Standard of sentencing amount

Legal analysis: Every crime is different. Examples are as follows:

1. Crime of corruption: more than 5, yuan, but less than 5, yuan, but the circumstances are serious (corruption and disaster relief, emergency rescue, flood control, epidemic prevention, special care, poverty alleviation, immigration, relief funds and materials, fund-raising funds and materials, stolen money, confiscation of funds and materials, temporary withholding of funds and materials, and bad corruption methods, destruction of evidence, transfer of stolen goods and other circumstances).

2. Crime of accepting bribes: more than 5, yuan but less than 5, yuan, but under any of the following circumstances:

(1) The national or social interests have suffered heavy losses due to bribery;

(2) deliberately making things difficult for the relevant units and individuals, causing adverse effects;

(3) extorting property by force.

Legal basis: Article 271 of the Criminal Law of the People's Republic of China. Personnel of companies, enterprises or other units who take advantage of their positions and illegally take the property of their own units for themselves, if the amount is relatively large, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention; If the amount is huge, he shall be sentenced to fixed-term imprisonment of not less than five years and may also have his property confiscated.
