Chapter I General Provisions

Article 1 In order to strengthen the management of special funds for consolidating the achievements of returning farmland to forests and improve the efficiency in the use of funds, these Measures are formulated in accordance with the Notice of the State Council on Improving the Policy of Returning Farmland to Forests (Guo Fa [2007] No.25) and other relevant provisions.

Article 2 The special funds for consolidating the achievements of returning farmland to forests (hereinafter referred to as special funds) refer to the funds specially arranged by the central government to consolidate the achievements of returning farmland to forests and solve the long-term livelihood of farmers who have returned farmland.

Article 3 Relevant departments of the State Council and local people's governments at all levels shall use and manage special funds in accordance with these Measures.

Chapter II Budget Management

Article 4 The special funds are mainly used in the western region, the sandstorm source control areas in Beijing and Tianjin, and the central region enjoying the western policy, and are inclined to areas with special difficulties.

Article 5 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for formulating special plans to consolidate the achievements of returning farmland to forests, with emphasis on the planning for the construction of basic grain ration fields, the planning for rural energy construction, the planning for ecological migration, and the planning for the development of farmers' continuing industries. Arrange the necessary funds for returning farmland to forests.

The National Development and Reform Commission, the the State Council Western Development Office, the Ministry of Agriculture, the State Forestry Administration and other departments are responsible for guiding the people's governments of provinces, autonomous regions and municipalities directly under the Central Government to formulate special plans to consolidate the achievements of returning farmland to forests according to their respective responsibilities and division of labor.

Article 6 Application procedures for special funds: The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government shall report the special plan for consolidating the achievements of returning farmland to forests to the National Development and Reform Commission, the the State Council Western Development Office, the Ministry of Finance, the Ministry of Agriculture and the State Forestry Administration for review. The relevant departments of the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government shall, according to the special plan for consolidating the achievements of returning farmland to forests approved by the relevant departments of the state, submit the plan for the use of funds for the next year to the National Development and Reform Commission, the the State Council Western Development Office, the Ministry of Finance, the Ministry of Agriculture, the State Forestry Administration and other departments before October 30 of each year. The National Development and Reform Commission and the the State Council Western Development Office, together with the Ministry of Finance, the Ministry of Agriculture, the State Forestry Administration and other departments, reviewed and issued a task plan. The Ministry of Finance issued a special fund budget according to the task plan and the verification and acceptance results of the State Forestry Administration. The allocation of special funds shall be implemented in accordance with the relevant provisions of the financial treasury management system. Where special funds are used for capital construction in accordance with the provisions of Article 9 of these Measures, the relevant departments of the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government shall do a good job in the preliminary work of the project in accordance with the basic construction procedures.

Article 7 Local people's governments at all levels shall, when formulating special plans to consolidate the achievements of returning farmland to forests, make overall consideration of capital construction investment in the central budget, basic grain field construction, rural energy and other funds arranged by special funds, clarify the specific tasks supported by special funds, and do a good job in coordination and connection with relevant national plans. At the same time, combined with poverty alleviation and development, forest right system reform, small-scale farmland water conservancy construction, land consolidation, comprehensive agricultural development and other funds, we will make overall arrangements to support farmers who have returned to farmland to improve their production and living conditions and enhance their self-development ability.

Article 8 In accordance with the principle of "four provinces" in terms of objectives, tasks, funds and responsibilities, special funds shall be used by all provinces, autonomous regions and municipalities directly under the Central Government at one time, and shall be distributed year by year in eight years from 2008.

Chapter III Use and Management of Funds

Article 9 The use of special funds shall be arranged in the following order:

(a) conditional farmers to build basic grain ration fields;

(two) conditional farmers to carry out biogas, firewood saving stoves, solar stoves and other rural energy construction.

(three) the implementation of ecological migration for farmers who have the conditions to return farmland.

(four) returning farmland to forests, replanting land, developing the construction of local advantageous industrial bases, and carrying out skills training for farmers' employment and entrepreneurship transfer.

(five) direct subsidies to farmers returning farmland in alpine minority areas.

Tenth special funds to implement special account accounting, earmarking, strict management, any department or unit shall not be withheld or misappropriated. Special funds shall not be used as local matching funds for other central subsidy projects.

