Chapter 1 General Provisions Article 1 The term “small ships” as mentioned in these Measures refers to motor-driven ships with a registered tonnage of less than 300 tons and towed passenger and cargo barges, regardless of tonnage, coming from and bound for Hong Kong and Macau. Small ships shall fly the flags and lights prescribed by the port authorities in conjunction with the customs. Article 2 Small ships, except for those specifically allowed to export goods from places where customs is not established in accordance with the provisions of Article 28 of these Measures, shall enter and exit, board and disembark passengers, and load and unload goods at ports with customs. Ships shall be subject to customs supervision during their import, export and berth in the port.
Small ships, unless authorized by the customs, must be equipped with warehouse sealing equipment. Article 3 Small vessels, on their way from or to Hong Kong and Macao, are not allowed to tow inland waterway vessels or dock in places where customs is not established without customs permission. If due to force majeure, the ship stops at a place where customs is not established, the captain shall declare in writing the reason, time and place of the stop to the customs at the place of arrival or passing through. Article 4 Small ships traveling between inland river ports and Hong Kong and Macao must dock at the supervision station and undergo customs inspection. Article 5 The port (navigation) authority or relevant departments shall notify the customs in advance of the time when small imported ships arrive at the supervision station and port, as well as the time and place of loading and unloading passengers and loading and unloading goods at the port. Article 6 The berthing places of small ships in the port and the areas for loading and unloading passengers and loading and unloading goods shall be jointly determined by the customs and port (navigation) authorities. Article 7 Small ships, imports, and other water vehicles are not allowed to approach before the customs inspection is completed and after the export is released by the customs. During the period when the ship is loading and unloading passengers and loading and unloading cargo, except for water vehicles transporting passengers, cargo and staff, other water vehicles are not allowed to come close to each other. Article 8 When the customs inspects a ship, the captain shall send personnel to the scene. If it is necessary to dismantle parts of the ship that may be hiding smuggled goods, the captain shall do so immediately; if any special equipment for hiding smuggled goods is found, the captain shall, according to the decision of the customs, be demolished. When the customs inspects the crew's room and crew luggage, the relevant crew member or his representative should be present. If it is necessary to open the place where the items are placed or unpack the luggage or packages, they should be responsible for it. Article 9 The procedures for embarking and disembarking passengers on small ships, loading and unloading luggage, cargo, marine fuel, materials, dunnage, ballast materials and international mail bags shall be carried out in accordance with customs regulations and shall be carried out under customs supervision. Article 10 When the customs performs supervisory duties, the port (shipping) authorities shall provide necessary office space and water transportation vehicles free of charge. Chapter 2 Acceptance of Small Ships Article 11 After the import of a small ship, no one is allowed to get on or off the ship without authorization before the customs inspection is completed, except for the inspectors. Article 12 When the customs accepts a small ship, the captain shall submit the following documents to the customs officer on duty (small ships that do not pass through the supervision station shall submit only one copy of documents (1) and (3)):
(1) Two copies of the small ship import report;
(2) Two copies of the import cargo manifest (no need to submit if there is no cargo);
(3) Two copies of the passenger manifest (It is exempted when there are no passengers);
(4) Navigation visa book (will be issued by the customs and returned to the captain).
When the customs deems it necessary, it may collect or view other documents. Article 13 The small ship import (export) report (attached format 1) ① shall be filled in and signed by the captain in detail according to the listed items. Article 14 Small ships that assemble machine parts or purchase marine fuel or materials in Hong Kong or Macao must submit relevant certificates, bills and invoices for inspection in accordance with regulations, and the customs (or supervision station) shall handle the matter in accordance with relevant regulations. Article 15 When a small ship imported through a supervision station arrives at the port, the captain shall submit the navigation visa book and the customs seal brought by the supervision station to the port customs. Article 16 Foreign currencies stored on board the ship and imported by the captain and crew shall be kept in a centralized manner by the captain and sealed by the customs verification point (vessels imported through the supervision station shall be sealed by the supervision station). Small ships carrying RMB reserves sealed by the customs at the time of export shall be handed over to the customs (or supervision station) by the captain for inspection, and the customs shall unseal them.
For small ships exported without going through a control station, if RMB reserves are used during domestic coastal navigation, the captain should report the reason and amount of the use to the customs (or control station) in writing. bright. Chapter 3 Unloading and Loading of Goods Article 17 After the Customs has completed the inspection of the ship and verified that the documents submitted by the captain are correct, it will verbally approve the unloading. Imported goods shall be unloaded into a warehouse approved by the Customs in accordance with the cargo manifest, except when the goods are handed over and picked up at the ship's side, and the captain shall verify and deliver the bill of lading signed by the customs to the owner of the goods. Article 18 For export goods, the captain shall load the ship based on the loading order signed and stamped by the customs. Article 19 When loading and unloading goods on a small ship, the number of pieces of each batch of goods shall be determined according to the loading list or import cargo manifest. If an error is found in calculating the number of pieces or failure to comply with the provisions of this article, the captain shall immediately check and make corrections together with the relevant handover unit according to the instructions of the customs. Article 20 When a small ship is loading and unloading goods, if it is discovered that goods have been returned to customs, short-loaded, or not included in the cargo manifest, the captain shall indicate the situation on the export or import cargo manifest, and the customs will handle it in accordance with relevant regulations. .
