About Hong Kong Investment Immigrants
The following are the specific requirements of the Hong Kong Immigration Department:
Most people who come to settle in Hong Kong (whether from Chinese mainland or other places) must have lived in Hong Kong for seven years before they can obtain permanent resident status in Hong Kong.
However, the rule of staying in Hong Kong for seven years does not mean that you must stay in Hong Kong for seven years and cannot leave the country. The law only stipulates that the person concerned must be "ordinarily resident in Hong Kong" during that period. Although the person concerned has temporarily left Hong Kong for business within seven years, he can still be regarded as ordinarily resident in Hong Kong. There is no clear definition of "temporarily", but section 2(6) of the Immigration Ordinance lists a number of factors to determine whether the person concerned is not ordinarily resident in Hong Kong.
For the purposes of this Ordinance, if a person is temporarily absent from Hong Kong, it does not mean that he has ceased to be ordinarily resident in Hong Kong. In deciding whether the person ceases to be ordinarily resident in Hong Kong, the personal circumstances of the person and his absence from Hong Kong shall be taken into account, including:
(a) The reason, duration and frequency of absence from Hong Kong;
(b) whether he has a habitual residence in Hong Kong.
(c) whether he is employed by a company based in Hong Kong. and
The location of the person's main family members (spouse and minor children).
If you are a minor, you should look at item (d) above. Are your parents Hong Kong residents and have lived in Hong Kong for a long time? If so, you still have a chance, because studying in the mainland or abroad can be used as a reason to leave Hong Kong temporarily. If your parents are not in Hong Kong, I don't think you have a chance. Your seven years didn't begin until the day when you really settled in Hong Kong.