Eleventh special funds shall be arranged by the local government in accordance with the provisions of Article 9 of these measures, and shall be used to consolidate the achievements of returning farmland to forests and solve the long-term livelihood of farmers who have returned farmland according to local conditions.

Chapter IV Supervision and Inspection

Article 12 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the use and management of special funds. The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government should conscientiously implement the central policies, exercise strict work discipline and strictly manage the use of funds. The financial departments at all levels (including the agencies of the financial departments at or above the provincial level) shall supervise and inspect the use and management of special funds, and promptly correct any problems found. In violation of the provisions on the use of special funds, units or individuals that intercept, misappropriate or cause financial losses shall be dealt with in accordance with the Regulations on Penalties and Punishment for Financial Violations (the State Council Decree No.427th) and relevant laws and administrative regulations.

Thirteenth relevant departments of the State Council should carry out their duties, formulate and implement the annual inspection plan year by year, and strengthen the management, supervision, inspection and assessment of special funds and construction projects.

Fourteenth supervision and auditing departments at all levels should strengthen the supervision and inspection of special funds.

Chapter V Supplementary Provisions

Article 15 The financial departments of all provinces, autonomous regions and municipalities directly under the Central Government shall, jointly with the development and reform commissions, agriculture, forestry and other relevant departments at the same level, formulate detailed implementation rules according to these Measures and report them to the Ministry of Finance for the record.

Article 16 These Measures shall be implemented as of the date of promulgation. Returning farmland to forests refers to stopping farming in a planned and step-by-step manner from sloping farmland that is prone to soil erosion and farmland that is prone to land desertification from the perspective of protecting and improving the ecological environment in the west; According to the principle of suitable trees, suitable irrigation and suitable grass, combining arbor with shrub and grass, we should plant trees and grass according to local conditions and restore forest and grass vegetation. Returning farmland to forests is one of the important policies for China to implement the strategy of developing the western region. Its basic policies and measures are "returning farmland to forests, closing hillsides for greening, substituting work for relief, and individual contracting".

Closing hillsides to facilitate afforestation: strictly close hillsides to protect the existing forest and grass vegetation in the project area, restore the forest and grass vegetation as soon as possible in barren hills and wasteland suitable for afforestation, and implement strict management and protection to ensure the greening results.

Grain for Relief: The state provides grain for farmers returning farmland to forests free of charge according to certain standards, and implements the policy of exchanging grain for ecology to ensure that farmers can have food after returning farmland to forests and grasslands, their income will not be reduced, and their enthusiasm will be mobilized. Individual contracting: the task of planting trees and grass and protecting vegetation is contracted from household to household. In accordance with the principle of "whoever reclaims farmland, afforestation, management and benefits", the rights and interests of afforestation and grass planters are clearly defined in the form of responsibility system, management and protection measures are implemented, and responsibility and rights are linked, so that the masses can make contributions to the ecological environment construction while gaining benefits. 1, overall planning, step-by-step implementation, highlighting key points and paying attention to actual results;

2. Combining policy guidance with farmers' voluntary returning farmland, whoever returns farmland, afforestation, management and benefits;

3. Follow the laws of nature, adjust measures to local conditions, make forests and grasses suitable, and comprehensively manage them;

4. Pay equal attention to construction and protection, and prevent damage while managing;

5. Gradually improve the living conditions of those returning farmland to forests. 1, scope, layout and key points;

2. Year, objectives and tasks;

3. Investment calculation and sources of funds;

4. Benefit analysis and evaluation;

5. Safeguard measures.

The State Council's "Regulations on Returning Farmland to Forests" stipulates that the following cultivated land should be included in the plan of returning farmland to forests, and the farmland should be implemented in a planned way according to the needs of ecological construction and national financial resources:

1. Serious soil erosion;

2. Serious desertification, salinization and rocky desertification;

3. The ecological status is important, and the grain output is low and unstable.

In the planning of returning farmland to forests, priority should be given to the cultivated land on steep slopes at the source of rivers and its banks, around lakes and reservoirs, cultivated land in ecologically important areas such as soil erosion and serious sandstorm damage.
