investors. The owner has the right to manage the fixed assets of the project.

construction unit: the organization that manages the project construction on behalf of the owner, which can be selected by the owner or entrusted by a unit with the ability of project construction management. Under the management of the construction unit, the supervision, consultation, design, construction unit and equipment manufacturer shall complete their respective tasks according to the contract. Supervision is part of construction management, and its units and personnel should be relatively stable. Article 7 The basic parties of bidding activities are the owners and bidding enterprises. Authorized by the owner, the construction unit, as the bidding unit, engages in bidding work on behalf of the owner. All construction enterprises holding the Qualification Grade Certificate of Water Conservancy and Hydropower Construction Enterprises can participate in the bidding for hydropower project construction corresponding to their qualifications. Construction enterprises holding qualification grade certificates of other industries shall participate in the bidding for the main project (including diversion project, the same below), and their qualifications shall be attached to the relevant provisions of the "Qualification Grade Standard for Water Conservancy and Hydropower Construction Enterprises" and approved by the project leading institutions. Article 8 The bidding plan, pre-qualification documents, bidding documents, pre-qualification reports and bid evaluation reports related to the principal project shall be submitted by the bidding unit to the owner for approval and confirmed by the project leading organization, and at the same time submitted to the superior competent department for verification.

the relevant units should reply within fifteen days after receiving the report, and those who fail to reply within the time limit will be confirmed. The tenderee may proceed to the next step. Chapter III Bidding Article 9 Bidding for hydropower projects shall meet the following conditions:

1. Construction funds have been secured and the project has been included in the national or local capital construction plan.

2. The bid-dividing scheme or execution budget has been approved by the owner; The bidding plan has been agreed by the owner and the project leader.

3. The construction unit has signed a design contract with the design unit.

iv. the preparation of tender documents, tender design and pre-tender estimate has been completed.

5. The implementation plan for land acquisition and resettlement for engineering construction has been implemented. Article 1 Bid division should be conducive to attracting bidding enterprises to participate in competition, and to the project management of construction units and contracting enterprises. The main project bidding should not be too much. Eleventh bidding methods are divided into open bidding, invitation bidding and invitation negotiation. The tenderee can choose according to the engineering conditions and market environment. The following different bidding methods can be adopted for the bidding projects in the same project.

1. open tender: the tender unit will publicly issue the tender notice.

2. Invitation to bid: The bid inviting unit sends a bid invitation to an enterprise with contracting ability. Invited construction enterprises should not be less than three.

3. Invitation for bid negotiation: The bid inviting unit invites enterprises with contracting ability, and determines the contracting enterprises and contract conditions through negotiation until signing the contract. Generally, there are not less than two invited enterprises. Article 12 The bidding enterprises shall be subject to qualification examination (pre-qualification or post-qualification examination). Thirteenth public bidding must adopt the pre-qualification method. The prequalification notice issued by the bid inviting unit shall include the following main contents:

1. Name of the owner, construction unit and design unit.

second, the project name, geographical location, bidding project scale, planned commencement date and completion date.

iii. qualifications and additional qualifications of enterprises applying for bidding.

iv. date, address and selling price of the prequalification documents. Article 14 Pre-qualification documents generally include the following contents:

1. General situation of the bidding project, construction conditions, main quantities and technical requirements, and corresponding drawings and materials.

ii. conditions of contract.

3. Instructions for prequalification applicants (including the deadline for accepting applications and the delivery address).

iv. Pre-qualification application form to be filled in by the bidding enterprise, with the main contents as follows:

1. Name, affiliation and principal responsible person of the enterprise.

2. Copy of enterprise qualification grade certificate.

3. A brief history of the enterprise and its engineering achievements in recent twenty years.

4. Enterprise status (personnel, equipment, finance).

5. Existing construction tasks and contracts under negotiation.

6. Equipment to be put into this project, equipment status and sources, and working capital to be put into this project.

7. the name and qualifications of the person in charge of the site to be dispatched.
