Regulations of Yunnan Province on Highway Management (revised on 20 18)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Highway Law of People's Republic of China (PRC), the Regulations on Highway Safety Protection of the State Council and other relevant laws and regulations, in combination with the actual situation of this province, in order to strengthen road administration and ensure the sound, safe and smooth roads. Article 2 These Regulations shall apply to the road administration and services of national highways, provincial highways, county roads, township roads and village roads included in the rural road planning within the administrative region of this province.

The term "road administration" as mentioned in these Regulations refers to the administrative activities of protecting and managing highways, land used for highways, highway ancillary facilities (hereinafter referred to as highway property), highway construction control zones and their surrounding highway protection zones (hereinafter referred to as highway property) according to law. Article 3 People's governments at or above the county level shall strengthen their leadership over road administration and improve the level of road administration and service. The funds needed for road administration shall be included in the financial budget of the people's government at the corresponding level. Article 4 The transportation departments of the people's governments at or above the county level shall be in charge of the road administration within their respective administrative areas, and the road administration institutions to which they belong (hereinafter referred to as the road administration institutions) shall specifically undertake the road administration work.

The relevant departments of the people's governments at or above the county level shall, according to their respective responsibilities, do a good job in road administration. Fifth township (town) people's governments and sub-district offices shall, in accordance with the relevant provisions of the state and this province, do a good job in highway management.

Village (neighborhood) committees can organize the masses through village rules and regulations, advocate the care of highways, and assist in highway management.

Road management agencies can establish a road protection cooperation mechanism with township (town) people's governments, sub-district offices and village (neighborhood) committees along the highway, and do a good job in road protection. Article 6 Units and highway management enterprises responsible for highway maintenance shall strengthen highway maintenance, do a good job in highway protection according to law, and support and cooperate with highway management agencies to do a good job in highway management. Seventh people's governments at all levels and their transportation departments should do a good job in publicity and education of highway protection and raise citizens' awareness of highway protection. Chapter II Institutional Responsibilities and Law Enforcement Supervision Article 8 Road administration institutions shall perform the following duties according to law:

(a) to publicize and implement the laws, regulations and rules of road administration;

(two) the protection of highway property, supervision and management of highway area;

(three) the implementation of highway inspections;

(four) to participate in the completion and acceptance of highway projects;

(five) to investigate and deal with violations of laws and regulations on road administration;

(six) other duties as prescribed by laws and regulations. Article 9 People's governments at or above the county level and their transportation departments shall strengthen the construction of road law enforcement teams, and equip them with law enforcement personnel and equipment that are suitable for the technical grade and mileage of highways under their jurisdiction.

Highway management agencies can employ law enforcement assistants in accordance with the provisions to assist highway law enforcement personnel to carry out highway management and service. Tenth road law enforcement officers shall abide by the following provisions when performing their duties of road administration:

(a) follow the principle of convenience, improve work efficiency and provide quality services;

(two) dress code, wear signs, certificates;

(three) abide by the law enforcement procedures and requirements, fair and civilized law enforcement. Eleventh special vehicles for road law enforcement should be equipped with unified signs and warning lights, and the warning lights should be turned on when patrolling the road. Twelfth road management agencies should strengthen information construction, use scientific and technological means to improve management and service efficiency. Thirteenth road management agencies should establish and improve the publicity platform for administrative law enforcement, open the subject, basis, authority and procedures of law enforcement, and publicly supervise and report methods.

After receiving complaints and reports, the transportation departments, road administration agencies and other relevant units shall promptly deal with them. Fourteenth highway management agencies shall, in accordance with the relevant provisions of the state and this province, reserve emergency materials for highway management and improve the emergency handling capacity of highway emergencies. Chapter III Protection and Traffic of Highways Article 15 People's governments at or above the county level shall determine the scope of land used for highways according to law.

There are ditches on both sides of the highway (intercepting ditch and slope toe berm, the same below), and the land area at the outer edge of the ditch is not less than 1 m; If there are no ditches on both sides of the highway, the scope of land use shall be no less than 1 m from the outer edge of kerb or toe line.

Where the land actually requisitioned or requisitioned by the highway exceeds the outer edge of the roadside ditch by 1 m, the scope of land used by the highway shall be subject to the actual scope of land requisitioned or requisitioned.

The scope of land for village roads shall be determined by the villagers' committee through the villagers' meeting or the villagers' representative meeting. Article 16 The following acts are prohibited within highways and roads:

(a) threshing, drying grain, planting crops and stocking livestock;

(2) Setting up stalls, stacking articles, discharging sewage and dumping wastes;

(3) Digging ditches to divert water, blocking or damaging highway drainage facilities;

(four) quarrying, mining, sand digging, soil borrowing and blasting operations;

(five) destroying, damaging, altering or moving highway signs, markings, stakes, guardrails and other ancillary facilities without authorization;

(six) unauthorized construction of buildings, structures and other facilities;

(seven) transport vehicles mopping the floor or leaking, throwing goods damage, pollution of roads and ancillary facilities;

(eight) other acts that affect the smooth flow of highways or damage highways.
