Regulations on the Administration of Qingshanzui Reservoir in Weichu

Chapter I General Provisions Article 1 In order to strengthen the protection, management and rational utilization of Qingshanzui Reservoir (hereinafter referred to as the Reservoir) and prevent water pollution, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC) and the Law of People's Republic of China (PRC) on the Prevention and Control of Water Pollution, combined with the actual situation of Wei Chu (hereinafter referred to as the Autonomous Prefecture). Article 2 Units and individuals engaged in activities within reservoir protection areas and water conveyance facilities shall abide by these Regulations. Article 3 The normal water level of the reservoir 18 14m (the elevation of the Yellow Sea, the same below), and the check flood level1819.84m. According to the functional requirements of flood control, irrigation, water supply, etc. , strictly protect the ecosystem of reservoir runoff area. Reservoir protection areas are divided into primary, secondary and quasi-protected areas.

(1) First-class protected area: the area within the normal water level of the reservoir, 250m upstream of the dam axis, 200m downstream of the dam toe line, 200m at both ends of the dam,100m outside the spillway boundary, 200m below the stilling basin, 50m outside the outer contour lines of other buildings and within the land ownership scope of the production and living quarters.

(2) Secondary protected area: the area outside the primary protected area and within the reservoir boundary pillar.

(3) Quasi-protected areas: reservoir runoff areas outside the first and second protected areas.

The specific scope of the reservoir protection area shall be delineated by the people's government of the Autonomous Prefecture, and boundary markers and signs shall be set up and announced to the public. Article 4 The specific protection scope of reservoir water conveyance facilities shall be delineated by the relevant county (city) people's government, and signs shall be set up and announced to the public. Article 5 The protection and management of reservoirs shall follow the principles of scientific planning, unified management, graded responsibility, rational utilization and comprehensive prevention and control. Article 6 The water quality of the first-class reservoir protection zone shall meet the Class III water quality objectives of the national surface water environmental quality standards. Seventh Autonomous Prefecture People's Government shall incorporate the protection and management of reservoirs into the national economic and social development plan, and the required funds shall be included in the fiscal budget at the corresponding level.

The people's governments of Chuxiong City, Nanhua County and Mouding County shall incorporate reservoir protection into the national economic and social development plan, formulate protection measures and implement the target responsibility system. Eighth Autonomous Prefecture People's Government shall establish an ecological compensation mechanism for reservoir protection areas, increase policy and financial support for reservoir protection areas, strengthen infrastructure construction, and effectively improve the production and living conditions of residents in reservoir protection areas.

Specific measures for ecological compensation shall be formulated by the people's government of the Autonomous Prefecture. Chapter II Management Duties Article 9 The people's government of the Autonomous Prefecture shall set up the Qingshanzui Reservoir Management Agency (hereinafter referred to as the Reservoir Management Agency) to be responsible for the protection and management of the reservoir and perform the following main duties:

(a) to publicize and implement the relevant laws, regulations and these regulations;

(two) to organize the implementation of special planning for reservoir protection and management;

(three) to formulate the reservoir dispatching plan and implement the dispatching instructions;

(four) according to the provisions of water charges, to ensure normal, safe and standardized water supply;

(five) the management, maintenance and conservation of engineering facilities in the first and second protected areas;

(six) responsible for the safety and security of the first and second protected areas;

(seven) the protection and management of water, forest, land and other resources in the first and second protected areas.

With the approval of the people's government of the Autonomous Prefecture, the reservoir management institution may exercise some administrative law enforcement rights of water affairs, environmental protection, agriculture, forestry, land and resources, transportation, tourism and other departments in the first and second protected areas. Article 10 Departments of water affairs, development and reform, finance, forestry, housing and urban and rural construction, environmental protection, public security, industry and information technology, agriculture, meteorology, land and resources, health, transportation, civil affairs, tourism, immigration and other departments of the people's governments of autonomous prefectures and relevant counties (cities) shall do a good job in reservoir protection according to their respective responsibilities. Eleventh Chuxiong City, Nanhua County, Mouding County People's Government shall perform the following duties:

(a) the preparation of non-point source pollution prevention and control and urban and rural environmental protection comprehensive improvement plan, and organize their implementation;

(two) to assist in the protection and management of the first and second protected areas of the reservoir;

(three) to do a good job in the protection and management of forest resources and soil and water conservation in reservoir protection areas;

(four) to organize and coordinate the relevant departments to implement the emergency treatment of sudden water pollution incidents;

(five) to investigate and deal with illegal acts in accordance with relevant laws and regulations and these regulations. Twelfth township (town) people's government shall perform the following duties in the reservoir protection area:

(a) the implementation of non-point source pollution prevention and control and urban and rural environmental protection comprehensive improvement plan;

(two) do a good job in the protection and management of forest resources and soil and water conservation in the reservoir protection area. Thirteenth reservoir water facilities management unit shall perform the following duties:

(a) the management and maintenance of reservoir water conveyance facilities and equipment;

(two) the implementation of flood control and drought relief instructions;

(three) to formulate the management system and safety, operation and maintenance procedures for water conveyance facilities;

(four) to carry out safety inspection of water conveyance facilities and stop acts that hinder the safety of water conveyance facilities;

(five) to assist the relevant departments in other work of reservoir protection and management. Chapter III Protection and Utilization Article 14 The relevant departments of the Autonomous Prefecture People's Government, such as development and reform, housing and urban and rural construction, land and resources, environmental protection, water affairs and reservoir management institutions, shall prepare special plans for reservoir protection and management, and report them to the Autonomous Prefecture People's Government for approval before implementation.

Reservoir management institutions shall, according to the special plan for reservoir protection and management, formulate specific implementation plans in conjunction with relevant departments.
