Regulations of Hanzhong Municipality on Water Environment Protection in Hanjiang River Basin

Chapter I General Provisions Article 1 In order to protect and improve the water environment in the Hanjiang River Basin of Hanzhong City, prevent and control water pollution, ensure the water quality safety in the water source protection areas of the Middle Route Project of South-to-North Water Transfer and the project of diverting water from the Han River to the Wei River, and promote the construction of a green cycle, ecologically livable and beautiful Hanzhong City, according to the provisions of the Environmental Protection Law of People's Republic of China (PRC), the Water Pollution Prevention Law of People's Republic of China (PRC), the Water Law of People's Republic of China (PRC) and Shaanxi Province, Article 2 These Regulations are applicable to the prevention and control of water pollution and water ecological protection of surface water bodies and underground water bodies within the administrative area of this Municipality.

The Hanjiang River Basin as mentioned in these Regulations refers to the catchment area of the main stream of the Hanjiang River.

The term "main stream of the Han River" as mentioned in these Regulations refers to the reach of the Han River from its birthplace, ningqiang county to Zhongshan, to Xinyu Dam, a tea town in Xixiang County.

Water environmental protection in key areas such as nature reserves, wetlands and drinking water source protection areas in the Hanjiang River Basin shall be implemented in accordance with relevant laws and regulations. Article 3 The prevention and control of water pollution and water ecological protection in the Hanjiang River Basin shall adhere to the principles of giving priority to protection, giving priority to prevention, comprehensive management, public participation and responsibility for damage. Article 4 The water quality of the main stream and tributaries of the Han River shall be protected according to the water quality standards delineated by the water function zoning, and the water quality of the exit section of Hanzhong shall not be lower than Class II water quality standards. Article 5 The people's governments of cities and counties (districts) shall incorporate the water environmental protection of the Hanjiang River Basin into the national economic and social development plan, organize the formulation of water pollution prevention and control plans and annual prevention and control plans or schemes, take timely measures to prevent and control water pollution, and be responsible for the water environmental quality of the Hanjiang River Basin within their respective administrative areas.

The town people's government, sub-district offices, development zones (new districts and new towns) and scenic spots management agencies in the Hanjiang River Basin assume the responsibility of territorial management, and are responsible for implementing the water environment protection measures in the Hanjiang River Basin and doing a good job in water environment protection.

City and county (District) people's governments shall establish the target responsibility system and assessment system for water environmental protection in the Hanjiang River Basin, and organize assessment, rewards and punishments every year. Article 6 When the people's governments of cities and counties (districts) report to the people's congresses at the corresponding levels or their standing committees on the environmental conditions and the completion of environmental protection targets every year, they shall report on the water environmental protection in the Hanjiang River Basin and make it public. Article 7 The river and lake systems of cities, counties, towns and village heads shall be fully implemented, and the work of water resources protection, waterfront management, water pollution prevention, water environment management and water ecological restoration in the Hanjiang River Basin shall be organized and led by stages. Article 8 The municipal competent department of ecological environment shall implement unified supervision and management on water environmental protection in Hanjiang River Basin.

The county (district) department in charge of ecological environment shall be specifically responsible for the supervision and management of water environmental protection in the Hanjiang River Basin within their respective administrative areas.

Development and reform, industry and information technology, public security, finance, natural resources, urban management, transportation, agriculture and rural areas, forestry, water conservancy and other relevant departments shall, according to their respective functions and duties, do a good job in water environment protection in the Hanjiang River Basin according to law.

The fields and regions where comprehensive administrative law enforcement is implemented, administrative penalties and related administrative compulsory measures involving water environmental protection shall be implemented by comprehensive administrative law enforcement departments according to law. Article 9 The people's governments of cities and counties (districts) shall include the funds for water environmental protection in the Hanjiang River Basin into the fiscal budget at the corresponding level for water pollution prevention, water ecological protection, water ecological restoration and compensation for ecological protection. Article 10 The municipal and county (district) departments in charge of ecological environment shall disclose the information on water quality and water pollution prevention and control in the Hanjiang River Basin according to law, improve the procedures for public participation, and provide convenience for citizens, legal persons and other organizations to participate in and supervise the water environmental protection in the Hanjiang River Basin. Encourage and support volunteers and social organizations to participate in water environmental protection.

All units and individuals have the obligation to protect the water environment in the Hanjiang River Basin, and have the right to report acts of pollution damage to the water environment. If the report is true, the competent department of ecological environment shall reward it. Article 11 Organs and social organizations prescribed by law may bring public interest litigation in accordance with the relevant provisions of laws and regulations against acts that damage the water environment of the Hanjiang River Basin and harm the public interests.

Where an organ or social organization prescribed by law applies to the department responsible for the supervision and administration of water environmental protection for providing monitoring data, collecting evidence of pollution damage and other assistance for bringing a public interest lawsuit, the department responsible for the supervision and administration of water environmental protection shall support it. Twelfth city, county (District) department in charge of ecological environment shall establish a file of environmental integrity in the Hanjiang River Basin, record the illegal information of enterprises, institutions and other producers and operators, and announce the list of environmental violators to the society. The information recorded in the environmental integrity archives is incorporated into the social credit information system, and it serves as an important basis for relevant departments to implement joint credit rewards and punishments. Chapter II Prevention and Control of Water Pollution Article 13 The municipal and county (district) people's governments shall, in accordance with the water quality objectives of the Hanjiang River Basin and the planning requirements of the main functional areas, strictly implement the regional environmental access conditions, rationally plan the layout of industrial development and urban and rural construction, eliminate backward production capacity according to law, and promote cleaner production. Article 14 The Municipal People's Government shall uniformly plan and set up cross-county (district) river monitoring sections, and determine the position and water quality control indicators of cross-county (district) regional boundary monitoring sections.

The people's governments of counties (districts) in the Hanjiang River Basin shall take effective measures to reduce the total discharge of water pollutants and ensure that the water quality of the monitoring section reaches the specified control index. If the water quality of the monitoring section exceeds the control index, the relevant county (District) people's government shall pay the pollution compensation fee. If the water quality of the monitoring section is better than the control index, the relevant county (District) people's government will be rewarded.

The specific provisions on compensation and reward for water pollution in Hanjiang River Basin shall be formulated by the municipal competent department of ecological environment jointly with the relevant administrative departments.
